Introduction and Adoption by First Reading of Ordinance No. 753 repealing Ordinance No. 677,\nterminating Development Agreement No. 18-012C, between the City of Cudahy and 420 Club, LLC\n(page 2413)\nPresented by the Assistant Planner\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open the public hearing and receive comments and testimony; and\n2. Make a determination that 420 Club, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-012C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading Ordinance No. 753 repealing\nOrdinance No. 677 terminating DA No. 18-012C, between the City of\nCudahy (“City”) and 420 Club, LLC; and\n4. Schedule the second reading of Ordinance No. 753 at the next\nregularly scheduled meeting on August 20, 2024; and\n5. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
