WAIVE FURTHER READING AND ADOPT ORDINANCE FOR DEVELOPMENT\nAGREEMENT (DA-24-01) A DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY\nOF MONTEREY PARK AND ATLANTIC SQUARE, LLC (TRC) TO FACILITATE\nIMPROVEMENTS ON AND ADJACENT TO THE ATLANTIC SQUARE SHOPPING CENTER\nLOCATED AT 2100 SOUTH ATLANTIC BOULEVARD; TA ACTIVATE THE BUSINESS\nRECOVERY DEVELOPMENT AGREEMENT ZONE (“BRDZ”) IN MONTEREY PARK\nMUNICIPAL CODE CHAPTER 21.45; AND TO AMEND THE ZONE MAP (ZA-24-02)\nIt is recommended that the City Council consider:\n(1) Waiving the second reading and adopting the proposed ordinance DA-24-01 and\namending the zoning map (ZA-24-02); and\n(2) Taking such additional, related, action that may be desirable.

RECEIVE AND FILE THE MONTEREY PARK BUSINESS IMPROVEMENT DISTRICT NO. 1\n(BID) 2024 ANNUAL REPORT AND APPROVE THE PROPOSED BID ASSESSMENT AND\nBUDGET FOR THE 2025 PROGRAM YEAR\nIt is recommended that the City Council consider:\n(1) Receiving and filing the 2024 Annual Report with the City Clerk;\n(2) Approving the proposed BID assessment and budget for the 2025 program year; and\n(3) Taking such additional, related, action that may be desirable.

3-D. 2024 CURB RAMP IMPROVEMENTS – AWARD OF PUBLIC WORKS CONTRACT TO ONYX\nPAVING COMPANY, INC.\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a public works contract, in a form approved by\nthe City Attorney, with Onyx Paving Company, Inc. in the contract amount of $169,000 for\nthe 2024 Curb Ramp Improvements Project;\n(2) Authorizing the Director of Public Works to approve change orders not to exceed $17,000\nover the total contract amount; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the\nregulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). CEQA Guideline § 15301(c) (Existing Facilities) exempts the operation, repair,\nmaintenance, alteration of existing public or private structures which involve negligible or no\nexpansion of existing or former use. The proposed work will occur entirely within an existing\nstructure. Accordingly, no further environmental review is required.\n3 of 637

3-E. APPROVAL OF CHANGE ORDER NO. 19 TO J.R. FILANC AGREEMENT FOR EXTENDED\nOVERHEAD COSTS TO THE CENTRALIZED GROUNDWATER TREATMENT SYSTEM\nIt is recommended that the City Council consider:\n(1) Approving Change Order No. 19 to Agreement No. 1954-A with J.R. Filanc Construction\nCompany, Inc. for the extended overhead costs; and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the\nregulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). CEQA Guidelines §§ 15301 and 15302 exempt this matter from further\nenvironmental review as the proposed action would result in a minor alteration of an existing\npublic structures involving no expansion of use located on the same site with substantially the\nsame purpose and capacity. The proposed work will occur entirely within an existing structure.\nAccordingly, no further environmental review is required.

NOTICE OF COMPLETION – VARIOUS PROJECTS\nIt is recommended that the City Council consider:\n(1) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nAugust 28, 2024, accepting the CIPP Lining at Various Locations Project completed by\nSouthwest Pipeline and Trenchless Corp;\n(2) Receiving and filing the Notice of Completion recorded by the Public Works Director on\nOctober 2, 2024, accepting the 2024 Sewer Manhole Rehabilitation project completed by\nSancon Technologies, Inc.;\n(3) Taking such additional, related, action that may be desirable.

SPIRIT BUS PILOT PROGRAM\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute an agreement with Nomad Transit, LLC, a wholly\nowned subsidiary of Via Transportation, Inc., without the need for competitive bidding, in\na form approved by the City Attorney, for on-demand transit services for an amount not-\nto-exceed $573,689;\n(2) Authorizing the City Manager to execute an Amendment with First Transit, in a form\napproved by the City Attorney, for fixed-route transit services for an annual amount not-\nto-exceed $2,064,537 for services through December 31, 2025;\n(3) Approving an additional appropriation of $123,946 from Prop A funds to the FY 2024-25\nbudget for services through June 30, 2025; and\n(4) Taking such additional, related, action that may be desirable.\n4 of 637

