12. First and Second Amendment(s) to the Agreement for Professional Services\nbetween the City of Walnut and Placeworks\nRecommendation: That the City Council:\n1. Approve and authorize the City Manager to execute and administer the\nSecond Amendment to the Agreement for the Professional Services between\nthe City of Walnut and Placeworks, in substantially the form attached hereto,\nand in such final form as approved by the City Attorney; and\n2. Authorize the City Manager to execute and administer implementing\ndocuments and amendments necessary to complete the professional services\ncontemplated by the Agreement, as amended, provided developer funds are\navailable in the project deposit account and the implementing documents and\namendments are in such final form as approved by the City Attorney.

13. Award of Bid – 2023-2024 Maintenance Area 3 Slurry Seal Project\nRecommendation: That the City Council:\n1. Award a construction contract for the 2023-2024 Maintenance Area 3 Slurry\nSeal Project to Doug Martin Contracting Company, Inc. in the amount of\n$801,833.00;\n2. Reject all other bids;\n3. Appropriate $222,110.00 from METRO Measure R Fund Reserves (Fund 16)\nto the project;\n4. Authorize staff to issue a Purchase Order to Doug Martin Contracting\nCompany, Inc. in the amount of $801,833.00; and\n5. Authorize staff to issue change orders not to exceed 15% of the contract\naward amount ($120,274.95) to Doug Martin Contracting Company, Inc.; and\n6. Approve a Purchase Order to RKA Consulting Group in the amount of\n$75,000.

Award a construction contract for the Walnut Ranch Park Storm Drain\nImprovement Project to Perry C. Thomas, Inc. in the amount of\n$186,241.00;\n2. Reject all other bids;\n3. Appropriate $274,865.00 from American Rescue Plan Act (ARPA) Fund\nReserves to the Walnut Ranch Storm Drain Improvement Project;\n4. Authorize staff to issue a Purchase Order to Perry C. Thomas, Inc. in the\namount of $186,241.00;\n5. Authorize staff to issue change orders not to exceed 10% of the contract\naward amount ($18,624.10) to Perry C. Thomas, Inc.; and\n6. Approve a Purchase Order to RKA Consulting Group in the amount of\n$58,390.
