F. ORDINANCE NO. 706: AMENDING CHAPTER 153 OF THE SAN GABRIEL\nMUNICIPAL CODE TO UPDATE THE SAN GABRIEL MUNICIPAL CODE\nRELATING TO NEW STATE LAW FOR ACCESSORY DWELLING UNITS AND\nJUNIOR ACCESSORY DWELLING UNITS (ZTA24-001) – SECOND READING\nAND ADOPTION\nAdoption of Ordinance No. 706 would amend Title XV, Chapter 153 (Zoning\nCode) of the San Gabriel Municipal Code (SGMC) relating to new state law for\nnew accessory dwelling units and junior accessory dwelling units (ZTA24-001).\nOrdinance No. 706 was approved at introduction by a 5-0 vote at the City\nCouncil at the April 16, 2024, City Council meeting. The Fiscal Year 2023-24\nAdopted Budget includes the cost for required legal publication and\ncodification of the Ordinance.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\namendments were reviewed for compliance with the California Environmental\nQuality Act (CEQA). Pursuant to Section 15061(b)(3) of the CEQA Guidelines, the\namendment to a Zoning Ordinance is not considered a project as defined in\nSection 15378 and can be seen with certainty that it will not have a significant\neffect on the environment. The proposed amendment to the Zoning Ordinance\nqualifies for this CEQA exemption as there is no possibility that the ordinance will\nhave a significant effect on the environment as it amends the City’s Municipal\nCode to demonstrate compliance with State Accessory Dwelling Units Law.\nRecommended Action:\nStaff recommends that the City Council waive reading and adopt Ordinance No.\n706 entitled, “An Ordinance of the City Council of the City of San Gabriel,\nCalifornia, Approving Planning Case No. ZTA24-001, Amending Title XV,\nChapter 153 (Zoning) Relating to New State Law for Accessory Dwelling Units\nand Junior Accessory Dwelling Units.”