CONSIDERATION AND POSSIBLE ACTION TO ADOPT REGULATIONS GOVERNING\nDATA CENTERS WITHIN SATURN PARK IN ACCORDANCE WITH SECTION 3(A) OF\nORDINANCE NO. 2198 (ADOPTED BY VOTERS AS MEASURE JJ ON NOVEMBER 3, 2020).\nIt is recommended that the City Council consider:\n(1) Opening the public hearing and taking testimonial and documentary evidence;\n(2) After closing the public hearing and considering the evidence submitted during that public\nhearing:\na. Adopting an Urgency Ordinance (Attachment 1) upon 4/5 vote pursuant to\nGovernment Code § 65858 amending Monterey Park Municipal Code\n(“MPMC”) Chapter 21.14 to add regulations governing data centers in\naccordance with Section 3(A) of Ordinance No. 2198 (adopted by voters as\nMeasure JJ on November 3, 2020);\nb. Introducing and waiving first reading of Ordinance No. _____ (ZCA-24-02)\n(Attachment 2) amending Monterey Park Municipal Code (“MPMC”)\nChapter 21.14 to add regulations governing data centers in accordance with\nSection 3(A) of Ordinance No. 2198 (adopted by voters as Measure JJ on\nNovember 3, 2020); and\nc. Adopting Resolution No. _____ (Attachment 3) adopting design guidelines\nfor data centers in accordance with MPMC Chapter 21.14; and\n(3) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nPursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq.;\n“CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq.;\nthe “CEQA Guidelines”), the City reviewed the environmental impacts of the proposed regulations\nand found and determined that this ordinance is not subject to further review under the California\nEnvironmental Quality Act (Public Resources Code §§ 21000, et seq.; “CEQA”) for the following\nreasons: (1) it will not result in a direct or reasonably foreseeable indirect physical change in the\nenvironment (14 Cal. Code Regs. § 15060(c)(2); (2) there is no possibility that the ordinance may\nhave a significant effect on the environment (14 Cal. Code Regs. § 15061(b)(3); and (3) the\nordinance, by itself, does not constitute a “project” as defined in the CEQA Guidelines (14 Cal.\nCode Regs. § 15378).

CONSIDERATION AND POSSIBLE ACTION TO INTRODUCE AND WAIVE FIRST\nREADING OF AN ORDINANCE SETTING SPEED LIMITS BASED UPON\nCERTIFICATION OF THE 2017 ENGINEERING AND TRAFFIC SURVEY FOR SPEED\nLIMITS EFFECTIVE THROUGH OCTOBER 2031 AND THE 2024 ENGINEERING\nAND TRAFFIC SURVEY OF 26 LOCATIONS FOR SPEED LIMITS THROUGH\nOCTOBER 2038\nIt is recommended that the City Council consider:\n(1) Introducing and waiving first reading for an Ordinance setting speed limits\nthroughout the City; and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThis Ordinance is exempt from review under the California Environmental Quality Act (California\nPublic Resources Code §§ 21000, et seq., “CEQA”) and the regulations promulgated thereunder\n(14 California Code of Regulations §§ 15000, et seq., the “CEQA Guidelines”) because it consists\nonly of minor revisions and clarifications to an existing code of speed control regulations\nestablished in accordance with California law and will not have the effect of deleting or\nsubstantially changing any regulatory standards or findings. This Ordinance, therefore, is an\naction being taken for enhanced protection of the environment and that does not have the\npotential to cause significant effects on the environment. Consequently, it is categorically exempt\nin accordance with CEQA Guidelines §§ 15301 as a minor alteration of existing public or private\nstructures involving no expansion of use; 15305 as a minor alteration in land use limitations which\ndo not result in any changes in land use or density; and 15308 as an action taken by a regulatory\nagency as authorized by California law to assure maintenance or protection of the environment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MONTEREY PARK,\nCALIFORNIA, DECLARING AND RECOGNIZING NOVEMBER 2024 AS NATIVE AMERICAN\nHERITAGE MONTH – REQUESTED BY COUNCIL MEMBER SANCHEZ\nIt is recommended that the City Council consider:\n(1) Adopting a Resolution declaring and recognizing November 2024 as Native American\nHeritage Month\n(2) Taking such additional, related, action that may be desirable.
