RENEWAL OF AUTHORIZATION FOR VIRTUAL PUBLIC MEETINGS PURSUANT\nTO AB 361\nConsideration of the circumstances of the state of emergency related to the COVID-19\npandemic to determine whether remote teleconference meetings of the City Council,\nCommittees, and Commissions can continue to be held under the provisions of AB 361.\nRECOMMENDED ACTION:\n1. City Council declare that this item is not subject to the California Environmental\nQuality Act (“CEQA”) pursuant to Sections 15060(c)(2) and 15060(c)(3); and\n2. Reconsider the circumstances of the state of emergency; and\n3. Find that state or local officials have continued to impose or recommend measures\nto promote social distancing; and\n4. Direct staff, no later than 30 days after the City Council approves the recommended\naction, to report back on the state-proclaimed state of emergency so that City\nCouncil may reconsider the circumstances of the emergency, and, if appropriate,\nmake findings to continue to hold virtual meetings of City legislative bodies pursuant\nto AB 361.\nJanuary 24, 2023

RESOLUTION INITIATING PROCEEDINGS AND ORDERING THE ENGINEER TO\nPREPARE AND TO FILE A REPORT FOR THE STANTON LIGHTING AND\nLANDSCAPING DISTRICT NO. 1\nAs part of the annual update to the Lighting and Landscaping District No. 1, certain\nprocedural resolutions must be adopted by the City Council. The proposed resolution\norders the Engineer’s report for the Fiscal Year 2023/24 update.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Section 15378(b)(5) (Organizational or administrative activities\nof governments that will not result in direct or indirect physical changes in the\nenvironment); and\n2. Adopt Resolution No. 2023-02 initiating proceedings and ordering the Engineer’s\nreport for the Fiscal Year 2023/24 update, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, INITIATING PROCEEDINGS FOR THE ANNUAL\nASSESSMENTS FOR THE STANTON LIGHTING AND LANDSCAPING\nDISTRICT NO. 1 FOR THE FISCAL YEAR BEGINNING JULY 1, 2023,\nAND ENDING JUNE 30, 2024; AND ORDERING THE ENGINEER TO\nPREPARE AND FILE A REPORT IN ACCORDANCE THEREWITH”.

6F. LANDSCAPE MAINTENANCE AGREEMENT WITH CALIFORNIA DEPARTMENT OF\nTRANSPORTATION\nThe California Department of Transportation (Caltrans) owns the right-of-way along\nBeach Boulevard (SR-39). When development projects propose to install landscaping\nimprovements on Beach Boulevard, Caltrans requires that the City enter into an\nagreement to maintain the landscaping. The City then transfers the maintenance\nresponsibilities to the fronting property owner/developer through a separate agreement.\nTo reduce administrative overhead and increase operational efficiencies, staff worked\nwith Caltrans to develop a Landscape Maintenance Agreement for Beach Boulevard to\nallow the process of transferring maintenance responsibilities of any future development\nprojects to be accomplished through an amendment to the Landscape Maintenance\nAgreement.\nRECOMMENDED ACTION:\n1. City Council declare this action to be categorically exempt under the California\nEnvironmental Quality Act, Class 1, Section 15301(h) as maintenance of existing\nlandscaping; and\nJanuary 24, 2023\n2. Approve the Caltrans Landscape Maintenance Agreement; and\n3. Authorize the Mayor and City Manager to execute said agreement; and\n4. Approve the use of the amendment(s) with Caltrans to process the transfer of\nlandscape maintenance responsibilities from Caltrans to the City and authorize the\nCity Manager to execute said amendment(s).\nEND OF CONSENT CALENDAR

7A. CONSIDERATION OF AN ORDINANCE TO ADOPT THE 2022 CALIFORNIA\nBUILDING AND RELATED MODEL CONSTRUCTION CODES\nThe State’s Health and Safety Code requires local governments to adopt the most\nrecent editions of the model codes related to construction. The construction codes\ninclude: the California Building, Residential, Energy, Green Building Standards,\nPlumbing, Mechanical, Electrical, Fire, Existing Building, Historical, Administrative,\nReferenced Standards Codes, the International Property Maintenance Code, and the\nInternational Swimming Pool and Spa Code. If City Council approves the attached\nordinance, the most recent editions of the California construction codes with the\napplicable amendments will become effective March 17, 2023 as required by State law.\nRECOMMENDED ACTION:\n1. City Council conduct a public hearing; and\n2. Declare that the project is not subject to CEQA in accordance with Sections 15378\nand 15061(b)(3) as the activity is covered by the general rule that CEQA applies\nonly to projects which have the potential for causing significant effect on the\nenvironment. Where is can be seen with certainty that there is no possibility that the\nactivity in question may have a significant effect on the environment, the activity is\nnot subject to CEQA; and\n3. Introduce for first reading Ordinance No. 1128, in accordance with California\nGovernment Code Title 5, Division 1, Part 1, as published by the Building Standards\nBulletin 22-02, entitled:\n“AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA AMENDING DIVISION I OF TITLE 16 AND CHAPTER 17.08 OF\nTITLE 17 OF THE STANTON MUNICIPAL CODE PERTAINING TO THE\nADOPTION OF THE 2022 EDITION OF THE CALIFORNIA BUILDING\nSTANDARDS CODE, CONSISTING OF THE CALIFORNIA BUILDING CODE,\nTHE CALIFORNIA RESIDENTIAL CODE, THE CALIFORNIA PLUMBING\nCODE, THE CALIFORNIA MECHANICAL CODE, THE CALIFORNIA\nELECTRICAL CODE, THE CALIFORNIA FIRE CODE, THE CALIFORNIA\nJanuary 24, 2023\nADMINISTRATIVE CODE, THE CALIFORNIA GREEN BUILDING\nSTANDARDS CODE, THE CALIFORNIA EXISTING BUILDING CODE, THE\nCALIFORNIA ENERGY CODE, THE CALIFORNIA HISTORICAL BUILDING\nCODE, AND THE CALIFORNIA REFERENCED STANDARDS CODE; THE\nINTERNATIONAL SWIMMING POOL AND SPA CODE; AND THE\nINTERNATIONAL PROPERTY MAINTENANCE CODE, WITH AMENDMENTS\nTHERETO, AND MAKING FINDINGS IN SUPPORT THEREOF”; and\n4. 8A. APPROVAL OF ORDINANCE NO. 1126\nThis Ordinance was introduced at the regular City Council meeting of January 10, 2023.\nRECOMMENDED ACTION:\n1. City Clerk read the title of Ordinance No. 1126, entitled:\n“AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, AMENDING THE CITY’S PURCHASING ORDINANCE AS\nSET FORTH IN TITLE 2 OF THE STANTON MUNICIPAL CODE”; and\n2. City Council adopt Ordinance No. 1126.

CONSIDERATION OF EXTENSION OF THE EXCLUSIVE NEGOTIATION\nAGREEMENT WITH BRANDYWINE ACQUISITIONS GROUP, C&C DEVELOPMENT\nCOMPANY, AND NATIONAL COMMUNITY RENAISSANCE OF CALIFORNIA\nREGARDING THE TINA-PACIFIC DEVELOPMENT PROJECT\nThe City Council and Housing Authority will consider extending the Exclusive\nNegotiation Agreement (ENA) with Brandywine Acquisitions Group, C&C Development\nCompany, and National Community Renaissance of California for the Tina Pacific\nProject for an additional 180 days to allow for additional time to negotiate a disposition\nand development agreement and any other necessary agreements.\nRECOMMENDED ACTION:\n1. City Council and Housing Authority find that this item is not subject to California\nEnvironmental Quality Act (“CEQA”) pursuant to Sections\n15378(b)(5)(Organizational or administrative activities of governments that will not\nresult in direct or indirect physical changes in the environment); and\n2. Approve extension of the ENA and authorize the City Manager/Executive Director to\nexecute the First Amendment to the ENA.\nJanuary 24, 2023

ADOPTION OF STANTON LOCAL HAZARD MITIGATION PLAN\nAtlas Planning Solutions, the City’s consultant for the Local Hazard Mitigation Plan\n(LHMP), will provide a review of the final LHMP, which has been reviewed and\napproved by the California Governor’s Office of Emergency Services (Cal OES) and the\nFederal Emergency Management Agency (FEMA).\nRECOMMENDED ACTION:\n1. City Council declare that this item is not subject to the California Environmental\nQuality Act (“CEQA”) pursuant to Sections 15060(c)(2) and 15060(c)(3); and\n2. Receive and file the presentation; and\n3. Approve Resolution No. 2023-03, entitled:\n“A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF STANTON,\nCALIFORNIA, APPROVING AND ADOPTING THE CITY’S LOCAL\nHAZARD MITIGATION PLAN”.

SCHEDULE FOR APPOINTMENTS TO THE PLANNING COMMISSION, PARKS,\nRECREATION AND COMMUNITY SERVICES COMMISSION, AND PUBLIC SAFETY\nCOMMITTEE\nThe City is currently seeking residents who are interested in serving on the Planning\nCommission, Parks, Recreation and Community Services Commission, and Public\nSafety Committee. The City Council will consider dates to conduct commissioner and\ncommittee member candidate interviews and appointments.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment); and\n2. Approve the proposed recruitment schedule and select a date to conduct\ncommissioner and committee member candidate interviews and appointments. The\nsuggested date is the regular City Council Meeting of February 28, 2023. If the\nnumber of commission applicants is greater than ten (10), Council may wish to call a\nspecial meeting for Thursday, March 2, Tuesday, March 7, or Thursday, March 9,\n2023; or propose an alternative date to conduct interviews and appointments.\nJanuary 24, 2023

CYPRESS COLLEGE FOUNDATION ANNUAL AMERICANA AWARDS\nCity Council consider participation through a sponsorship contribution for the 48th\nAnnual Cypress College Foundation Americana Awards scheduled for Saturday, March\n11, 2023. This awards ceremony is used as a fundraiser for the Cypress College\nFoundation with all proceeds benefiting Cypress College students and programs and\nhonors the Citizen of the Year from surrounding communities. This year Mr. Brian\nDonahue has been selected and will be honored as the City of Stanton’s Citizen of the\nYear.\nRECOMMENDED ACTION:\n1. City Council find that this item is not subject to California Environmental Quality Act\n(“CEQA”) pursuant to Sections 15378(b)(5)(Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment);\n2. Approve the City’s participation through a sponsorship contribution for the 48th\nAnnual Cypress College Foundation Americana Awards; and\n3. Discuss and direct staff to proceed with the selection and purchase of either Option\n1: the Benefactor Sponsorship at a cost of $3,500 which includes registration for ten\n(10) and a half-page color donor acknowledgement in the Americana Program or\nOption 2: the purchase of ten (10) individual registrations at a cost of $300 per\nregistration for a total cost of $3,000.
