1. CONSIDERATION OF THE READOPTION OF DRAFT 4 OF THE 2021-2029 HOUSING\nELEMENT OF THE ALHAMBRA GENERAL PLAN, AND DIRECTING STAFF TO\nRESUBMIT THE DRAFT HOUSING ELEMENT TO THE STATE DEPARTMENT OF\nHOUSING AND COMMUNITY DEVELOPMENT – F2M20-37, N2M23-116, R2M23-50\nThis is the time and place set by Notice No. N2M23-116 for the City Council to hold a\npublic hearing to consider the readoption of Draft 4 of the 2021-2029 Housing Element of\nthe Alhambra General Plan and to direct staff to resubmit the Draft Housing Element to\nthe State Department of Housing and Community Development. On October 5, 2021, the\nHousing Element was submitted to the State Department of Housing and Community\nDevelopment “HCD”. City staff and the City’s Consultant (ECONorthwest) worked on\nresponding to HCD’s multiple correction letters and resubmitted updated versions of the\nHousing Element based on HCD’s comments. On January 3, 2022, the Planning\nCommission conducted a public hearing and recommended that the Alhambra City\nCouncil adopt the 2021-2029 Draft Housing Element (“Housing Element”). Then, on\nJanuary 31, 2022, the City Council adopted the Housing Element and directed staff to\n2\n10-9-23\nresubmit it to HCD for formal review. After submitting the adopted Housing Element to\nHCD, the City received multiple correction letters dated, December 2, 2021; April 8, 2022;\nOctober 10, 2022; and May 25, 2023. On May 25, 2023, HCD issued the City a letter\nindicating that this most recent 4th Draft of the Housing Element (attached to the staff\nreport) meets the statutory requirements of State Housing Element Law. However, HCD\nindicated that the Housing Element cannot be found in substantial compliance until the\nCity has completed the necessary re-zoning, which is currently underway as part of the\ncomprehensive Zoning Code update. Given that changes have been made since the\nPlanning Commission and City Council approved the Housing Element in January 2022,\nHCD requires re-adoption of the Housing Element. All revisions that have occurred since\nthe City Council approved the Housing Element in January 2022 are shown in the redlined\nversion of the Draft Housing Element provided in the staff report, and a clean, non-redlined\nversion is provided as an attachment to the staff report as well. On August 7, 2023, the\nPlanning Commission conducted a public hearing on the re-adoption of the 4th Draft of the\n2021-2029 Housing Element, and then continued the item to their meetings on August 21,\n2023 and September 18, 2023. On September 18, 2023, the Planning Commission\nfinalized a list of recommendations for nine (9) additional revisions to the 4 th Draft of the\nHousing Element which are outlined in an attachment to the staff report and adopted a\nResolution recommending the City Council re-adopt the revised 2021-2029 Housing\nElement. All comment letters received prior to this meeting as well as additional\ndocumentation related to the Housing Element have been posted on the project website\nat www.alhambrahousingelement.com and are available for public review.\nRecommended Action: City Council:\n1. Conduct a Public Hearing to receive public testimony;

