CASH AND INVESTMENT REPORT – MARCH 2024\nIn accordance with the City of San Gabriel’s 2023-2024 Adopted Investment\nPolicy (Resolution No. 23-36) and California Government Code Section 53646,\nthe Finance Director is to render an investment report to the City Council, City\nTreasurer, City Manager, and the City Attorney. The Cash and Investment\nReport is presented to receive and file in accordance with the City’s adopted\n2023-24 Investment Policy.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council receive and file the Cash and\nInvestment Report for March 2024.

D. FOURTH AMENDMENT TO CITY MANAGER EMPLOYMENT AGREEMENT\nBETWEEN THE CITY OF SAN GABRIEL AND MARK LAZZARETTO\nThe proposed Fourth Amendment to the City Manager Employment\nAgreement would extend the City Manager’s term of employment by an\nadditional five years, to February 5, 2031, and increase the City Manager’s base\nsalary by five percent (5%), to $257,317. Additionally, the annual base salary of\nthe City Manager shall never be less than 105% of the top range of the base\nsalary of the City’s next-highest paid employee. No change to any other\nprovision of the employment agreement of any kind is proposed. The Fourth\nAmendment affirms an increase of $12,253 to the City Manager’s annual base\nsalary. The annualized costs are covered in the existing 2024-2025 fiscal year\nbudget.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council approve the Fourth Amendment to the\nCity Manager Employment Agreement between the City of San Gabriel and\nMark Lazzaretto.

E. RESOLUTION NO. 24-24 ADOPTING RETIREE MEDICAL VESTING UNDER\nSECTION 22904 OF THE PUBLIC EMPLOYES’ MEDICAL AND HOSPITAL\nCARE ACT\nIn November 2022, the City and its five distinct employee bargaining groups\nmutually agreed upon successor labor agreements. An important part of these\nagreements was the restructuring of the City’s retiree medical benefit provided\nby Section 22893 of the Public Employees’ Medical and Hospital Care Act\n(PEMHCA). Resolution No. 24-24 adopts Section 22904 of the Public\nEmployees’ Medical and Hospital Care Act and establishes a multi-tiered retiree\nmedical benefit system for the City of San Gabriel for employees starting service\non January 1, 2023 and after. Resolution No. 24-24 and Section 22904 of\nPEMHCA are expected to markedly reduce the City’s $44.1 million Other Post\nEmployment Benefits Liability over the next 10-15 years as the number of\nretiree medical beneficiaries subject to Section 22904 (Tier 3) increases.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 24-24, which\napproves the implementation of Section 22904 of Public Employees’ Medical\nand Hospital Care Act and establishes a third tier of retiree medical benefits for\nemployees first hired on a full-time basis on or after January 1, 2023, and\nelected officials who first served as elected officials on or after January 1, 2023.

F. ORDINANCE NO. 706: AMENDING CHAPTER 153 OF THE SAN GABRIEL\nMUNICIPAL CODE TO UPDATE THE SAN GABRIEL MUNICIPAL CODE\nRELATING TO NEW STATE LAW FOR ACCESSORY DWELLING UNITS AND\nJUNIOR ACCESSORY DWELLING UNITS (ZTA24-001) – SECOND READING\nAND ADOPTION\nAdoption of Ordinance No. 706 would amend Title XV, Chapter 153 (Zoning\nCode) of the San Gabriel Municipal Code (SGMC) relating to new state law for\nnew accessory dwelling units and junior accessory dwelling units (ZTA24-001).\nOrdinance No. 706 was approved at introduction by a 5-0 vote at the City\nCouncil at the April 16, 2024, City Council meeting. The Fiscal Year 2023-24\nAdopted Budget includes the cost for required legal publication and\ncodification of the Ordinance.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\namendments were reviewed for compliance with the California Environmental\nQuality Act (CEQA). Pursuant to Section 15061(b)(3) of the CEQA Guidelines, the\namendment to a Zoning Ordinance is not considered a project as defined in\nSection 15378 and can be seen with certainty that it will not have a significant\neffect on the environment. The proposed amendment to the Zoning Ordinance\nqualifies for this CEQA exemption as there is no possibility that the ordinance will\nhave a significant effect on the environment as it amends the City’s Municipal\nCode to demonstrate compliance with State Accessory Dwelling Units Law.\nRecommended Action:\nStaff recommends that the City Council waive reading and adopt Ordinance No.\n706 entitled, “An Ordinance of the City Council of the City of San Gabriel,\nCalifornia, Approving Planning Case No. ZTA24-001, Amending Title XV,\nChapter 153 (Zoning) Relating to New State Law for Accessory Dwelling Units\nand Junior Accessory Dwelling Units.”

