8J. Authorization to enter into a Master License Agreement for Small Wireless Facility Attachment Installation with Ubicquia, Inc. Environmental Considerations: The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because it is not a "project" under Section 15378(b)(5) of CEQA Guidelines. The action involves an organizational or administrative activity of government that will not result in a direct or indirect physical change in the environment. Contact Person Senior Management Analyst Elmore Recommended Action: 1) Adopt Resolution 2025-106 titled, "A Resolution of the City Council of the City Of Encinitas, California, Amending the Authorized Maximum Site License Fee for Small Wireless Facilities and Other Infrastructure Deployments in the Public Rights-of-Way;" and 2) Authorize the City Manager, or designee, in consultation with the City Attorney, to execute a Master License Agreement for Small Wireless Facility Attachment Installation with Ubicquia, Inc., a Delaware corporation, in substantial form, for an initial ten-year term, with three (3) automatic five (5)-year extensions, for a not-toexceed twenty-five year term, with options to cancel by either party, and for a total agreement value to be determined in the manner set forth therein. 2025-10-15 Item 08J Master License Agreement for Small Wireless Facility Attachment Installation with Ubicquia Inc
