3.\nRATIFICATION OF PAYROLL AND DEMANDS The City Council has\napproved the use of Government Code Section 37208 to expedite the\npayment of City of Tustin obligations that are in accordance with the\napproved budget or continued operations authorizations.\nRecommendation: It is recommended that the City Council approve\nPayroll in the amount of $1,185,115.70 and Demands in the amount of\n$2,278,564.66.

4.\nRESOLUTION DETERMINING THE NEED TO CONTINUE THE\nPROCLAIMED LOCAL EMERGENCY RELATED TO THE NAVY NORTH\nHANGAR At its meeting on November 10, 2023, the City Council ratified\nthe Acting City Manager’s Proclamation of Local Emergency related to the\nfire at the Navy’s North Hangar and release of chemicals of public health\nconcern, including asbestos. At a special meeting of the City Council on\nJanuary 9, 2024, and at its regular meetings on March 5, 2024, April 16,\n2024, June 4, 2024, June 18, 2024, July 16, 2024, August 20, 2024,\nOctober 15, 2024, December 3, 2024, January 21, 2025, March 18, 2025,\nMay 6, 2025, June 17, 2025, August 5, 2025, September 16, 2025,\nNovember 4, 2025, December 16, 2025, February 3, 2026, and March 17,\n2026, the City Council reviewed and determined the need to continue the\nlocal emergency. This item recommends that the City Council once again\nreview and determine that the need exists to continue the local\nemergency, as required by State law.\nRecommendation: Recommended that the City Council adopt Resolution\n26-20 determining the need exists to continue the local emergency related\nto the fire and release of chemicals of public health concern from the\nNavy’s North Hangar, in the form attached hereto as Attachment 2.\nRESOLUTION NO. 26-20 A RESOLUTION OF THE CITY COUNCIL OF\nTHE CITY OF TUSTIN, CALIFORNIA, DETERMINING THE NEED TO\nCONTINUE LOCAL EMERGENCY RELATED TO FIRE AND RELEASE\nOF HAZARDOUS MATERIALS FROM NAVY NORTH HANGAR. 5.\nQUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND\nTHE\nSUCCESSOR AGENCY\nFOR THE TUSTIN\nCOMMUNITY\nREDEVELOPMENT AGENCY FOR THE QUARTER ENDED MARCH 31,\n2026 Government Code Section 53646 requires that the Treasurer make\nan Investment Report to the City Council at least quarterly showing\nbalances by authorized investment and certifying its compliance with the\nadopted Investment Policy.\nRecommendation: Recommended the City Council receive and file the\nreport.Fiscal Impact: There is no fiscal impact associated with this item.

6.\nJOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT –\nQUARTER THREE AND QUARTER FOUR, 2025 This agenda report\ntransmits the John Wayne Airport Noise Abatement Quarterly Report\ncovering the third and fourth quarters of 2025. The City of Tustin is within\nthe John Wayne Airport’s “Noise Impact Area” since it has the potential to\nexperience an average Community Noise Equivalent Level above 65\ndecibels. Community Noise Equivalent Level is a weighted 24-hour\naverage of noise levels, a measurement often used to regulate airport\nnoise impacts on the surrounding community. The average noise levels\nmeasured at Tustin’s monitoring station, located at Columbus Tustin\nMiddle School on Beneta Way (site map in Attachment A), remained\nbelow City, County, and State maximum criteria in the first and second\nquarter reporting periods.\nRecommendation: Recommend the City Council receive and file the\nreport. Fiscal Impact: There is no fiscal impact associated with this item.

7.\nAPPROVE AGREEMENT WITH DAVIS FARR LLP FOR INDEPENDENT\nAUDIT SERVICES The City issued a Request for Proposal (RFP) for\nprofessional auditing services and received eight proposals. The Audit\nCommission appointed an Ad-Hoc Committee, consisting of Chair Lillyan\nChandler and Commissioner John Wende, to evaluate proposals from the\ntop ranked audit firms. On April 23, 2026, the Audit Commission received\nfeedback from the Ad Hoc Committee. After deliberation, the Audit\nCommission recommended that the City Council approve a service\nagreement with Davis Farr LLP as the City’s independent auditor.\nRecommendation: Recommend the City Council: 1. Approve a\nprofessional service agreement with David Farr LLP as the independent\ncertified public accounting firm to perform auditing services for three years\nbeginning with the fiscal year ending June 30, 2026, with the option of\nproviding the same services for two subsequent fiscal years. 2. Authorize\nthe City Manager or designee to execute necessary contract documents\nand subsequent amendments with Davis Farr LLP subject to any non-\nsubstantive modifications as may be deemed necessary and/or\nrecommended by the City Attorney. Fiscal Impact: The all-inclusive fee\nproposed by Davis Farr LLP for the fiscal year ending June 30, 2026 is\n$54,240. The Fiscal Year 2026-2027 proposed budget includes sufficient\nfunding to cover the scope of work associated with this agreement. Total\nmaximum cost over a five-year contract term (initial three years plus two\noptional years if exercised) is $281,336 and will be incorporated in the\nannual proposed budget for Council's consideration.

