11. Updating the Rent Stabilization and Tenant Protections Ordinance\nRecommendation as submitted by Supervisor Mitchell: Extend the current 4%\nrental increase cap in the unincorporated County through December 31, 2024;\ninstruct County Counsel, in consultation with the Director of Consumer and\nBusiness Affairs, to return to the Board with an amendment to County Code,\nTitle 8 - Consumer Protection, Business and Wage Regulations, Chapter 8.52 -\nRent Stabilization and Tenant Protections Ordinance (RSTPO), reflecting the\nabove extension of the current 4% rental increase cap, from July 1, 2024\nthrough December 31, 2024, for fully covered rental units in the unincorporated\nCounty; and take the following actions:\nInstruct the Director of Consumer and Business Affairs, in consultation\nwith the Chief Executive Officer and County Counsel, to return to the\nBoard with a further amendment to the RSTPO to reflect the following,\neffective January 1, 2025:\nLimit annual rent increases for fully covered rental units subject to\nthe RSTPO to 60% of the percentage change in the Consumer\nPrice Index over the previous 12-month period ending in\nSeptember, not to exceed a maximum rent increase of 3%, unless\notherwise determined by the Department of Consumer and\nBusiness Affairs (DCBA);\nPrior to December 31, 2026, a Small Property Owner may\nincrease rent on a rental unit by an additional 1% annually above\nthe allowable annual rental increase specified above for a rental\nunit, which shall not exceed 4%, unless otherwise determined by\nDCBA, and define a “Small Property Owner” as a landlord that\nmeets the requirements below:\nIs qualified for, and receives a Homeowners' Property Tax\nExemption for the property on which the subject rental unit\nis located; or\nOwns or controls only one rental property with no more than\n50 rental units; or\nOwns or controls no more than three rental properties with a\ncombined total of no more than 10 rental units, including\nany outside of the County; and\nInstruct the Director of Consumer and Business Affairs to update the\nRent Registry registration process to require registrants who identify as\nSmall Property Owners and meet the definition above, to provide\nself-certification under penalty of perjury; and report back to the Board in\nwriting by March 31, 2026, on the status and outcomes of RSTPO\nupdates per this motion, with the report to include, but not be limited to, a\nreview and assessment of the number and outcomes of fair return cases,\nand recommendations on the formula, pass-throughs, and streamlined\napplication processes.
