43. RESCIND PRIOR JULY 22, 2024 ACTION FOR ORDINANCE NO. O2M24-4831 AND\nSECOND READING AND CONSIDERATION FOR ADOPTION OF ORDINANCE NO.\nO2M24-4831 APPROVING ZONING TEXT AMENDMENT AMD-24-01 MAKING\nGENERAL CLARIFYING UPDATES TO THE CITY’S ZONING CODE AND DETERMINE\nTHIS ACTION IS EXEMPT FROM CEQA – F2M20-24, O2M24-4831\nOrdinance No. O2M24-4831 was introduced for first reading at the June 24, 2024 City\nCouncil meeting and returned for a second reading and adoption at the July 22, 2024 City\nCouncil meeting. Shortly thereafter, it was identified that there was an inconsistency\nbetween the Zoning Text Amendment language introduced at first reading and the\n20\n8-26-24\nlanguage adopted at second reading. Specifically, the text introduced at first reading\nincluded a clarifying statement in Alhambra Municipal Code (“AMC”) Sections 23.05.030.C\n(Minimum Residential Density, CBD, EMC, CMU, and AC Districts) and 23.06.030.A\n(Minimum Residential Density, PO and I Districts) specifying that the provisions of those\nsections only apply “if residential uses are proposed for the site.” This clarifying statement\nwas not included in the text adopted at second reading on July 22nd. Additionally, there\nwere minor inconsistencies found in AMC Section 23.22.040 (Accessory Dwelling Units).\nTo rectify these inconsistencies, the language of the Zoning Text Amendment has been\nrevised to reflect what was initially introduced for first reading on June 24th and to be\nconsistent with State law, and the Ordinance is returning for re-introduction for second\nreading and adoption.\nRecommended Action: City Council:\n1. Rescind the Council’s prior action on July 22, 2024 with respect to Ordinance No.\nO2M24-4831;\n2. Re-introduce for its second reading and adopt the following ordinance entitled:\nOrdinance No. O2M24-4831: AN ORDINANCE OF THE CITY COUNCIL OF\nTHE CITY OF ALHAMBRA ADOPTING ZONING TEXT AMENDMENT AMD-\n24-01 AMENDING THE ALHAMBRA MUNICIPAL CODE TO ADDRESS NEW\nSTATE LAWS, ELIMINATE INCONSISTENCIES, CLARIFY AMBIGUOUS\nPROVISIONS, CORRECT TYPOGRAPHICAL AND FORMATTING ERRORS,\nAND MODIFY USE ALLOWANCES
