3. AN ORDINANCE OF THE CITY OF BEVERLY HILLS AUTHORIZING THE CITY MANAGER TO\nREMOVE CERTAIN CURBSIDE PICKUP ZONES, READOPTING CITY MANAGER AUTHORITY\nTO ISSUE PERMITS FOR OUTDOOR DINING, READOPTING WAIVER OF SPECIAL EVENT\nPERMIT FEES AND REQUIREMENTS FOR OUTDOOR DINING AND ADDING ARTICLE 8 TO\nCHAPTER 4 OF TITLE 4 OF THE BEVERLY HILLS MUNICIPAL CODE; AND\nMAKING FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. First\nReading - Introduction\nComment: On February 7, 2023, the City Council provided direction on codifying certain emergency\nregulations related to COVID-19. The emergency regulations in this proposed ordinance include: (1)\ndelegation of authority to the City Manager to oversee, review, and remove any currently designated\ncurbside pickup zones that were established as a result of COVID-19 if certain criteria are met and (2)\nestablishing maximum fees a third-party food delivery service may charge restaurants and customers.\nThe City Council also provided direction that (1) the delegation of authority to the City Manager to issue\nstreet closure permits and other permits necessary to allow outdoor dining shall continue and (2) the\nwaiver of fees and minimum period for filing an application for a special event permit for outdoor dining\nand participants in OpenBH shall continue until the City Council formally approves a long-term program\nfor OpenBH participants related to the issuance of permits, adoption of fees, and establishment of design\n& operating standards associated with the OpenBH program.