10. ACCEPT GRANT: STATE OF CALIFORNIA GOVERNOR’S OFFICE OF EMERGENCY\nSERVICES AND THE FEDERAL EMERGENCY MANAGEMENT AGENCY UNDER\nHAZARD MITIGATION GRANT PROGRAM – F2M23-18, M2M23-177\nStaff requests that the City Council City Council accept a grant in the amount of $135,450\nfrom the State of California Governor’s Office of Emergency Services (Cal OES) and the\nFederal Emergency Management Agency (FEMA) under the Hazard Mitigation Grant\nProgram and approve a related Designation of Applicant’s Agent Resolution. The grant\nfunding will be used to create a Local Hazard Mitigation Plan which is a comprehensive,\nlong-term plan developed before a disaster occurs to identify local policies and actions\nthat can be implemented to reduce risk and future losses from hazards.\nRecommended Action: City Council accept a grant in the amount of $135,450 from\nthe State of California Governor’s Office of Emergency Services (Cal OES) and the\nFederal Emergency Management Agency (FEMA) under the Hazard Mitigation Grant\nProgram; approve the Designation of Applicant’s Agent Resolution as outlined in the\nOctober 9, 2023 joint report of the Assistant City Manager, Fire Chief and Grants\nSpecialist; appropriate revenue and expenditure funds; authorize the City Manager, or\ndesignee, to execute all documents related to grant implementation; and, direct staff to\nundertake the steps necessary to finalize Council’s action. 11. ESTABLISHMENT OF A NEW FUND AND ACCOUNTS IN THE 2023-2024 AND 2024-\n2025 ADOPTED BUDGET – F2M23-17, M2M23-178\nOn May 25, 2017, the Los Angeles County Metropolitan Transportation Authority (Metro)\nBoard voted to eliminate the SR-710 North extension between Alhambra and Pasadena.\nThe following year, the Board authorized the programming of $730 million in Measure R\n7\n10-9-23\nfunds in support of local road improvements to provide traffic congestion relief within the\nregion. In 2020, Measure R funds were dedicated to cities and other areas impacted by\nthe SR-710 North. Alhambra received an allocation of approximately $241 million for Local\nStreet/Road and Freeway Local Interchange Mobility Improvements, Local Street\nIntersection Improvements, and Traffic Signal Synchronization Projects. Currently, the\nprojects are assigned together in Measure R and Measure M sections of the Budget. In\norder to manage the costs associated with each project and to track reimbursable\nexpenses, staff is requesting the Finance Department establish a new fund and separate\naccounts as outlined in the October 9, 2023 joint report of the Assistant City Manager and\nDirector of Public Works and Utilities.\nRecommended Action: City Council: 1) Authorize the Finance Director to set up a\nnew fund (Fund 235) for the SR 710 North Mobility Improvement Project to track all related\nMeasure R 710 transactions; 2) Authorize the Finance Director to establish revenue and\nexpenditure accounts to track each project; 3) Approve an appropriation in the amount of\n$72,375 in the 2022-23 Fiscal Year Adopted Budget; $28,527,625 in the 2023-24 Fiscal\nYear Adopted Budget; and $19,300,000 in the 2024-25 Fiscal Year Adopted Budget; and,\n4) Direct staff to undertake the steps necessary to finalize Council’s action. 15. SECOND READING AND ADOPTION OF AN ORDINANCE REQUIRING SAFE\nSTORAGE OF FIREARMS – F2M23-7, O2M23-4819\n8\n10-9-23\nAt the September 11, 2023 City Council meeting, Vice Mayor Sasha Renée Pérez\nrequested that a suite of ordinances recently adopted by the City of Monterey Park be\npresented to the City Council for consideration. At the September 25, 2023 meeting, the\nCouncil adopted an urgency ordinance to temporarily prohibit the establishment of new\nfirearm sales businesses in the City of Alhambra as well as gave first reading to two\nordinances related to safe storage of firearms and prohibiting firearms on City property.\nThe safe storage ordinance adds a new section 9.92.050 to the Alhambra Municipal Code\nentitled “Safe Storage.” The proposed ordinance requires any person in a residence within\nthe City to store firearms in a locked container or disable them with an appropriate safety\ndevice in the home. Keeping a firearm locked when it is not being carried prevents\nunauthorized users, including children, from accessing and using firearms which can\nreduce unintentional discharges, firearm theft, and suicide.\nRecommended Action: City Council, by one motion, declare introduced for its second\nreading and adopt the following ordinance entitled:\nOrdinance No. O2M23-4819: AN ORDINANCE OF THE CITY COUNCIL OF\nTHE CITY OF ALHAMBRA, CALIFORNIA, ADDING SECTION 9.92.050\n“SAFE STORAGE” TO THE ALHAMBRA MUNICIPAL CODE TO REQUIRE\nTHE SAFE STORAGE OF FIREARMS

Adopt Resolution No. R2M23-50 entitled: A RESOLUTION OF THE CITY COUNCIL\nOF THE CITY OF ALHAMBRA, CALIFORNIA, APPROVING GENERAL PLAN\nAMENDMENT GPA-22-01 READOPTING THE 2021-2029 HOUSING ELEMENT OF\nTHE ALHAMBRA GENERAL PLAN (DRAFT 4), AND DIRECTING STAFF TO\nSUBMIT THE READOPTED HOUSING ELEMENT TO THE STATE OF CALIFORNIA\nDEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR\nCERTIFICATION\nPRESENTATION\n2. LEGISLATIVE UPDATE: SB 567 (DURAZO) ON TENANT PROTECTIONS AND SB2\nON STRENGTHENING CONCEALED GUN WEAPON LAWS AND FIREARM\nPOSESSION RESTRICTIONS – F2M23-7, O2M23-4820\nOn September 11, 2023, staff presented a report advising that SB 567 (Durazo), which\nadds requirements and restrictions for evictions related to substantial remodels, passed\nthe Senate and then was awaiting the Assembly for Third Reading. On September 30,\n2023, SB 567 was officially signed by the Governor, resulting the bill be enacted into law;\nhowever, pursuant to any last-minute amendments that occurred during the Third Reading\nprocess. One kay change to the bill was a new implementation date of April 1, 2024. On\nMay 23, 2023, the City Council adopted Urgency Ordinance O2M23-4811, establishing\nthe same renoviction protections as SB 567 through December 31, 2023. SB 567 was\noriginally identified to become effective on January 1, 2024; however, since this date was\n3\n10-9-23\nrecently amended to April 1, 2024, staff is requesting the City’s Urgency Ordinance be\nextended to March 31, 2024 to ensure there are no gaps in protections in Alhambra before\nSB 567 becomes effective.\nOn September 26, 2023, the Governor signed various firearm safety bills, including SB 2,\nwhich is designed to strengthen concealed carry weapons laws by ensuring firearms in\npublic do not pose danger; setting minimum age requirements to 21; requiring stronger\nstorage and training requirements; identifying certain sensitive places where guns may\nnot be carried; and including due process protections. On September 25, 2023, the City\nCouncil introduced and gave first reading to Ordinance O2M23-4820, prohibiting firearms\non public property. Since SB 2, under Section 27, addresses those same sensitive place\nand restrictions as Ordinance O2M23-4820, staff is recommending the City not proceed\nwith agendizing the second reading of Ordinance O2M23-4820.\nRecommended Action: City Council receive a report regarding the passage of SB\n567 (Durazo), state tenant protections subject to “no fault” evictions due to substantial\nremodels, which has relevance to Alhambra’s Urgency Ordinance O2M23-4811, which\nexpires on December 31, 2023, but should be extended to March 31, 2024; receive a\nreport on SB 2 (Portantino), which bill was recently signed into law prohibiting possessing\nfirearms in public property, as intended by the City Council under Ordinance O2M23-4820;\nand, direct staff to undertake the steps necessary to carry out the Council’s actions.\nCONSENT AGENDA (Item Nos. 3 – 15)\nAll items listed under the Consent Agenda are considered by the City Council to be routine and\nwill be enacted by one motion unless a citizen or Council member requests otherwise; in which\ncase, the item will be removed for separate consideration.

AWARD CONTRACT: 6th STREET SEWER MAIN REPLACEMENT PROJECT- PHASE\nII – F2M21-47, N2M23-103, C2M23-79, M2M23-172\nOn August 28, 2023, the City Council approved the distribution of a Notice Inviting Bids\nfor the Sixth Street Sewer Main – Phase 2 between San Marino Avenue and Valley\nBoulevard. On September 28, 2023, bids were opened by the City Clerk. Ten bids were\nreceived, which ranged from $1,168,950.00 to $2,667,640.00. Ramona Inc. submitted the\nlowest qualified bid at $1,168,950.00. Staff reviewed the bid submitted by Ramona Inc.\nand found it to be in full compliance and conformance with the project specifications.\nRecommended Action: City Council award a contract, subject to final language\napproval by the City Manager and City Attorney, by and between the City of Alhambra and\nRamona Inc., for the Sixth Street Sewer Main Replacement Project - Phase 2 in an amount\nnot to exceed $1,168,950.00; find the 6th Street Sewer Main Replacement Project -\nPhase 2 categorically exempt from California Environmental Quality Act (CEQA) pursuant\nto CEQA Guidelines Section 15301 (b); and, direct staff to undertake the steps necessary\nto finalize Council’s action. AWARD CONTRACT: REHABILITATION OF THE SEWER MAIN ON BEACON\nSTREET – F2M23-61, N2M23-104, C2M23-80, M2M23-173\n4\n10-9-23\nOn August 28, 2023, the City Council approved the distribution of a Notice Inviting Bids\nfor the Rehabilitation of the Sewer Main on Beacon Street. On September 21, 2023, bids\nwere opened by the City Clerk. Three bids were received, which ranged from $36,560.00\nto $111,980.00. Southwest Pipeline & Trenchless Corp. submitted the lowest qualified bid\nat $36,560.00. Staff reviewed the bid submitted by Southwest Pipeline & Trenchless Corp.\nand found it to be in full compliance and conformance with the project specifications.\nRecommended Action: City Council award a contract, subject to final language\napproval by the City Manager and City Attorney, by and between the City of Alhambra and\nSouthwest Pipeline & Trenchless Corp. for the Rehabilitation of the Sewer Main on\nBeacon Street in an amount not to exceed $36,560.00; find the Rehabilitation of the Sewer\nMain on Beacon Street categorically exempt from California Environmental Quality Act\n(CEQA) pursuant to CEQA Guidelines Section 15301 (b); and, direct staff to undertake\nthe steps necessary to finalize Council’s action. 5. NOTICE OF COMPLETION: REHABILITATION OF THE STORM DRAIN ON\nMONTEZUMA AVENUE – F2M23-40, C2M23-49, M2M23-174\nOn June 26, 2023, the City Council awarded a contract to Sancon Technologies, Inc. for\nthe Rehabilitation of the Storm Drain on Montezuma Avenue in an amount of $130,045.00.\nThere was one change order authorized for the project, which was for additional work to\nCCTV the storm drain downstream of the project area on Ramona Avenue. The change\norder increased the total amount of the contract by $1,250.00, for a total of $131,295.00.\nThe project has been completed in accordance with the City requirements and\nspecifications. As such, it would be appropriate for the City Council to accept the project\nas complete and instruct the City Clerk that the Notice of Completion be filed with the\nCounty of Los Angeles Recorder’s Office.\nRecommended Action: City Council accept the work of Sancon Technologies, Inc.\nfor the Rehabilitation of the Storm Drain on Montezuma Avenue as complete in the amount\nof $131,295.00; direct the Finance Director to appropriate $1,250.00 from the Safe Clean\nWater Program Fund balance and allocate the fund to account number\n233.80.8882.92240; direct the City Clerk to file a Notice of Completion with the County of\nLos Angeles for recordation; direct the Finance Director to release the five percent\nretention 35 days from the date of recordation if no liens are filed; and, direct staff to\nundertake the steps necessary to finalize Council’s action. NOTICE INVITING BIDS: ALHAMBRA PARK POOL IMPROVEMENT PROJECT –\nF2M22-37, N2M23-121\nOn October 24, 2022, the City Council awarded a contract to Goodale Architecture and\nPlanning for professional engineering and design services to provide plans, specifications,\nand bid documentation for the Alhambra Pool Improvement Project. The Alhambra Park\nPool Improvement Project will include a complete renovation of the pool facility to\ntransform the lobby, expand restrooms and changing areas, upgrade to high efficiency\nfixtures, install new roofing and exterior upgrades, sustainable landscaping, and shaded\nseating. Specifications and bid documentation have been completed for the Project. Bids\nare due no later than 10:30 a.m. on December 7, 2023 in the office of the City Clerk and\nwill be opened at 11:00 a.m. that same day.\n5\n10-9-23\nRecommended Action: City Council authorize staff to circulate a Notice Inviting Bids\nto prospective contractors for the Alhambra Park Pool Improvement Project; and, direct\nstaff to undertake the steps necessary to finalize Council’s action.

7. ACCEPT GRANT: SAN GABRIEL VALLEY COUNCIL OF GOVERNMENTS (SGVCOG)\nFOR HOMELESS SERVICES – F2M23-18, M2M23-175\nThe SGVCOG entered into a contract with the County of Los Angeles for Measure H\nfunding for homeless services in support of the County’s Homeless Initiative (HI) strategies\nto combat homelessness in the San Gabriel Valley. The SGVCOG Board allocated\n$30,000 from Measure H funds to support Alhambra’s needs, including supplementing\nexisting homelessness programs, outreach and services for hard-to-reach populations.\nThe City and SGVCOG have set the terms of ongoing collaboration with respect to\naddressing homelessness in a Memorandum of Agreement (MOA). The term of this MOA\nis through June 30, 2024, and it may be extended by mutual agreement of both parties by\nway of an amendment to the MOA.\nRecommended Action: City Council authorize staff to accept the San Gabriel Valley\nCouncil of Governments (SGVCOG) grant in the amount of $30,000 for homeless\noutreach, housing navigator and case management services and emergency\nhousing/shelter placement; authorize the City Manager to sign the Memorandum of\nAgreement (MOA); appropriate the grant revenue and expenditure funds in the amount of\n$30,000; and, direct staff to undertake the steps necessary to finalize the Council’s action.\n(M2M23-175)

8. AWARD OF CONTRACT: FINANCIAL CONSULTING SERVICES RELATED TO\nTHE AMERICAN RESCUE PLAN ACT - F2M21-67, C2M23-76, M2M23-176\nStaff is requesting to award a contract to CliftonLarsonAllen LLP to provide financial\nconsulting services over the remainder of the ARPA reporting period. The contract will\ncover four fiscal years, ending on June 30, 2027 with a not to exceed amount of $120,000.\nFederal ARPA funds come with stringent guidelines and reporting requirements;\nconsequently, failure to comply with the ARPA restrictions and reporting guidelines can\nresult in the recoupment of funds. Projects must be obligated by December 31, 2024, with\nthe period of performance concluding by December 31, 2026. The City would like to\ncontinue services with CliftonLarsonAllen LLP due to the firm’s knowledge of the City and\nfor continuity of work product. Staff recommends awarding this contract in accordance\nwith Section 3.38.050 of the Alhambra Municipal Code, which stipulates the City Council\nmay dispense with the bidding process, at their discretion, if they deem it would be\nadvantageous to the City to do so.\nRecommended Action: City Council approve an award of contract, subject to final\nlanguage approval by the City Manager and City Attorney, for professional services with\nCliftonLarsonAllen LLP to provide financial consulting services related to the American\nRescue Plan Act (ARPA) in the amount of $120,000 (C2M23-76); approve a transfer of\n$120,000 from account number 281.70.9101.92024 to 281.16.9101.62110; and, direct\nstaff to undertake the steps necessary to finalize Council’s action. 9. RESOLUTION APPROVING A THIRD SIDE LETTER AGREEMENT AMENDING THE\nMEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF ALHAMBRA AND\nALHAMBRA POLICE DISPATCH ASSOCIATION (APDA) – F2M23-2, R2M23-51,\nC2M21-51, M2M23-179\nIn the past few years, the City has been challenged in the area of recruitment and retention\nof Police Dispatchers. Challenges include turnover of newly hired dispatchers who fail to\nmeet probationary standards or whom resign or retire. Therefore, staff is requesting the\nability to overhire effective immediately. The proposed Third Side Letter with APDA\nprovides the City Manager with the ability to overhire by one (1) Full-Time Dispatcher. This\nensures the Police Department’s staffing levels in this area remain stable by allowing the\none overhire position to easily and readily be available to step in and fill any vacancies\nduring transition periods brought on by any resignations or retirements.\nRecommended Action: City Council, by one motion, take the following actions: 1)\nAdopt Resolution No. R2M23-51 entitled: A Resolution of the Alhambra City Council\napproving a Third Side Letter amending the Memorandum of Understanding between the\nCity of Alhambra and the Alhambra Police Dispatch Association; and, 2) Direct the\nFinance Director to make necessary budget adjustments within the Fiscal Year 2023-24\nand 2024-25 Adopted Budget to allow for the overhire of one (1) Full-Time Dispatcher.\n(M2M23-179)
