4. Second Extension of Urgency Ordinance Establishing a Moratorium on Senior\nMobilehome Park Conversions\nRecommendation:\nThat the Town Council:\n(1) Finds that the second extension of the Urgency Ordinance is not\nsubject to the California Environmental Quality Act (“CEQA”), pursuant\nto Sections 15060(c)(2) (the activity will not result in a direct or\nreasonably foreseeable indirect physical change in the environment),\n15060(c)(3) (the activity is not a project as defined in Section 15378),\nand 15061(b)(3) (the activity will not have a significant effect on the\nenvironment) of the CEQA Guidelines, California Code of Regulations,\nTitle 14, Chapter 3. These findings are premised on the fact that the\nadoption of this ordinance will maintain existing environmental\nconditions arising from the Town’s current land use regulations without\nsignificant change or alteration; and\n(2) Adopts the proposed Urgency Ordinance imposing a second\nextension on the moratorium prohibiting the conversion of any\nmobilehome park currently in existence in the Town from Seniors-Only\nMobilehome Park to a mobilehome park accepting residents of all ages.\nORDINANCE NO. 316\nA SECOND EXTENSION OF URGENCY ORDINANCE NO. 308 OF THE TOWN\nCOUNCIL OF THE TOWN OF YUCCA VALLEY, CALIFORNIA, ESTABLISHING\nA MORATORIUM ON THE CONVERSION/CHANGE OF ANY MOBILEHOME\nPARK CURRENTLY EXISTING IN THE TOWN FROM A PARK OCCUPIED\nPRIMARILY OR EXCLUSIVELY BY RESIDENTS OVER THE AGE OF 55 YEARS\n(SENIOR RESIDENTS) TO A MOBILEHOME PARK ALLOWING RESIDENTS\nOF ALL AGES\nDEPARTMENT REPORTS:

5. Ballot Measure to Reauthorize the Town's Existing Voter Approved Measure Y,\nTransaction and Use Sales Tax\nRecommendation:\n1. Adopt Resolution No. 24-31 calling an election to be\nconsolidated with the November 5, 2024 statewide election to\nsubmit to the voters of the Town a ballot measure to\nreauthorize the Town’s existing transactions and use tax (sales\ntax).\n2. Compliance with CEQA. Town Project No.8957: Miracle League Field Surface Replacement Project\nAuthorization to waive formal bidding Procedures, and award contract to Pro\nPlayground\nRecommendation:\nThat the Town Council:\n1- Waives the formal competitive bidding process pursuant to the\nMunicipal Code;\n2- Awards bid to Pro Playground, in the amount of $165,999 for the\nMiracle Field League Surface Replacement - Town Project No.8957,\nestablishes a contingency in the amount of $17,000, and authorizes\nthe Town Manager, Town Attorney and Mayor to sign all documents\nnecessary to implement the project and authorizes the Town\nManager to expend the contingency in order to deliver the project.\nFUTURE AGENDA ITEMS:
