8A. PUBLIC HEARING TO INTRODUCE (FIRST READING) OF ORDINANCE NO.
1803 TO AMEND VARIOUS PORTIONS OF SAN CLEMENTE MUNICIPAL
CODE TITLE 2 - ADMINISTRATION AND PERSONNEL, TITLE 12 - STREETS,
SIDEWALKS, AND PUBLIC SPACES, TITLE 16 - SUBDIVISIONS, AND TITLE
17 - ZONING ORDINANCE, FOR STREAMLINING AND CLEANUP
PURPOSES, AND FINDING THE ORDINANCE EXEMPT FROM THE
REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
Continued public hearing to consider amendments to the City of San
Clemente Municipal Code Title 2, Title 12, and Title 17, to streamline
review processes for various types of projects, and be consistent with
State Law, and clarify code sections. This includes a reworked Zoning
Administrator review process that allows the City Planner to make
decisions if a notice of future decision is sent to property owners within
300 feet of a site and there is not a request a hearing.
The City Council will also consider whether the zoning amendments are
not a “project” as defined by the State CEQA Guidelines Sections
15378(b)(2) and 15378(b)(5), because the revisions relate to the ongoing
administrative or discretionary activities and organizational or
administrative activities of governments that will not result in direct or
indirect physical changes in the environment, and therefore do not
constitute a “project” as defined by the State CEQA Guidelines (Cal.
Code Regs., title 14, § 15000 et seq.).
