3) CONSIDERATION OF CONSTRUCTION SERVICES AGREEMENT FOR CORTEZ SENIOR &\nCOMMUNITY CENTER ROOF AND HVAC IMPROVEMENTS - PROJECT NO. 24009\nIt is recommended that the City Council take the following actions, contingent upon the City\nCouncil's approval of the amendments to the Program Year 2019 and Program Year 2023\nCommunity Development Block Grant (CDBG) Action Plans and corresponding budget\namendment:\n1. Reject the bid submitted by MBC Enterprises, Inc. as non-responsive;\n2. Award the Construction Services Agreement for the Cortez Park Senior & Community\nCenter Roof and HVAC Improvements Project (Project No. 24009) to AC Pros, Inc. as the\nlowest responsible bidder;\n3. Authorize the City Manager to negotiate and execute an agreement with AC Pros, Inc.\nfor $1,395,000.00, in such final form as approved by the City Attorney;\n4. Authorize the City Manager to negotiate and execute any amendments up to 10% of the\nawarded agreement amount;\n5. Find that the project is categorically exempt from the California Environmental Quality\nAct (CEQA) pursuant to CEQA Guidelines Section 15302 (Replacement or\nReconstruction).\nEND OF CONSENT CALENDAR\nHEARINGS
