3-I. \nMONTEREY PASS ROAD OVERLAY – AWARD OF PUBLIC WORKS CONTRACT TO \nHARDY & HARPER, INC. \nIt is recommended that the City Council consider: \n(1) \nAuthorizing the City Manager to execute a public works contract, in a form approved by \nthe City Attorney, with Hardy & Harper, Inc. in the contract amount of $1,133,912 for the \nMonterey Pass Road Overlay Project; \n(2) \nAppropriating an additional $150,000 from Fund 241 Prop C Funds, and an additional \n$100,000 from Fund 100 General Funds to the FY2024-25 budget; \n(3) \nAuthorizing the Director of Public Works to approve change orders not to exceed $113,392 \nover the total contract amount; and \n(4) \nTaking such additional, related, action that may be desirable. \nCEQA (California Environmental Quality Act): \nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the \nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and \nthe regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA \nGuidelines”). CEQA Guideline § 15301(c) (Existing Facilities) exempts the operation, repair, \nmaintenance, alteration of existing public or private structures which involve negligible or no \nexpansion of existing or former use. The proposed work will occur entirely within an existing \nstructure. Accordingly, no further environmental review is required.