G. COOPERATIVE AGREEMENT WITH LOS ANGELES COUNTY FOR THE\nANNUAL STREETS PROGRAM FISCAL YEAR 2023-2024 AT AN ESTIMATED\nCOST OF $557,015\nAs part of this year’s Annual Streets Program, the City of San Gabriel plans to\nrepave Broadway and Walnut Grove Avenue which are jurisdictionally shared\nbetween the City of San Gabriel and the County of Los Angeles. Due to the\nscope and cost of the project, the County policy requires a Cooperative\nAgreement be executed for the joint-agency repaving project. The City’s share\nis estimated to be $2,052,929.64 and the County’s share is estimated to be\n$557,015. The County will pay a deposit of $590,000 to the City, covering the\nanticipated estimated project cost share of $557,015. Upon the completion of\nthe project, the City will invoice the County for their actual share costs of the\nproject.\nCalifornia Environmental Quality Act (CEQA) Determination: This project is\ndetermined to be Categorical Exempt per CEQA Section 15301 – Existing\nFacilities. The project will improve the existing condition of local streets. No\npotential for significant impacts to the environment are anticipated in this project.\nRecommended Action:\nStaff recommends that the City Council authorize the Mayor of San Gabriel to\nexecute the Cooperative Agreement between the City and Los Angeles County\nand authorize City staff to invoice Los Angeles County for their actual share\ncosts of the project.

H. APPROVAL OF L.A. METRO EXPRESSLANES NET TOLL REVENUE\nREINVESTMENT FUNDS AGREEMENT FOR THE SAN GABRIEL ROADWAY\nSAFETY IMPROVEMENTS AND BIKE LANE INSTALLATION (CONTRACT NO.\nMX202304) FOR $1,269,109 AND APPROVAL OF THE CITY’S LABOR IN-\nKIND MATCH OF $162,600 WITH AN ADDITIONAL $80,000 OF MEASURE\nR MATCHING FUNDS TO ACQUIRE VIDEO DETECTION SYSTEMS\nThe Los Angeles County Metropolitan Transportation Authority (LACMTA)\nawarded the San Gabriel Roadway Safety Improvements and Bike Lane\nInstallation Project with a total project budget of $1,511,709. This project aims\nto improve bike and pedestrian safety at 13 locations, extend the bike lane on\nDel Mar Avenue to bridge the gap leading to the City of San Marino, and install\n25 Rectangular Rapid Flashing Beacons (RRFB) at 25 existing high-risk crosswalk\nlocations. The City is required to enter into funding agreements with LACMTA\nto accept $1,269,109 of Net Toll Revenue Reinvestment Funds. The project\nrequires the City to provide $162,600 labor in-kind match, along with $80,000\nof Measure R Matching funds.\nCalifornia Environmental Quality Act (CEQA) Determination: This is not a project\nas defined in Section 15378 of the State CEQA Guidelines. The project will include\nthe improvement of the existing intersections and addition of additional striping\nand markings to the existing roadways within the public right-of-way facility.\nIrrespective of the exemption, no potential significant impacts to the environment\nare anticipated from this project.\nRecommended Action:\nStaff recommends that the City Council approve the Los Angeles County\nMetropolitan Transportation Authority Funding Agreement MXL Grant\n#MX202304 in Toll Revenue Reinvestment funds for the San Gabriel Roadway\nSafety Improvements and Bike Lane Installation Project, authorize the Mayor to\nexecute the funding agreements on behalf of the City, and approve the City’s\nlabor in-kind match of $162,600 with an additional $80,000 of Measure R\nMatching funds to acquire video detection systems as part of Capital\nImprovement Project #2-21-02.

MEMORANDUM OF AGREEMENT WITH THE SAN GABRIEL VALLEY\nCOUNCIL OF GOVERNMENTS APPROVING A PROPORTIONAL SHARE OF\nTHE ADDITIONAL EXPENDITURES RELATED TO THE 2018-2023\nMEMORANDUM OF AGREEMENT IN THE AMOUNT OF $8,599.32 FOR\nVARIOUS STORMWATER MANAGEMENT PROGRAMS [RESOLUTION NO.\n24-23]\nThe 2018-2023 Memorandum of Agreement between the San Gabriel Valley\nCouncil of Government (SGVCOG) and the City, intended for administration and\ncost sharing in the implementation of monitoring programs, exceeded the\noriginal scope of work. The City’s proportional overage share is $8,599.32. In\norder to reconcile these overages, the SCVCOG will enter into a new agreement\nwith the City to facilitate payment collection.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 24-23 to\nappropriate $8,599.32 from the Safe, Clean Water Program (Measure W) fund\nto the Stormwater Contractual account 138-800-03-22-000, authorize the City\nManager to execute the Memorandum of Agreement with the San Gabriel\nValley Council of Governments, and approve a purchase order in the amount\nof $8,599.32 using account number 138-800-03-22-000.

J. APPROVAL OF MISSION PLAYHOUSE TICKETING SOFTWARE CONTRACT\nWITH AUDIENCEVIEW\nSince 2016, the City of San Gabriel has used Ticketmaster LLC for ticketing\nservices for the Mission Playhouse. The initial User Agreement had a set term\nof three years and expired in December of 2019.\nStaff has reviewed options for new ticketing software and recommends the\napproval of a contract with AudienceView. The proposed agreement is for five\nyears and will be up for renewal in April of 2029.\nThe report recommends the City Council discontinue the partnership with\nTicketmaster and authorize the City Manager to enter into an agreement with\nAudienceView.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council approve the AudienceView contract\neffective immediately and include the related ongoing expenses in the Fiscal\nYear 2024-25 budget. Staff also recommends that the City Council authorize\nthe City Manager to execute the contract with Card Connect pending approval\nby the City Attorney.

K. PURCHASE OF NEW POLICE MOTORCYCLE - $39,316.78\nPublic Works Fleet staff have determined that the 2015 Honda police\nmotorcycle is long overdue for replacement as a viable patrol motorcycle and\nwill likely soon need major repairs. The proposed replacement for the 2015\nHonda ST 1300 is the 2024 Harley Davidson FLTRXP which is more reliable, has\nlower maintenance costs, and has been a tested and proven a more reliable\npolice motorcycle than the older Honda which has been phased out of service\nat many agencies. Honda has discontinued its production of police\nmotorcycles. This information was confirmed by the 48th Annual Law\nEnforcement Motorcycle Test and Evaluation program conducted in 2022. The\nHarley Davidson model received the overall rating of “Above Average” for the\nevaluation, and no major manufacturer changes have been implemented in\n2024.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council approve the purchase of one 2024\nHarley Davidson from Laidlaw Harley Davidson utilizing Office of Traffic Safety\nSelective Traffic Enforcement Program Grant #24174 funds from account #124-\n751-52-99-201.

A. PROPOSED CITYWIDE FEE SCHEDULE FOR FISCAL YEAR 2024-2025\n[RESOLUTION NO. 24-26]\nThe citywide fee schedule establishes user fees and charges for various\ndepartment-related services. User fees and regulatory fees charged by the City\nmay not exceed the estimated reasonable cost to provide the service or\nregulate the activity. Fees for the use of public property are considered rents.\nRents are set at the discretion of the City and are not limited by cost recovery.\nThe consumer price index (CPI) for the Los Angeles Metro area, for January\n2024, increased by 2.5%. Based on the Fiscal Year 2024-25 forecasted revenues,\na 2.5% to general fund fees is estimated to generate approximately an\nadditional $160,000 in general fund revenue.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council adopt Resolution No. 24-26 updating\nthe Master Fee Schedule for Fiscal Year 2024-25.
