15.a CONSIDERATION OF RESOLUTION NO. 2022-110 — RECITING THE FACT\nOF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022,\nDECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY\nLAW. (0430-40)\n\nCity Clerk Kelly gave a PowerPoint presentation stating the November 8, 2022\nGeneral Municipal Election results for the City of Imperial Beach as follows:\n\nPursuant to Resolution No. 2022-41 the Registrar of Voters of the County of San\nDiego consolidated the General Municipal Election with the statewide General\nElection, canvassed the returns of the election and has certified the results to this\nCity Council, the results are received, attached and made a part of Resolution\nNo. 2022-110 as “Exhibit A.”\n\nIn accordance with California Elections Code 10263 that upon the completion of\nthe canvass, and before installing the new officers, the governing body of the city\nshall adopt a resolution reciting the facts of the election and such other matters\nas are enumerated in EC 10264. Also known as the Statement of the Vote.\n\nThe whole number of votes cast in the precincts (vote centers) except vote by\nmail voter ballots was 733. That the whole number of vote by mail voter ballots\ncast in the City was 5,384, making a total of 6,117 votes cast in the City.\n\nThe names of persons voted for at the General Municipal Election for Mayor and\nthe total number of votes received for each candidate are as follows:\nPALOMA AGUIRRE 2,688\nSHIRLEY NAKAWATASE — 2,341\n\nJOHN “JACK” FISHER 795\nVANCE E. LOCKE 99\nTOTAL 5,923\n\nThe names of persons voted for at the General Municipal Election for Member of\nthe City Council, District 1 and the total number of votes received for each\ncandidate are as follows:\n\nCAROL SEABURY 548\nJEN CRUMLEY 478\nTOTAL 1,026\n\nThe names of persons voted for at the General Municipal Election for Member of\nthe City Council, District 3 and the total number of votes received for each\ncandidate are as follows:\n\nMITCHELL “MITCH” MCKAY 1,127\nANNA WEBB 820\nTOTAL 1,947\n\nThe measure voted upon at the General Municipal Election and the total number\nof votes received are as follows:\n\nIMPERIAL BEACH QUALITY OF LIFE MEASURE. Shall the measure to\nmaintain quality of life for residents, retain local businesses, jobs; keep\nneighborhoods, beaches, parks, public areas safe/clean, maintain 911\nemergency response; reduce traffic congestion; gain community benefit from\ntourism by increasing the transient occupancy tax (paid by hotel, motel, shortterm rental guests) by 4%, providing about $400,000 annually until ended by\nvoters, with annual audits, public disclosure of spending, all funds for Imperial\nBeach, be adopted?\n\nThe number of YES votes received was: 3,904 (67.36%)\nThe number of NO votes received was: 1,892 (32.64%)\nTOTAL 5,796\n\nThe certified results declare and determine that:\n\nPaloma Aguirre was elected as Mayor for the full term of four years; Carol\nSeabury was elected as Member of City Council for District 1 for the full term of\nfour years; Mitchell “Mitch” McKay was elected as Member of City Council for\nDistrict 3 for the full term of four years; and a majority of the voters (50% plus\none) voting on the measure relating to Measure "R" did vote in favor of it and that\nthe measure was carried, and shall be deemed adopted and ratified.\n\nPublic comments: None.\nMotion by Councilmember Spriggs\nSeconded by Councilmember Leyba-Gonzalez\n\nTo adopt Resolution No. 2022-110 declaring the results of the November 8, 2022\nElection.\n\nAYES (4): Mayor Pro Tem Fisher, Councilmember Leyba-Gonzalez,\nCouncilmember Aguirre, and Councilmember Spriggs\n\nABSENT (1): Mayor Dedina\nMotion Carried (4 to 0)

