a. PUBLIC WORKS CONTRACT WITH HARDY & HARPER, INC. (H&H) FOR\nTHE PALM DRIVE PAVEMENT REHABILITATION PROJECT FROM OBISPO\nAVE. TO E. WILLOW ST. (PROJECT NO. 90.24003)\nSummary:\nThe City Council will consider entering into a Public Works Contract with Hardy\n& Harper, Incorporated (H&H) for construction of the Palm Drive Pavement\nRehabilitation Project from Obispo Avenue to East Willow Street (Project No.\n90.24003). The Project includes the following elements:\n· Approximately 49,700 square feet of asphalt pavement repair employing\na combination of reconstruction and grind/overlay;\n· Removal and replacement of approximately 600 square feet of damaged\nsidewalk and driveways;\n· Removal and replacement of approximately 450 linear feet of curb and\ngutter;\n· Restoration of traffic striping and markings; and\n· Upgrade of three curb ramps to comply with the American Disabilities Act.\nFunds are available as designated in the FY 2023-24 Capital Improvement\nProgram (CIP) Budget for Pavement Management, utilizing funding from\nMeasure R (County), Measure M, Proposition C, and Road Maintenance and\nRehabilitation Act (RMRA). Expenditures for this Project will be allocated initially\ntowards Measure R, Measure M, and Proposition C to prioritize funds consistent\nwith expenditure deadlines.\nSubject to City Council approval of the contract award, staff would issue a\nNotice to Proceed and begin coordinating with the contractor. Staff anticipates\nthe project would begin construction in August 2023 and anticipates project\ncompletion in November 2023.\nRecommendations:\n1. Authorize the City Manager to enter into a Public Works Contract with H&H\nfor construction of the Palm Drive Pavement Rehabilitation Project from\nObispo Avenue to East Willow Street (Project No. 90.24003), for a term of 50\nworking days and a not-to-exceed contract amount of $774,000 in a form\napproved by the City Attorney.\n2. Authorize the Public Works Director to utilize a contingency of up to 10%\n($77,400) to accommodate additional scope of work in the event of changed\nor unforeseen conditions, for a total construction budget of $851,400.

b. POLICY DIRECTION REGARDING PROPOSED AMENDMENTS TO THE\nSIGNAL HILL MUNICIPAL CODE (SHMC)\nSummary:\nCity staff and the City Attorney’s office have been working to identify portions of\nthe Signal Hill Municipal Code (SHMC) that could be updated to conform with\nState law and best practices. While this review has focused on provisions\nrelated to code enforcement, additional areas of the SHMC have also been\nidentified for improvement, including housing and building ordinances, use of\npublic facilities, and the City’s sign ordinance. Staff is requesting City Council\npolicy direction regarding areas in which staff should focus its efforts and bring\nback as code amendments for potential adoption at a future meeting.\nRecommendation:\nStaff recommends the City Council consider changes to the SHMC in the areas\ndiscussed below and provide direction regarding next steps. If the City Council\nwishes to proceed with changes to the SHMC in any of the areas discussed\nbelow, City staff will come back with an ordinance or further staff report, as\napplicable, for City Council consideration.

THIRD AMENDMENT TO AGREEMENT FOR CONTRACT SERVICES\nBETWEEN THE CITY OF SIGNAL HILL AND SHUSTER ADVISORY GROUP,\nLLC\nSummary:\nAt its meeting of December 12, 2017, the City Council entered into a Contract\nServices Agreement with Shuster Advisory Group, LLC (formerly SFG\nRetirement Plan Consulting, LLC) for investment advisor and fiduciary services\nfor the City’s 457(b) Deferred Compensation Plan and 401(a) Defined\nContribution Plan. Since June 11, 2019, Shuster Advisory Group has been\nserving as the sole fiduciary for the City’s 457(B) and 401(A) plans. Shuster\nAdvisory Group, LLC (Shuster) is requesting a not to exceed 3% cost of living\nadjustment to its annual compensation, starting on August 1, 2023. City Council\napproval of the proposed Third Amendment to the agreement is required for the\ncompensation structure to be modified.\nRecommendation:\nAuthorize the City Manager to execute Amendment No. 3 to the Contract\nServices Agreement between the City of Signal Hill and Shuster for a cost of\nliving adjustment to its annual compensation, limited to a not-to-exceed\nadjustment of 3%, in a form approved by the City Attorney.

RESOLUTION APPROVING THE 2022 MILITARY EQUIPMENT ANNUAL\nREPORT AND RENEWING ORDINANCE NO 2022-06-1535\nSummary:\nOn September 30, 2021, Governor Newsom signed into law Assembly Bill (AB)\n481, which went into effect on January 1, 2022, and added California\nGovernment Code Sections 7070 through 7075 relating to the funding,\nacquisition, and status and inventory of military equipment by local law\nenforcement agencies. The bill required law enforcement agencies seeking to\nfund or acquire new military equipment or continue use of any military equipment\nacquired prior to January 1, 2022, to draft a military equipment use policy and\nobtain approval from its governing body via adoption of an ordinance. AB 481\nalso requires law enforcement agencies to present an annual report to their\ngoverning body on the status and inventory of the equipment. The City Council\nwill consider approving the 2022 Military Equipment Annual Report and a\nresolution, renewing Ordinance No. 2022-06-1535 in accordance with Assembly\nBill 481.\nRecommendation:\nAdopt a resolution, entitled:\nA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL,\nCALIFORNIA, APPROVING THE 2022 MILITARY EQUIPMENT ANNUAL\nREPORT AND RENEWING ORDINANCE NO. 2022-06-1535, IN\nACCORDANCE WITH ASSEMBLY BILL 481

CONTRACT AMENDMENT REGISTER DATED JULY 11, 2023\nSummary:\nThe Contract Amendment Register is a listing of proposed contract amendments\nand project change orders eligible for streamlined processing based upon the\nfollowing criteria as documented in the City’s Purchasing policy:\n· Funds have been authorized as part of the adopted fiscal year Operating\nBudget;\n· Staff are satisfied with the goods/services received to date; and\n· City Manager has reviewed and approved each amendment for\nstreamlined processing.\nTwo contract amendments are being presented for City Council consideration:\n1) Michael Baker International, Inc. provides on-call water engineering\nconsulting services. The amendment increases the compensation of the\non-call agreement by $9,592 to make revisions to project plans and\nprovide additional bidding support services for the 33rd Street Water Main\nReplacement Project.\n2) DISC Solutions, Inc. provides professional consulting services to support\nthe City’s Diversity Coalition Committee.
