3. AWARD CONTRACT: ALHAMBRA PARK BANDSHELL IMPROVEMENT PROJECT –\nF2M24-22, N2M24-18, C2M24-19, M2M24-49\nOn February 12, 2024, the City Council approved a Notice Inviting Bids (NIB) for the\nAlhambra Park Bandshell Project. On Thursday, March 14, 2024, the City Clerk received\nthree bids for the Project. The bids ranged from $85,000.00 (Sanz Construction, Inc.) to\n$178,360.00 (Newbuild Construction and Restoration, Inc.). State law requires all\ncontractors and sub-contractors be registered with the Department of Industrial Relations\n(DIR). Also, the NIB required proof of DIR registration upon submittal, however, State law\ndoes not require that a bid include the submittal of proof of DIR registration. Sanz\nConstruction, Inc, did not provide proof of DIR registration with its bid submittal, but staff\nwas able to verify the company’s status on the DIR website. Staff is recommending that\nthe proof of DIR registration submittal is waived and Sanz Construction, Inc., be awarded\nthe contract based on the lowest responsive bid.\nRecommended Action: City Council award contract, subject to final language\napproval by the City Manager and City Attorney, to Sanz Construction Inc in the amount\nof $85,000.00 for the Alhambra Park Bandshell Project; determine the project is exempt\nfrom CEQA pursuant to CEQA guidelines section 15301; waive the requirement for proof\nof DIR registration with the bid submittal; and, direct staff to undertake the steps necessary\nto finalize the Council’s action.
