OFFSHORE SAND SOURCE INVESTIGATION RESULTS AND\nCONSIDERATION OF A RESOLUTION APPROVING PHASE 2, ACCEPTING\nFUNDING FROM AND APPROVING A COOPERATIVE AGREEMENT WITH\nMETROLINK/SOUTHERN CALIFORNIA RAILROAD AUTHORITY,\nAUTHORIZING AN EXEMPTION TO THE FORMAL SOLICITATION\nPROCESS, AWARDING A CONTRACT TO COASTAL FRONTIERS FOR\nPHASE 2 FIELDWORK, AUTHORIZING THE CITY MANAGER TO EXECUTE\nRELATED AGREEMENTS, MAKING RELATED SUPPLEMENTAL\nAPPROPRIATIONS AND FINDING THE ACTIONS EXEMPT FROM THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT\nRecommended Action\nAdopt Resolution 26-48, which will:\n1. Approve Phase 2 of the Offshore Sand Source Investigation project to further\nstudy the San Onofre/Agra, Santa Ana River and potentially other sites.\n2. Approve, and authorize the City Manager to execute, Contract No. C26-23,\nthe Cooperative Agreement, by and between the City of San Clemente and\nMetrolink/Southern California Railroad Authority, to accept $300,000 in\nmitigation fees to fund Phase 2 of the Offshore Sand Source Investigation\nproject (Attachment 2).\n3. Accept revenues contributed by Metrolink/Southern California Railroad\nAuthority to mitigate impacts on sand supply from a past project on the\nbeach in San Clemente in the amount of $300,000 to Account No. 001-000-\n33490.\n4. Authorize a supplemental appropriation of $300,000 (mitigation funds) to\nAccount No. 001-433-43695.\n5. Reassign $100,000 in the FY 2025-26 Adopted Budget in Account No. 001-\n636-45900-000-35807 (previously assigned to SCOUP permitting) to support\nPhase 2 of the Offshore Sand Source Investigation study to account 001-433\n-43695.\n6. Re-program $49,000 in unused funding from California Coastal Commission\nLCP Planning Grant 21-07 to LCP Grant 24-01.\n7. Award a contract to Coastal Frontiers in an amount not to exceed $449,000\nto complete the fieldwork portion of the Offshore Sand Source Investigation\nstudy.\n8. Approve, and authorize the City Manager to execute, Contract No. C26-24,\nby and between the City of San Clemente and Coastal Frontiers, providing\nthe fieldwork portion of the Offshore Sand Source Investigation study, in an\namount not to exceed $449,000 (Attachment 3), following execution of the\nCooperative Agreement with Metrolink/Southern California Railroad\nAuthority.\n9. CONTRACT AWARD FOR THE SHORELINE MONITORING PROGRAM,\nAUTHORIZING AN EXEMPTION TO THE FORMAL SOLICITATION\nPROCESS, AND FINDING THE PROJECT EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nRecommended Action\nAdopt Resolution No. 26-49, which will:\n1. Find the project is categorically exempt from the California Environmental\nQuality Act (CEQA) pursuant to CEQA Guidelines Section 15306\n(Information Collection, 14 CCR 15306).\n2. Award, approve, and Authorize the City Manager to execute, Contract No.\nC26-25, by and between the City of San Clemente and Coastal Frontiers,\nproviding for the continuation of the Shoreline Monitoring Program, in an\namount not to exceed $190,913 over a three-year period.\n3. Authorize the City Manager to negotiate and execute an amendment to\nthe Professional Services Agreement with Coastal Frontiers Corporation\nfor the Shoreline Monitoring Program to adjust the pricing for the survey\ntasks in a cumulative sum not to exceed $8,605 in the event that OCTA\ndoes not participate in funding some or all of the six surveys.\n4. Approve an exemption to the formal solicitation process in accordance\nwith City Purchasing Policy 201-2-1 Section XI.A.1.2.

PUBLIC HEARING TO INTRODUCE (FIRST READING) OF ORDINANCE NO.\n1803 TO AMEND VARIOUS PORTIONS OF SAN CLEMENTE MUNICIPAL\nCODE TITLE 2 - ADMINISTRATION AND PERSONNEL, TITLE 12 - STREETS,\nSIDEWALKS, AND PUBLIC SPACES, TITLE 16 - SUBDIVISIONS, AND TITLE\n17 - ZONING ORDINANCE, FOR STREAMLINING AND CLEANUP\nPURPOSES, AND FINDING THE ORDINANCE EXEMPT FROM THE\nREQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nContinued public hearing to consider amendments to the City of San\nClemente Municipal Code Title 2, Title 12, and Title 17, to streamline\nreview processes for various types of projects, and be consistent with\nState Law, and clarify code sections. This includes a reworked Zoning\nAdministrator review process that allows the City Planner to make\ndecisions if a notice of future decision is sent to property owners within\n300 feet of a site and there is not a request a hearing.\nThe City Council will also consider whether the zoning amendments are\nnot a “project” as defined by the State CEQA Guidelines Sections\n15378(b)(2) and 15378(b)(5), because the revisions relate to the ongoing\nadministrative or discretionary activities and organizational or\nadministrative activities of governments that will not result in direct or\nindirect physical changes in the environment, and therefore do not\nconstitute a “project” as defined by the State CEQA Guidelines (Cal.\nCode Regs., title 14, § 15000 et seq.).\nRecommended Action\n1. Opening the public hearing to receive and consider public comment, and\nclose the public hearing following the public portion of the hearing.\n2. PUBLIC HEARING TO CONSIDER A RESOLUTION TO REDUCE THE SC\nRIDES PROGRAM SUBSIDY RATE, AND FINDING THE PROJECT\nCATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL\nQUALITY ACT\nPublic hearing to consider adjustments to City/Orange County\nTransportation Authority (OCTA) subsidy rates related to the SC Rides\ntransit program.\nPursuant to California Government Code Section 66018, a public hearing\nis required prior to the adoption of new or increased fees. The proposed\nadjustments pertain solely to the subsidy rate that the City and the OCTA\nshare to help offset rider costs. A reduction in the City/OCTA subsidy may\nincrease the overall fee that SC Rides users are charged per ride. These\nfees are not mandatory taxes or assessments, but rather per-use fees to\ncover a portion of the operating and maintenance costs of the City and\nOCTA.\nRecommended Action\n1. Opening the public hearing to receive and consider public comment, and\nclose the public hearing following the public portion of the hearing.\n2. Adopt Resolution No. 26-47 entitled A RESOLUTION OF THE CITY\nCOUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ADOPTING A\nREDUCTION IN THE SC RIDES PROGRAM SUBSIDY RATE, AND\nFINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT.
