(6) 21-1230-S7 PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT and HOUSING COMMITTEE REPORT relative to reporting on language that fully incorporates the labor standards and the affordability requirements of Senate Bill (SB) 4, as adopted by the State Legislature, into the Department of City Planning’s (DCP) local implementation of SB 4 projects and policies; removes from the Citywide Housing Incentive projects and policies; and, removes from the Citywide Housing Incentive Program (CHIP), any local adaption of SB 4's intent so that SB 4 is the only law that governs incentives for by-right development of housing on lands governed by SB 4. A. PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT Recommendations for Council action, as initiated by Motion (McOsker, et al. - Padilla): 1. REQUEST the City Attorney, in consultation with the DCP, to include the following language in the draft CHIP Ordinance (Council file No. 21-1230-S5): a. Fully incorporate the labor standards and the affordability requirements of SB 4 (Wiener, 2023), as adopted by the State Legislature into the DCP’s local implementation of SB 4 projects and policies. b. Remove from the CHIP Ordinance any local adaptation of SB 4’s intent, so that SB 4 is the only law that governs incentives for by-right development of housing on lands governed by SB 4. 2. INSTRUCT the DCP to include in the Annual Progress Report issued by the DCP the number of projects within B. HOUSING COMMITTEE REPORT Recommendation for Council action, as initiated by Motion (McOsker, et al. – Padilla): NOTE and FILE Motion (McOsker, et al. – Padilla) relative to incorporating the labor standards and the affordability requirements of SB 4. Fiscal Impact Statement: Neither the City Administrative Officer nor the Chief Legislative Analyst has completed a financial analysis of this report.
