CONSIDERATION AND APPROVAL OF ORDINANCE NO. 1278,\nAMENDING CHAPTER 8.40 OF TITLE 8 OF THE SOUTH EL MONTE\nMUNICIPAL CODE REGARDING TOBACCO AND ELECTRONIC\nCIGARETTE RETAIL PERMITTING REGULATIONS\nThe City of South El Monte (“City”) currently regulates tobacco and\nelectronic cigarette retail through South El Monte Municipal Code\n(“SEMMC”) Chapter 8.40, Tobacco and Electronic Cigarette Retail\nPermitting Regulations. This Chapter introduced a permitting process for\ntobacco retailers. Ordinance No. 1278 (“Ordinance”) would amend\nChapter 8.40 in order to prohibit the sale of flavored tobacco and\nelectronic cigarette products, the repackaging of tobacco products, and\nestablishing a radius requirement between a tobacco retailer and youth-\noriented areas.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Find that California Environmental Quality Act (CEQA) in\naccordance with Section 21065 of CEQA and State CEQA\nGuidelines Sections 15060(c)(2), 15060(c)(3), and 15378 applies;\n2. Conduct the first reading of Ordinance No. 1278, amending\nSEMMC Chapter 8.40 to prohibit the sale of flavored tobacco and\nelectronic cigarettes products, the repackaging of tobacco products,\nand establishing a radius requirement between a tobacco retailer\nand youth-oriented areas in order to preserve the health, safety,\nand welfare of all community members (especially minors) and to\nenforce all Federal and State tobacco regulations to the fullest\nextent permitted by law; and\n3. Set adoption of said ordinance at the next regular city council\nmeeting.
