CONSIDERATION OF A RESOLUTION TO APPROVE AN IMPLEMENTATION\nAGREEMENT FOR THE TRANSFER AND EXCHANGE OF\nTRANSPORTATION CORRIDOR AGENCY PROPERTIES AND RELATED\nPROPERTY EXCHANGES, EASEMENTS, DEED RESTRICTIONS, AND\nCRISTIANITOS BASIN MAINTENANCE OBLIGATIONS, AUTHORIZE THE\nCITY MANAGER TO NEGOTIATE, FINALIZE AND EXECUTE ALL RELATED\nAGREEMENTS AND FIND THE ACTIONS EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nRecommended Action\nAdopt Resolution No. 26-35, which will:\n1. Find the actions categorically exempt from the California Environmental\nQuality Act (CEQA) pursuant to Sections 15325 (Class 25 - Transfers of\nOwnership of Interests in Land), 15317 (Class 17 - Open Space Contracts\nor Easements), 15307 (Class 7 - Actions by Regulatory Agencies for\nProtection of Natural Resources), and 15308 (Class 8 - Actions by\nRegulatory Agencies for Protection of the Environment) of the CEQA\nGuidelines (14 CCR §15000 et seq.).\n2. Approve the Implementation Agreement for the Transfer of Transportation\nCorridor Agency Property in San Clemente among the City of San\nClemente, Talega Associates, LLC, and Talega Maintenance Corporation,\nincluding all exhibits thereto.\n3. 11F. NOTICE OF COMPLETION - FY 2025 AS-NEEDED STREET IMPROVEMENT\nPROGRAM\nRecommended Action\nAdopt Resolution No. 26-38, which will:\n1. Accept the FY 2025 As-Needed Street Improvement Program, CIP Project\nNo. 15318, from the contractor, Hardy & Harper, Inc.\n2. Authorize the City Clerk to execute and record the Notice of Completion\nfor the FY 2025 As-Needed Street Improvement Program.\n3. Authorize the City Clerk to release the payment bond 35 days from the\nrecordation of the Notice of Completion upon verification with the\nEngineering Division that no liens have been levied against the contractor,\nHardy & Harper, Inc.\n4. Authorize the City Clerk to release the performance bond for this project\nupon receipt of a warranty bond in a form acceptable to the Public Works\nDirector/City Engineer in the amount of 25% of the total construction cost.

CONTRACT AWARD - FY 2026 STREET IMPROVEMENT PROGRAM\n(PAVEMENT REPAIRS), AND FINDING THE PROJECT CATEGORICALLY\nEXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nRecommended Action\nAdopt Resolution No. 26-39, which will:\n1. Find the FY 2026 Street Improvement Program (Pavement Repairs), CIP\nProject No. 16318, categorically exempt from the California Environmental\nQuality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section\n15301) of the State CEQA Guidelines.\n2. Award the FY 2026 Street Improvement Program (Pavement Repairs),\nCIP Project No. 16318, contract to TOWO Enterprise, Inc.\n3. Approve, and authorize the City Manager to execute, Contract No. C26-\n19, by and between the City of San Clemente and TOWO Enterprise, Inc,\nproviding for the FY 2026 Street Improvement Program (Pavement\nRepairs), in an amount not to exceed $500,000, in a form substantially\nsimilar to Contract No. 26-xx (Attachment 2).\n4. Authorize the City Manager to renew the contract for up to three additional\none-year terms, and award and execute similar future contracts, provided\nthat they are within the City Council-approved budget for pavement\nrepairs and City policy and ordinances and state law regarding the\nprocurement and public contracting is otherwise followed.

