13. APPEAL OF A PLANNING COMMISSION DECISION OF DENIAL OF SITE PLAN REVIEW AND ZONE\nVARIANCE REQUESTS FOR REDUCED LOT SIZE, REDUCTION IN FRONT YARD SETBACK, AND LOT\nCOVERAGE, AS WELL AS THE DENIAL OF A RECOMMENDATION OF APPROVAL TO THE CITY COUNCIL\nREGARDING VESTING TENTATIVE TRACT MAP (“VTTM”) NO. 084478 TO SUBDIVIDE ONE LEGAL LOT\nRESULTING IN THE CREATION OF 16 LEGAL LOTS TO ACCOMMODATE 15 SINGLE-FAMILY DWELLING\nUNITS INCLUDING A COMMON PARCEL FOR STREETS, UTILITIES, AND A PRIVATE PARK (CASE NO.\nPC-2024-0002-SPR/ZV/TTM) FOR THE PROPERTY LOCATED AT 301 JACMAR DRIVE.\nRECOMMENDATION: It is recommended that the City Council:\n1. Conduct a Public Hearing to consider all matters presented at the public hearing, uphold the Planning\nCommission denial of PC-2024-0002/SPR/ZV/TTM, and direct staff to bring back a City Council\nResolution containing findings supporting the Planning Commissions denial of PC-2024-0002-\nSPR/ZV/TTM; or\n2. Conduct a public hearing to consider all matters presented at the public hearing, adopt a resolution\noverturning the Planning Commission decision to deny PC-2024-0002-SPR/ZV/TTM and approving PC-\n2024-0002-SPR/ZV/TTM, which would become effective after City Council’s findings are referred to the\nPlanning Commission and the Planning Commission provides a further report on the matter per\nMontebello Municipal Code 17.78.130 “Council decisions contrary to planning commission action;” and\n3. Take such additional, related action that may be desirable.
