10. AUTHORIZE EXECUTION OF DEED RESTRICTION DOWNLOAD AND RECEIVE AND FILE LONG-TERM MANAGEMENT AND MAINTENANCE PLAN FOR LAGUNA CANYON CREEK EROSION PROTECTION PROJECT Recommendations:\n1. Authorize the City Manager to execute and record the attached Deed Restriction and Agreement Regarding\nthe Use of Property for on-site and off-site mitigation areas associated with the Laguna Canyon Creek Protection Project near the Animal Shelter;\n2. Receive and file the attached Long-Term Management\nand Maintenance Plan for long-term stewardship of the\nmitigation areas and direct staff to complete permit closeout activities; and\n3. Determine that no additional environmental review is\nrequired for the recommended action based on a prior adopted Final Mitigated Negative Declaration for the project that contemplated these implemented actions.

11. AUTHORIZATION TO PURCHASE DISPATCH DOWNLOAD CONSOLE AND RADIO ANTENNA SYSTEM FOR EMERGENCY OPERATIONS CENTER REDUNDANCY AT THE LAGUNA BEACH COMMUNITY & RECREATION CENTER Recommendations:\n1. Approve and authorize the City Manager to execute the Cooperative Agreement with Motorola Solutions, Inc.\nfor the purchase of communications equipment and\nservices in an amount not to exceed $125,022.11\n(inclusive of estimated taxes), pursuant to Los Angeles County Contract No. MA-IS-2240228-2;\n2. Authorize the City Manager to approve an agreement with the Orange County Sheriff’s Department Communications Division for antenna system procurement and installation at the Laguna Beach\nCommunity & Recreation Center Emergency\nOperations Center in an amount not to exceed $7,401.61;\n3. Authorize total project expenditures not to exceed $132,423.72, funded from the Wildfire Mitigation / Fire Safety Police Support Services account (Account No. 1412101-12071-S2604); and\n4. Find this action is not a “project” subject to the California Environmental Quality Act pursuant to Section 15378 of the CEQA Guidelines.\nAUTHORIZATION TO ASSUME MAINTENANCE 12.\nDOWNLOAD RESPONSIBILITY FOR FUEL MODIFICATION ZONE 25 (IRVINE COVE) Recommendations:\n1. Authorize the Fire Department to proceed with\nestablishing a contract for the ongoing maintenance of\nFuel Modification Zone 25 (Irvine Cove), with the City assuming responsibility for maintenance costs previously funded by the Irvine Cove Community Association HOA; and\n2. Find that this action is exempt from the California Environmental Quality Act (“CEQA”) pursuant to\nCEQA Guidelines § 15301 and § 15304, and is further\nstatutorily exempt as an action necessary to prevent or mitigate an emergency pursuant to Public Resources\nCode § 21080(b)(4) and CEQA Guidelines § 15269(c).\n13. AWARD OF CONTRACT TO GENASYS INC. FOR THE DOWNLOAD INSTALLATION, SETUP, AND INSPECTION OF PUBLIC SAFETY EQUIPMENT AND THE COMMISSIONING AND MAINTENANCE OF PUBLIC SAFETY SOFTWARE Recommendations:\n1. Award and authorize the City Manager to execute a\ncontract with Genasys Inc. in the amount of $354,026.49 for the installation, setup, and inspection\nof public safety equipment and the commissioning and maintenance of public safety software; and\n2. Determine the number of members to be appointed to the Hospital Task Force; and\n3. Find that the recommended action is not subject to the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15378 because the action involves organizational and administrative\nactivities that will not result in a direct or indirect physical change in the environment.\nE. PUBLIC HEARINGS - NON APPEALS. This section is for matters (other than\nappeals) that are structured as Public Hearings.  Public hearings are different from\nregular business items in that there is a specific time period where a formal hearing is\nopened by the presiding officer, public comment is accepted from any member of the\npublic, and the hearing is closed by the presiding officer.   Generally each public\nspeaker has one opportunity to speak.  The City Council conducts all Public Hearings\nin accordance with the provisions of applicable Laguna Beach procedure and State\nlaw. The presiding officer shall have discretion to establish the time allocated for public comment.\nTENTATIVE PARCEL MAP 2026-0793 AND COASTAL 17.