CONSIDERATION OF A RESOLUTION AWARDING A PURCHASE\nAGREEMENT TO ELECTRIC VEHICLE CHOICE UNDER THE COOPERATIVE\nSOURCEWELL CONTRACT FOR TWO ALTERNATIVE QUALIFYING\nELECTRIC VEHICLES USING GRANT FUNDS FROM THE CLEAN MOBILITY\nOPTIONS (CMO) GRANT VOUCHER PROGRAM, APPROVING AN\nEXEMPTION TO THE CITY’S PURCHASING POLICY TO USE A\nCOOPERATIVE PURCHASE AGREEMENT, APPROPRIATING THE $1.8\nMILLION IN GRANT REVENUES, AND FINDING THE PROJECT\nSTATUTORILY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL\nQUALITY ACT UNDER CALIFORNIA PUBLIC RESOURCES CODE §\n21080.25\nRecommended Action\nAdopt Resolution No. 26-40, which will:\n1. Find the Clean Mobility Options (CMO) Voucher Pilot Program, as\nmodified, statutorily exempt from the California Environmental Quality Act\npursuant to California Public Resources Code § 21080.25.\n2. Authorize an exemption to City Purchasing Policy 201-2-1 to allow for\nutilization of a cooperative purchasing agreement, specifically Sourcewell\nContract EV-032824,consistent with Purchasing Policy Section XI.A.1.4.\n3. Award a purchase agreement to Electric Vehicle Choice for two\nKarsan-Damera eJest Mini Buses in the amount of $725,184.\n4. Approve, and authorize the City Manager to negotiate and execute,\nContract No. C26-20, contract documents consistent with Sourcewell\nContract EV-032824, providing for the purchase of two Karsan-Damera\neJest Mini Buses from Electric Vehicle Choice, in the amount of $725,184,\nusing funds from the Clean Mobility Options Voucher Pilot Program Grant.\n5. Authorize and direct the City Manager to negotiate and execute an\namendment to the Clean Mobility Options grant budget and to the Mobility\nProject Voucher Agreement (Agreement Number MP23W2A-16G) to\nreflect the final cost of the purchased vehicles.\n6. Authorize related supplemental appropriations from the General Fund\nrevenue account 001-000-33490 and expense account 001-808-45600 to\nreceive all Voucher Pilot Program funds in the amount of $1.8 million, a\nportion of which will be used to fund the purchase of these two electric\nvehicles.

CONSIDERATION OF A RESOLUTION AWARDING A PROFESSIONAL\nCONSULTANT SERVICES AGREEMENT TO HOUT CONSTRUCTION\nSERVICES, INC., FOR CONSTRUCTION MANAGEMENT AND INSPECTION\nSERVICES FOR THE CALLE FRONTERA LIFT STATION SOIL\nSTABILIZATION, CIP PROJECT NO. 32201, AND AUTHORIZING THE CITY\nMANAGER TO EXECUTE THE AGREEMENT IN AN AMOUNT NOT TO\nEXCEED $109,200\nRecommended Action\nAfter consideration of available options, the City Council will need to\ndetermine if awarding a Professional Services Agreement to HCS is in the\nbest interest of the City and in particular, the wastewater (sewer) system. If the\nCity Council chooses to approve a Professional Services Agreement, adopt\nResolution No. 26-41, which will:\n1. Award a Professional Services Agreement to Hout Construction Services,\nInc., for construction management and inspection services for the Calle\nFrontera Lift Station, CIP Project No. 32201.\n2. Approve, and authorize the City Manager to execute, Contract No. C26-\n21, by and between the City of San Clemente and Hout Construction\nServices, Inc., providing for the Calle Frontera Lift Station, in an amount\nnot to exceed $109,200, in a form substantially similar to Contract No.\nC26-21 (Attachment 2).

Approve, and authorize the City Manager to execute, Contract C19-90, by\nand between the City of San Clemente and the County of Orange,\nproviding for the placement of ballot drop boxes at the Municipal Golf\nCourse parking lot, for a five-year period.\n2. Approve, and authorize the City Manager to execute, Contract C19-91, by\nand between the City of San Clemente and the County of Orange,\nproviding for the placement of ballot drop boxes at the Jim Johnson\nMemorial Sports Park, for a five-year period.\n3. Approve, and authorize the City Manager to execute, Contract C19-92, by\nand between the City of San Clemente and the County of Orange,\nproviding for the placement of ballot drop boxes at the City Hall, for a\nfive-year period.\n4. Authorize the City Manager, in his discretion, to enter into similar license\nagreements for ballot drop boxes with the County of Orange in the future.

8A. PUBLIC HEARING: CONSIDERATION TO INTRODUCE, AND CONDUCT A\nFIRST READING OF AN ORDINANCE TO AMEND VARIOUS PORTIONS OF\nSAN CLEMENTE MUNICIPAL CODE TITLE 12, TITLE 16, AND TITLE 17,\nFOR STREAMLINING AND CLEANUP PURPOSES\nPublic hearing to consider amendments to the City of San Clemente\nMunicipal Code Title 2, Title 12, and Title 17, to streamline review\nprocesses for various types of projects, and be consistent with State Law,\nand clarify code sections. This includes a reworked Zoning Administrator\nreview process that allows the City Planner to make decisions if a notice\nof future decision is sent to property owners within 300 feet of a site and\nthere is not a request a hearing.\nThe City Council will also consider whether the zoning amendments are\nnot a “project” as defined by the State CEQA Guidelines Sections\n15378(b)(2) and 15378(b)(5), because the revisions relate to the ongoing\nadministrative or discretionary activities and organizational or\nadministrative activities of governments that will not result in direct or\nindirect physical changes in the environment, and therefore do not\nconstitute a “project” as defined by the State CEQA Guidelines (Cal.\nCode Regs., title 14, § 15000 et seq.).\nRecommended Action\nContinue the public hearing to the Regular City Council meeting of March 17,\n2026.