15.b SECOND READING/ADOPTION OF ORDINANCE NO. 2022-1216 ADOPTED\nBY THE VOTERS AT THE NOVEMBER 8, 2022 ELECTION TO APPROVE AN\nINCREASE IN THE TRANSIENT OCCUPANCY TAX. (0430-95)\n\nCity Attorney Lyon reported on the item. She stated this is an administrative item,\nthe ordinance was approved by the voters, and the City Council is being asked to\ndo the second reading and adoption of the ordinance to increase the Transient\nOccupancy Tax rate pursuant to voter approval at the November election.\n\nPublic comments: None.\n\nCity Clerk Kelly read the title of Ordinance No. 2022-1216 "AN ORDINANCE OF\nTHE CITY OF IMPERIAL BEACH, CALIFORNIA, AMENDING SECTION\n3.24.030A OF CHAPTER 3.24 OF THE IMPERIAL BEACH MUNICIPAL CODE\nTO INCREASE THE CITY’S TRANSIENT OCCUPANCY TAX FROM 10% TO\n14% OF THE RENTS CHARGED TO LODGING AND HOTEL GUESTS\nEFFECTIVE JANUARY 1, 2023."\n\nMotion by Councilmember Aguirre\nSeconded by Councilmember Leyba-Gonzalez\n\nTo conduct the second reading/adoption of Ordinance No. 2022-1216 pursuant\nto the City Council's previous action to approve a resolution which certified and\ndeclared the results of the voters of Imperial Beach at the November 8, 2022\nelection. |\n\nAYES (4): Mayor Pro Tem Fisher, Councilmember Leyba-Gonzalez,\nCouncilmember Aguirre, and Councilmember Spriggs\n\nABSENT (1): Mayor Dedina\nMotion Carried (4 to 0)

15.c OATHS OF OFFICE. (0430-65)\nCity Manager Hail introduced Carol Seabury.\n\nThe Ceremonial Oath of Office for Carol Seabury - District 1 was administered by\nPrior Councilmember Hazel Bailey and she was pinned by Duane Snider.\n\nCity Clerk Kelly presented Councilmember Seabury with her Certificate of\nElection.\n\nCouncilmember Seabury expressed her thanks and appreciation to her\nsupporters.\n\nCity Manager Hall introduced Mitch McKay\n\nThe Oath of Office for Mitch McKay - District 3 was administered by City Clerk\nKelly and he was pinned by his wife, Suzanne Parish-McKay.\n\nCity Clerk Kelly presented Councilmember McKay with his Certificate of Election.\nCouncilmember McKay thanked everyone for their attendance.\nCity Manager Hall introduced Paloma Aguirre.\n\nThe Ceremonial Oath of Office for Paloma Aguirre was administered by Nora\nVargas, Vice Chair of the San Diego County Board of Supervisors, and she was\npinned by her husband, Delio Baclaski.\n\nCity Clerk Kelly presented Mayor Aguirre with her Certificate of Election.\n\nMayor Aguirre thanked Vice Chair Vargas and said it was an honor to be sworn\nin by the first Latina District 1 Supervisor and future Chair of the County Board of\nSupervisor. She acknowledged her family who were not able to attend but were\nwatching online. She thanked City staff for putting the event together, the\nSheriff's deputies for keeping the community safe, and Novo Brazil for opening\ntheir doors for the event. She also thanked and recognized all the candidates for\nrunning for office. She congratulated her new Council colleagues and looks\nforward to working with them on improving the quality of life for all Imperial Beach\nresidents. She also recognized her husband, Delio, for his unconditional support,\nand thanked all her supporters who assisted her during her successful campaign.\nShe thanked the community for entrusting her with the great honor and\nresponsibility as Mayor.\n\nThe new members were seated at the dais.

8.c RESOLUTION NO. 2022-111 APPROVING AND ADOPTING’ THE\nSIDELETTER OF AGREEMENT TO THE MEMORANDUM OF\nUNDERSTANDING BETWEEN THE CITY AND SERVICE EMPLOYEES’\nINTERNATIONAL UNION, LOCAL 221, AND THE IMPERIAL BEACH\nFIREFIGHTERS’ ASSOCIATION, LOCAL 4692. (0540-50)\n\nCity Council adopted Resolution No. 2022-111 increasing the employee health\nallotment from $1,900 to $1,966.15 per month.
