CONSIDERATION AND APPROVAL OF ORDINANCE NO. 1276,\nAMENDING CHAPTER 2.04 OF TITLE 2 OF THE SOUTH EL MONTE\nMUNICIPAL CODE REGARDING COMPENSATION OF MAYOR AND\nCOUNCILMEMBERS\nCalifornia Government Code Section 36516(a)(4) provides that cities may\nincrease the salary of councilmembers five percent (5%) for each calendar\nyear from the operative date of the last adjustment. The proposed\namendment for the change in salary shall become effective when one or\nmore councilmembers commences a new term on or about December 10,\n2024.\nRECOMMENDED ACTION: Staff recommends City Council waive first\nreading and introduce Ordinance No. 1276, regarding the compensation of\nCouncilmembers pursuant to California Government Code section 36516.\nGeneral Business Items 9.b. through 9.d. next page.\nGENERAL BUSINESS (CONTINUED)

CONSIDERATION AND APPROVAL OF RESOLUTION NO. 24-226,\nAPPROVING COST OF LIVING ADJUSTMENTS FOR JOB\nCLASSIFICATIONS NOT SUBJECT TO A MEMORANDUM OF\nUNDERSTANDING\nInflation affects the cost of living for employees. Most government\nagencies, including federal, states, counties, and others, such as\npensions, recognize this economic reality and provide cost of living\nadjustments (COLAs) for their employees. For retirees, Social Security\nand CalPers provide COLAs so that retirees can also retain their\npurchasing power as inflation increases.\nRECOMMENDED ACTION: Staff recommends City Council adopt\nResolution No. 24-226, approving cost of living adjustments of 5% for the\nCity’s executive and part-time non-represented employees for FY 2024-25,\nFY 2025-26, and FY 2026-27.

CONSIDERATION AND APPROVAL OF ORDINANCE NO. 1277,\nADDING CHAPTER 8.22 OF TITLE 8 OF THE SOUTH EL MONTE\nMUNICIPAL CODE THEREBY AMENDING THE CITY’S HEALTH AND\nSAFETY REGULATIONS IN RELATION TO CAMPING AND STORAGE\nOF PERSONAL PROPERTY\nThe City Attorney’s Office and City staff are presenting proposed\nOrdinance No. 1277, “AN ORDINANCE OF THE SOUTH EL MONTE\nCITY COUNCIL ADDING CHAPTER 8.22 OF TITLE 8 OF THE SOUTH\nEL MONTE MUNICIPAL CODE THEREBY AMENDING THE CITY’S\nHEALTH AND SAFETY REGULATIONS IN RELATION TO CAMPING\nAND STORAGE OF PERSONAL PROPERTY (ORDINANCE NO. 1277).”\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Find that the ordinance is not subject to the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Regulation\n15061(b)(3);\n2. Based on the analysis provided in the attached ordinance, waive\nfirst reading and introduce Ordinance No. 1277; and\n3. 9.e. CONSIDERATION AND APPROVAL OF ORDINANCE NO. 1278,\nAMENDING CHAPTER 8.40 OF TITLE 8 OF THE SOUTH EL MONTE\nMUNICIPAL CODE REGARDING TOBACCO AND ELECTRONIC\nCIGARETTE RETAIL PERMITTING REGULATIONS\nThe City of South El Monte (“City”) currently regulates tobacco and\nelectronic cigarette retail through South El Monte Municipal Code\n(“SEMMC”) Chapter 8.40, Tobacco and Electronic Cigarette Retail\nPermitting Regulations. This Chapter introduced a permitting process for\ntobacco retailers. Ordinance No. 1278 (“Ordinance”) would amend\nChapter 8.40 in order to prohibit the sale of flavored tobacco and\nelectronic cigarette products, the repackaging of tobacco products, and\nestablishing a radius requirement between a tobacco retailer and youth-\noriented areas.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Find that California Environmental Quality Act (CEQA) in\naccordance with Section 21065 of CEQA and State CEQA\nGuidelines Sections 15060(c)(2), 15060(c)(3), and 15378 applies;\n2. Conduct the first reading of Ordinance No. 1278, amending\nSEMMC Chapter 8.40 to prohibit the sale of flavored tobacco and\nelectronic cigarettes products, the repackaging of tobacco products,\nand establishing a radius requirement between a tobacco retailer\nand youth-oriented areas in order to preserve the health, safety,\nand welfare of all community members (especially minors) and to\nenforce all Federal and State tobacco regulations to the fullest\nextent permitted by law; and\n3. Set adoption of said ordinance at the next regular city council\nmeeting.