8.\nPROPOSED ORDINANCE TO REGULATE THE OPERATION OF E-\nBIKES, BICYCLES AND OTHER REGULATED MOBILITY DEVICES The\nproposed ordinance would establish operational, safety, and enforcement\nregulations for bicycles, electric bicycles, and other regulated mobility\ndevices within the City. The intended purpose of the ordinance is to\naddress increasing safety concerns, clarify permissible conduct, and\nprovide enforcement tools to address unsafe riding behaviors on bicycles,\ne-bikes, and other regulated mobility devices. The proposed framework\nemphasizes behavior-based regulation, focusing on unsafe operation,\nrather than restricting the safe and lawful use of mobility devices.\nRecommendation: Recommend the City Council introduce and conduct\nfirst reading by title only of Ordinance No. 1576 repealing Section 5344\n(Use of Motorized Cycles) and Section 5345 (Use of Bicycles) of the\nTustin City Code, and adding new Part 5 (Bicycles and Regulated Mobility\nDevices) to Chapter 3 (Traffic Regulations) of the Tustin City Code\nregarding operation of bicycles and regulated Mobility Operation of\nBicycles and Regulated Mobility Devices such as Electric Bicycles, and\nschedule the ordinance adoption for the City Council’s next scheduled\nregular meeting. ORDINANCE NO. 1576 AN ORDINANCE OF THE CITY\nCOUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING\nSECTION 5344 (USE OF MOTORIZED CYCLES) AND SECTION 5345\n(USE OF BICYCLES), AND ADDING NEW PART 5 (BICYCLES AND\nREGULATED MOBILITY DEVICES) TO CHAPTER 3 (TRAFFIC\nREGULATIONS)\nOF\nTHE\nTUSTIN\nCITY\nCODE\nREGARDING\nOPERATION OF BICYCLES AND REGULATED MOBILITY DEVICES\nSUCH AS ELECTRIC BICYCLES Fiscal Impact: There is no fiscal impact\nassociated with this item.

9.\nACCEPTANCE OF PUBLIC IMPROVEMENT AND AUTHORIZATION TO\nFILE THE NOTICE OF COMPLETION FOR THE CAMINO REAL PARK\nPLAYGROUND RENOVATION The Camino Real Park Phase 1\nPlayground Renovation has been completed, and is now ready for City\nCouncil acceptance. Phase 2 of the project, the Picnic Shelter\nRenovation, has been budgeted but is not yet complete and is not\nincluded in this Notice of Completion.\nRecommendation: Recommend the City Council: 1. Adopt Resolution No.\n26-21 accepting the Camino Real Park Phase 1 Playground Renovation,\nand 2. Authorize the City Clerk to file the Notice of Completion with the\nCounty Recorder's office for Phase 1 only. RESOLUTION NO. 26-21 A\nRESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,\nCALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND\nAUTHORIZING THE RECORDATION OF\nTHE NOTICE OF\nCOMPLETION FOR THE CAMINO REAL PARK PLAYGROUND (CIP NO.\n20096) Fiscal Impact: On November 4, 2025, the City Council authorized\nan appropriation in the FY 2025/2026 Capital Improvement Program from\nthe Park Development Fund in the amount of $ 1,000,000 for the Camino\nReal Playground and Picnic Shelter Renovation project (CIP No. 20096)\nwhich consists of two separate phases under distinct contracts. Project\nallocations\nincluded:\n•\nPhase\n1\nPlayground\n-\nInnovative\nPlaygrounds.........................$486,979.04 • Phase 2 Picnic Shelter - Icon\nShelter\nSystems\n.........................$421,864.76\n•\nTotal\nContract\nExpenditures..............................................$908,843.80 The final cost of\nthe playground renovation contract was $486,979.04, with no change\norders under the original scope of work. Phase 2 (Picnic Shelter\nRenovation) is currently in progress and will be presented to City Council\nfor acceptance at a later date.
