43. As-Needed Consultant Services Master Agreements Recommendation: Authorize the Director of Parks and Recreation to execute 48 Master Agreements (MAs) substantially similar to Attachment I, and any subsequent MAs to additional contractors that meet all the requirements described in the Request for Statement of Qualifications, to provide as-needed planning, landscape architecture, civil engineering, environmental, architecture, construction-cost management, real estate, community engagement and related services, graphic communications, and public relations and marketing services, and any additional service categories: administrative and operational support services, effective upon Board approval, for an initial term of three years, two one-year extension options, and month-to-month extensions for up to six months for a maximum MA term of five years and six months and a maximum annual amount of $5,000,000 per consultant. Find that the award of these agreements is not subject to the California Environmental Quality Act. Authorize the Director to take the following actions: (Department of Parks and Recreation) APPROVE Approve and execute amendments, including to execute individual work orders and amendments to work orders to incorporate necessary changes to the scope of work/project without increase to the original MA amount related to the as-needed planning, landscape architecture, civil engineering, environmental, architecture, construction-cost management, real estate, community engagement and related services, graphic communications, and public relations and marketing services, and any additional service categories: administrative and operational support services; to add, delete, and/or change certain terms and conditions as required under Federal or State law or regulation, County policy and/or the Board; to assign rights or delegation of duties should the original contracting entity merge, be acquired or otherwise change entities; and to suspend or terminate any MA if, in the opinion of the Director, it is in the best interest of the County to do so; Exercise two additional one-year extension options, and month-to-month extensions for up to six months, at the Director’s sole discretion with the contractors who have effectively performed the services during the initial MA term period and the services are still required; Extend the term of the current October 19, 2021, Board approved as needed consultant MAs past the MA expiration date of October 18, 2026, solely to allow for the completion of the ongoing work orders that were already issued prior to, but not completed by the expiration date; and Extend access to the as-needed consultants with County Departments and County-related agencies by executing Memoranda of Understanding agreements that specifies the scope of work, funding for each project consistent with the terms and conditions of the MA, including a one-time administrative fee of 12% to the Department of Parks and Recreation, and with a term that is concurrent with the MA.
