4-A. CONSIDERATION AND POSSIBLE ACTION TO ADOPT A RESOLUTION APPROVING A\nSECOND ONE-YEAR TIME EXTENSION FOR CONDITIONAL USE PERMIT (CUP-18-01) TO\nCONSTRUCT 40-UNIT SENIOR CITIZEN HOUSING DEVELOPMENT AT 130-206 SOUTH\nCHANDLER AVENUE\nIt is recommended that the City Council consider:\n(1) Opening a public hearing to receive documentary and testimonial evidence;\n(2) After closing the public hearing and considering the evidence, adopt a resolution approving\na time extension for Conditional Use Permit (CUP-18-01); and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the extension under the California Environmental\nQuality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated\nthereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guidelines\n§§ 15060(c)(2), 15061(b)(3), and 15378 exempt activities that will not result in a direct or\nreasonably foreseeable indirect physical change in the environment, activities where there is\npossibility that it may have a significant effect on the environment, and activities that do not\nconstitute a “project” as defined, respectively. This activity contemplates extending the expiration\ndate of a conditional use permit. Accordingly, this activity is exempt from further review.\nAdditionally, the environmental impacts regarding this request were adequately reviewed in\naccordance with the IS/MND adopted by Resolution No. 12135. Consequently, the findings set\nforth in Section 3 of Resolution No. 12135 are incorporated by reference as if fully set forth.
