Award the contract to the lowest responsible bidder, Big Ben Inc., in the amount of $4,995,512 for\nthe Rio Vista Street Sanitary Sewer Improvements from Lincoln Avenue to South Street and the\nSanitary Sewer Improvements at the Ball Road and Western Avenue Intersection; and the Rio\nVista Street Rehabilitation from Lincoln Avenue to Wagner Avenue and Wagner Avenue from Rio\nVista Street to Marjan Street Project; authorize the Director of Public Works to execute the\ncontract and related documents and to take the necessary actions to implement and administer\nthe contract; determine that the project is categorically exempt from the California Environmental\nQuality Act pursuant to Class 2, Section 15302 (c) (Replacement or Reconstruction) of Title 14 of\nthe California Code of Regulations; and authorize the Finance Director to execute the Escrow\nAgreement pertaining to contract retentions [continued from the Council meeting of March 4,\n2025, Item No. 7].\n4 March 25, 2025

Approve two Passthrough Agreements with the Anaheim Transportation Network, i) in an amount\nnot to exceed $2,010,000, toward the purchase of battery-electric buses for the term expiring\nJune 30, 2027; ii) in an amount not to exceed $305,120, toward the completion of a Needs and\nOpportunity Study focusing on three census tracts identified as areas of persistent poverty, for the\nterm expiring June 30, 2027; authorize the Director of Public Works, or designee, to execute the\nagreements and related documents necessary to implement the agreements; and increase the\nPublic Works revenue and expenditure budget in restricted transportation grant funds by\n$2,315,120 in the appropriate fiscal year [continued from the Council meeting of March 4, 2025,\nItem No. 10].

Approve the professional services agreement with Dudek, in an amount not to exceed $180,000,\nfor consultant services for the City of Anaheim Wildfire Evacuation Plan; authorize the Public\nWorks Director, or designee, to execute the agreement and to take the necessary, required, or\nadvisable actions to implement and administer the agreement; and increase the Public Works\nDepartment’s Fiscal Year 2024/25 revenue and expenditure budgets in the Restricted\nTransportation Grant funds by $90,000.

Approve a software services agreement with Accelerated Technology Laboratories, LLC for a\nweb-based water quality management software solution including implementation and training\nservices for a one year term with one year optional extensions, in an amount not to exceed\n$38,380 for one-time start-up costs and an annual amount not to exceed $38,125 with a\nConsumer Price Index escalator for software subscriptions, plus a 15% contingency for as-\nneeded extra services; and authorize the Public Utilities General Manager, or designees, to\nexecute the agreement and related documents, including any cost-neutral amendments, and any\ndocuments contemplated by the agreement and to take the necessary actions to implement, fund,\nand administer the agreement.

16. Approve License Agreement (Number FB2520-24XXX-2327) with the United States Air Force\nTechnical Applications Center for ground-based sensor equipment installation at 425 S. Harbor\nBoulevard for a five year term; and authorize the Chief of Police to execute the agreement.

Approve an agreement with Joseph Sakoda, in the amount of $276,282 with an annual 10%\ncontingency for as-needed extra services, to provide a Fitness & Recovery Training Program for\na five year term; and authorize the Fire Chief, or designees, to execute the agreement and\nrelated documents, including any cost-neutral amendments, and any documents contemplated by\nthe agreement and to take the necessary actions to implement, fund, and administer the\nagreement.

(“KABOOM!”) on behalf of the City of Anaheim for the installation\nand maintenance of playground equipment at Maxwell Park, authorizing the Director to execute\nall required grant documents and amending the budget accordingly [city contribution amount of\nup to $125,876].\nApprove and authorize the Director of Community Services, or designee, to execute the 2025\nPlayspace Partner Agreement with KABOOM! and act as the agent of the city on all matters\nconcerning the grant programs and accept future stipends and funds received from KABOOM! for\nmaintenance of the playground equipment at Maxwell Park.

Beach Boulevard, formerly 130 S. Beach Boulevard].

This request was\ndenied by the Planning and Building Director. Pursuant to Anaheim Municipal Code Section\n18.60.135, appeals of a decision made by the Planning and Building Director are subject to\nreview by the Planning Commission, which was denied.\nENVIRONMENTAL DETERMINATION: Pursuant to Section 15270 of the State California\nEnvironmental Quality Act (CEQA) Guidelines (California Code of Regulations, Title 14, Chapter\n3, Sections 15000-15387), CEQA does not apply to disapproved projects.\nACTION TAKEN BY THE PLANNING COMMISSION: Approved Resolution No. PC2025-003,\ndenying the appeal of the Planning and Building Director’s decision to deny the proposed\nmodifications to the Mills Act property, thereby denying Planning and Zoning Application No.\n2024-00546.
