7.e. CONSIDERATION AND APPROVAL OF RESOLUTION NO. 23-102,\nAWARDING A PROFESSIONAL SERVICES AGREEMENT (PSA) TO\nWEST COAST ARBORISTS, INC. FOR TREE MAINTENANCE\nSERVICES\nOn September 12, 2023, the City Council approved the solicitation of\nwritten proposals for Citywide Tree Maintenance Services for the City of\nSouth El Monte. Three (3) proposals were received and evaluated by staff\nusing the criteria listed on the Request for Proposal.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Find that the proposed action is not a project subject to the California\nEnvironmental Quality Act (CEQA) pursuant to Section 20165 of\nCEQA and Sections 15060(c)(2), 15060(c)(3), and 15378 of the State\nCEQA Guidelines and, as such, no environmental document pursuant\nto CEQA is required;\n2. Adopt Resolution No. 23-102, awarding a Professional Services\nAgreement to West Coast Arborists, Inc. for Tree Maintenance\nServices in the amount of $900,000; and\n3. Authorize the City Manager or designee to negotiate and execute the\nagreement.\nENVIRONMENTAL ANALYSIS: The action proposed herein is not a\nproject subject to the California Environmental Quality Act (CEQA) in\naccordance with Section 21065 of CEQA and State CEQA Guidelines\nSections 15060(c)(2), 15060(c)(3), and 15378. Entering into an agreement\nfor tree maintenance services is an administrative action that would not\ncause either a direct physical change in the environment or a reasonably\nforeseeable indirect physical change in the environment. Therefore, the\nproposed action is not a “project” subject to CEQA, as defined in Section\n21065 of CEQA and Section 15378 of the State CEQA Guidelines. Since\nthe action is not a project subject to CEQA, no environmental document is\nrequired.\n7.4. CONSIDERATION AND APPROVAL TO REJECT ALL BIDS AND READVERTISE REQUEST FOR PROPOSALS _— (RFP) FOR\nARCHITECTURAL DESIGN SERVICES FOR SOUTH EL MONTE CITY\nHALL RESTROOMS REHABILITATION\nThe City received only one proposal for Architectural Design Services for\nthe South El Monte City Hall Restrooms Rehabilitation. Staff recommends\nthat the City re-advertise the RFP to ensure a minimum of two (2)\nproposals for service and to incorporate language required to utilize\nCommunity Development Block Grant funds.\nRECOMMENDED ACTION: Staff recommends City Council reject the one\nproposal received and authorize re-advertising the RFP for Architectural\nDesign Services for the South El Monte City Hall Restrooms Rehabilitation\nand authorize staff to solicit proposals.\n7.1. CONSIDERATION FOR AUTHORIZATION TO SOLICIT REQUEST FOR\nPROPOSALS (RFP) FOR JANITORIAL MAINTENANCE SERVICE\nStaff seeks City Council approval to publish a Request for Proposals\n(RFP) for Janitorial Maintenance Services for the City of South El Monte.\nRECOMMENDED ACTION: Staff recommends City Council approve the\nRFP to solicit proposals from qualified consultants to provide Janitorial\nMaintenance Services.\nCONSENT CALENDAR (CONTINUED)\n7.3. CITY COUNCIL APPEAL OF PLANNING COMMISSION'S ACTION\nADOPTING PC RESOLUTION NO. 23-04 APPROVING CONDITIONAL\nUSE PERMIT NO. 23-03 FOR A SPECIAL EVENT FACILITY (RUSTIC &\nCHIC) LOCATED AT 1703 FLORADALE AVENUE\nCouncilmember's appeal to the Planning Commission decision to adopt\nResolution No. 23-04, which approved Conditional Use Permit No. 23-03\nfor a special event facility (Rustic & Chic) located at 1703 Floradale\nAvenue in the Manufacturing (M) zone.\nRECOMMENDED ACTION: Staff recommends the City Council:\n1. Conduct a public hearing for the appeal;\n2. Take public testimony; and\n3. Discuss the matter after receiving public testimony and decide whether\nor not to agree with or overturn the decision by the Planning\nCommission to grant the CUP. Options available to the City Council\nunder municipal code section 17.74.070 include to affirm, reverse or\nmodify the Planning Commission’s decision; remand the matter to the\ncommission; or continue the matter.

CONSIDERATION AND APPROVAL OF THE CITY'S 2024 SPECIAL\nEVENTS CALENDAR\nThe City's 2024 Special Events Calendar includes recommended dates,\ntimes, and locations for the City-sponsored events held by the Community\nServices Department. All scheduled events are subject to modifications,\ndate changes, and/or cancellations.\nRECOMMENDED ACTION: Staff recommends City Council consider and\napprove the City's 2024 Special Events Calendar.\nGENERAL BUSINESS (CONTINUED)

9.b. COUNCIL TO REVIEW AND SELECT AN OPTION FOR THE ENERGY\nEFFICIENCY AND MECHANICAL ENERGY EFFICIENCY PROJECT\nFOR CITY FACILITIES\nThe City received Department of Energy (DOE) grants funds for lighting energy\nefficiency and mechanical energy efficiency upgrades. These upgrades were\ninitially scheduled for the City's Community Center, Mini Center and Senior\nCenter; however, a phased approach may now be required to complete the\nprojects.\nRECOMMENDED ACTION: Staff recommends City Council to consider\nand select from the following two options:\n1. Proceeding with the original scope of work, previously approved on July\n25, 2023, which covers all designated centers; or\n2. Adopt a two-phase approach as outlined, beginning with the Senior\nCenter and Community Center in Phase 1, and subsequently\naddressing the Mini Center in Phase 2.

CONSIDERATION AND APPROVAL OF ORDINANCE NO. 1270 OF\nTHE SOUTH EL MONTE CITY COUNCIL AMENDING CHAPTER 5.09\nOF TITLE 5 OF THE SOUTH EL MONTE MUNICIPAL CODE THEREBY\nAMENDING THE CITY’S SIDEWALK VENDING REGULATIONS IN\nRELATION TO REQUIREMENTS WHEN VENDING, INCLUDING\nREQUIRED DISTANCE BETWEEN VENDORS, KEEPING SIDEWALKS\nCLEAR OF OBSTRUCTIONS AND COOKING WASTE, RESTRICTIONS\nON COOKING WITHOUT REQUIRED LA COUNTY HEALTH PERMIT,\nAND DOCUMENTS REQUIRED WHILE VENDING\nPer the City Council's direction given at the October 24, 2023 City Council\nMeeting, the City Attorney's Office and City staff are presenting a\nproposed ordinance amending the South El Monte's Municipal Code\nChapter 5.09 "Sidewalk Vending" in relation to requirements for vending.\nRECOMMENDED ACTION: That the City Council:\n1. Find that the amended ordinance is not subject to the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Regulation\n15061(b)(3) and based on the analysis provided in the attached\nordinance; waive first reading and introduce Ordinance No. 1270; and\n2. Set said ordinance for adoption at the next regular city council meeting.
