3. Consider adopting Ordinance No. O2M24-4832 by a 4/5 vote:\nAN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF\nALHAMBRA, CALIFORNIA, ENACTED PURSUANT TO CALIFORNIA\nGOVERNMENT CODE SECTION 65858, EXTENDING A TEMPORARY\nMORATORIUM ON THE ISSUANCE OF PERMITS OR ENTITLEMENTS FOR\nANY SELF-STORAGE PROJECT IN THE CITY\nIf adopted, this ordinance will go into effect immediately extending Ordinance No. O2M23-\n4816 for a period of one year, unless regulations governing self-storage projects are adopted\nsooner.\n3. CONSIDERATION OF AN URGENCY INTERIM ZONING ORDINANCE EXTENDING\nORDINANCE NO. O2M23-4818, THE PROHIBITION ON THE ESTABLISHMENT OF\nNEW FIREARMS SALES BUSINESSES AND DETERMINE THIS ACTION IS EXEMPT\nFROM CEQA – F2M23-7, N2M24-80, O2M24-4833, O2M23-4818, M2M24-128\nAt the September 25, 2023 City Council meeting, the City Council adopted an urgency\nordinance placing a temporary moratorium prohibiting the establishment of new firearm\nsales businesses in the City. (“Moratorium”). On October 23, 2023, the City Council voted\nto extend the Moratorium, to be effective until September 24, 2024. The reasons for the\nmoratorium and its first extension are set forth in Ordinance No. O2M23-4818. Staff\ncontinues to work on permanent regulations, and has been monitoring legislation and\npending litigation as to the enforceability of potential regulations. Staff anticipates bringing\nforward a buffer ordinance that would limit the establishment of new retail firearm sales\nbusinesses in areas near sensitive uses. In the meantime, given the duration of the\nmoratorium, staff is also recommending that the moratorium not apply to the relocation of\nexisting businesses within the City, provided that any such business is not proposing to\nexpand its business. The current moratorium will expire at the end of September 24, 2024.\nThe extension will last for an additional year until and through July 22, 2025, unless new\nregulations are adopted. A report detailing the intended course of action by staff has been\navailable in the City Clerk’s office since July 11, 2024.\nRecommended Action: City Council take the following actions:\n1. Conduct a public hearing.\n2. Find that the recommended action is exempt from the California Environmental Quality\nAct ("CEQA") as set forth in the attached Urgency Ordinance (M2M24-128); and,\n3. Consider adopting Ordinance No. O2M24-4833 by a 4/5 vote:\nAN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF\nALHAMBRA, CALIFORNIA, ENACTED PURSUANT TO CALIFORNIA\nGOVERNMENT CODE SECTION 65858, EXTENDING A TEMPORARY\nMORATORIUM ON THE ISSUANCE OF PERMITS OR ENTITLEMENTS FOR\nANY SELF-STORAGE PROJECT IN THE CITY\nIf adopted, this ordinance will go into effect immediately extending Ordinance No. O2M23-\n4818 for a period of one year, unless permanent regulations governing firearms sales\nbusinesses are adopted sooner.