\nDOWNLOAD DEVELOPMENT PERMIT 2026-0802 AT 2500 GLENNEYRE STREET, 2500 PALA WAY, AND 2500 QUEDA WAY Recommendations:\n1. Conduct a Public Hearing, including receiving a staff\nreport and taking public testimony and evidence related\nto the consideration of Tentative Parcel Map 20260793, Coastal Development Permit 2026-0802, and CEQA exemption under State CEQA Guidelines Section 15303; and\n2. Adopt the Resolution titled, “A RESOLUTION OF\nTHE CITY COUNCIL OF THE CITY OF LAGUNA BEACH, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP 2026-0793 AND COASTAL DEVELOPMENT PERMIT 2026-0802 MERGING THREE LOTS AT 2500 GLENNEYRE STREET (APN: 626-126-09), 2500 PALA WAY (APN: 626-14601), AND 2500 QUEDA WAY (APN: 626-146-02)\nINTO A SINGLE LOT IN THE R-1 (RESIDENTIAL LOW-DENSITY) ZONE; AND FINDING THE ACTION EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT PURSUANT TO STATE CEQA GUIDELINES SECTION 15303”.\n18. Continue to conduct the Public Hearing that was\nopened at the May 12, 2026, City Council meeting,\ntake public testimony, and continue the public hearing\nto the June 23, 2026, City Council meeting; and\n2. Find that the action to continue the public hearing is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Section 15061 (b)(3) (Common Sense Exemption).\nF. PUBLIC HEARINGS FOR APPEALS. This section is specifically for appeals of\ndeterminations of the Planning Commission, the Design Review Board, or other\nBoards or Commissions.  Public Hearings (Appeals) are different from other public\nhearings in two ways:  (1) In some cases, the City Council can only consider whether\na lower body abused its discretion in granting or denying a project application.  In\nother cases, the Council can conduct the hearing “ de novo ,” meaning that it can\nconsider old and new information and make a determination unbound by the lower\nbody’s decision.  The item’s staff report will clearly state which review standard\napplies to each appeal item; and (2) public comment generally occurs this way:  Staff\npresents a report about the appeal, Council members ask questions about the report.\nThen the presiding officer opens the public hearing, inviting the person who filed the\nappeal (the appellant) to speak first, followed by persons supporting the appellant’s\nposition.  Then the presiding officer invites persons disagreeing with appeal to speak.\nWhen all speakers have spoken, the presiding officer invites the appellant up a second\ntime to address any comment and to conclude their argument.  Following that, the\npresiding officer closes the public hearing, and the Council deliberates further and\nultimately votes on a motion.  The City Council conducts all Public Hearings in\naccordance with the provisions of applicable Laguna Beach procedure and State law.\nThe Mayor shall have discretion to establish the time allocated for persons who wish\nto speak, often allowing more time for the appellant and/or the applicant.\nA.\n31565 EAGLE ROCK WAY: PUBLIC HEARING FOR DOWNLOAD APPEAL OF DESIGN REVIEW BOARD APPROVAL OF DESIGN REVIEW 2025-0407 FOR A NEW SINGLEFAMILY DWELLING, ATTACHED TWO-CAR GARAGE, ELEVATED DECK, GRADING, POOL, SPA,\nLANDSCAPING, HARDSCAPE, NEW VEHICULAR ACCESS, PUBLIC STREET IMPROVEMENTS, AND DEMOLITION OF AN EXISTING STORAGE BUILDING, AND COASTAL DEVELOPMENT PERMIT 2025-0408 FOR A DETACHED ACCESSORY DWELLING UNIT IN THE VC, VILLAGE COMMUNITY ZONE, AND CATEGORICAL EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT GUIDELINES SECTION 15303 (CLASS 3) Recommendations:\n1. Award and authorize the City Manager to execute a\ncontract with Gentry General Engineering Inc., in the\namount of $587,330.00 for the Agate Storm Drain Improvements project;\n2. Award and authorize the City Manager to issue a task\norder to Onward Engineering, in the amount of $94,770 to provide construction inspection services;\n3. Authorize the City Manager to approve project-related expenses and construction change-orders for\nunforeseen circumstances in an amount not to exceed $60,000; and\n4. Award and authorize the City Manager to execute a\ncontract with Voltaire Engineering in the amount of\n$1,499,266, for the construction of the Fire Station 4 retaining wall at 31796 S Coast Highway;\n2. Authorize the City Manager to approve project-related expenses and contract change orders for unforeseen\ncircumstances in an amount not to exceed $150,000;\nand\n3. Find that the project was previously evaluated pursuant to the California Environmental Quality Act (CEQA) through adoption of an Initial Study/Mitigated Negative Declaration (State Clearinghouse No.\n2022090383), adopted by the City Council on November 15, 2022.
