WRITE OFF $460,795.92 in Reserve Fund loans and advances listed on Attachment 1 contained in the City Administrative Officer (CAO) report dated June 28, 2024, attached to Council file No. 13­ 1465­S1. 2. INSTRUCT City departments with outstanding loans to work with the special fund administrators and report to the CAO in 90 days on the status of loans listed on Attachment 1 contained in the CAO report dated June 28, 2024, attached to the Council file, as requiring further analysis. 3. INSTRUCT City departments to prioritize and expedite the submission of invoices to the appropriate City department(s) in order to recover Reserve Fund loans made for special fund expenditures. 4. Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: 1. FIND that the California Environmental Quality Act (CEQA) does not apply to the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment; State CEQA Guidelines Section 15378(b)(4). The draft Ordinance is, therefore, not subject to CEQA because it does "not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment." Any CEQA­defined projects constructed from the funds received from the enactment of this ordinance will be subject to a project­specific CEQA process before construction. 2. Fiscal Impact Statement: The City Administrative Officer reports that approval of the proposed Amendment to Permit No. 750 with SA Recycling will increase compensation from $3,969,079 by $2,434,923 to a new Minimum Annual Guarantee (MAG) of $6,404,002. The compensation structure will be changed such that land rent, wharfage, and dockage will be subject to an aggregate MAG of $6,404,002 in Year 1. Thereafter, MAG will increase by the greater of the annual change in the Consumer Price Index or two percent. Revenues are to be deposited in the Harbor Revenue Fund. The recommendations in the report and proposed actions comply with the Harbor Department’s Financial Policies. There is no impact on the City’s General Fund.
