Approve and award the construction contract for the City Council Chambers Project (CIP No. 22-038) to CWS Systems Inc. in the amount of $4,561,920.00; and 2. Approve a 10% construction contingency in the amount of $456,192.00 for the project; and 3. Authorize the Mayor and City Clerk to execute the agreement with CWS Systems Inc. 4. Authorize the Director of Finance to make the funding reallocations shown in the second table under the Fiscal Impact section, and to make any necessary appropriations and budget adjustments.

Waive further reading and adopt Ordinance No. 1528 entitled: “AN ORDINANCE OF THE ESTABLISHING A MORATORIUM ON THE APPROVAL, ESTABLISHMENT, OR OPERATION OF BATTERY ENERGY STORAGE SYSTEMS FACILITIES TO CONSIDER ADOPTING REGULATIONS FOR BATTERY ENERGY STORAGE SYSTEM FACILITIES PURSUANT TO GOVERNMENT CODE SECTION 65858”

17. First Reading and Introduction of an Ordinance that Amends Title XV, Chapter 153 of the (Location: City Wide; Case Number AZC 25-04). It is recommended that the City Council: 1. Conduct a public hearing. 2. Find the proposed ordinance is exempt from environmental review under the California Environmental Quality Act (Pub. Resources Code, §§ 21000 et seq.) (“CEQA”) and the State CEQA Guidelines (Cal. Code Regs, tit. 14, §§ 15000 et seq.). Specifically, the ordinance is exempt from CEQA under Guidelines Section 15061(b)(3) (Common Sense Exception) since it can be seen with certainty that there is no possibility that the ordinance may have a significant effect on the environment, either directly or indirectly, and that therefore no environmental review under CEQA is required. 3. Introduce by first reading, by title only and waive further reading, Ordinance 1527, entitled CALIFORNIA, AMENDING THE BALDWIN PARK MUNICIPAL CODE, TITLE XV, LAND USAGE, CHAPTER, 153, ZONING CODE, SECTIONS 153.030.010, 153.040.010, 153.040.020, 153.040.030, 153.040.040, 153.040.070, 153.040.080, 153.040.300, 153.130.050, 153.150.130, 153.160.040, 153.200.190 AND 153.210.170 RELATING TO CONSISTENCY OF DEVELOPMENT STANDARDS ON ALL RESIDENTIALLY ZONED PARCELS AND MAKING A FINDING OF EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT”

It is recommended that the City Council hold a Public Hearing and after considering testimony, adopt California, Ordering the Annual Levy and Collection of Assessment Associated with the Citywide Landscaping and Lighting Maintenance Assessment District for FY2026-2027 and Authorizing the Los Angeles County Assessor to Add this Special Assessment to the Property Tax Bills” and authorize the Director of Finance to make necessary appropriation budget adjustments.

2. Authorize the Mayor and City Clerk to execute the Reduced Tuition Partnership Agreement with the Claremont Lincon University. 6. Adoption of a Resolution Authorizing the Chief Executive Officer, Chief of Police and Finance Director to Execute Agreements, Assurances and Reimbursement Claims to Obtain Federal Financial Assistance Under Public Law 93-288 As Amended By the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, And/Or State Financial Assistance Under the California Disaster Assistance Act It is recommended that the City Council: A. Adopt the attached resolution (Cal OES Form 130); and B. Authorize the Chief Executive Officer, Chief of Police and Finance Director to execute agreements, assurances, and reimbursement claims to obtain federal financial assistance under Public Law 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state financial assistance under the California Disaster Assistance Act. 7. Creation of Limited-Term Senior Engineer Classification; Adopt Resolution No. 2026-020 Amending the City’s Comprehensive Salary Schedule in Accordance with CalPERS Established Guidelines; and Adopt Resolution No. 2026-021 Approving a Side Letter Agreement with City Employee’s Association (CEA) It is recommended that the City Council: 1. Approve the new title of Senior Engineer – Limited Term. Comprehensive Salary Schedule adopted by Resolution 2024-036, to update job titles for the above referenced job classifications.

Approve the Employment Agreement with Keith Kang for the position of Accounting Manager, subject to any non-substantive changes made by Chief Executive Officer and the City Attorney, and subject to conditions precedent reflected in the agreement; and 2. Authorize the Mayor and City Clerk to execute the Employment Agreement with Keith Kang.

Adoption of Resolution No. 2026-023 Submitting a Non-Retail Cannabis Business Tax Measure to the Electorate at the November 3, 2026, General Municipal Election and Requesting Consolidation with Other Elections Held on November 3, 2026 It is recommended that the City Council: 1. Adopt Resolution No. 2026-023, entitled “A RESOLUTION OF THE CITY COUNCIL OF CANNABIS BUSINESS TAX MEASURE TO THE ELECTORATE AT THE NOVEMBER 3, 2026 GENERAL MUNICIPAL ELECTION; REITERATING ITS REQUEST THAT THE ELECTION BE CONSOLIDATED WITH OTHER ELECTIONS TO BE HELD ON THAT DATE; AND TAKING CERTAIN OTHER RELATED ACTIONS”; and 2. If desired, authorize members of the City Council to file an argument and rebuttal regarding the measure.

American Rescue Plan Act (ARPA) Reallocation and Re-Obligation, and Reallocation of Other Funding Sources for the City Council Chamber Improvements Project It is recommended that the City Council: 1. Approve the reallocation and re-obligation of ARPA funds from Council Chamber Improvements to the projects and programs herein in the amount of $1,348,612.19; and 2. Approve Addendums under the Attachments section; and 3. Approve the reallocation of the funds in the amount of $2,177,666.88 listed in the table under the Fiscal Impact section to the Council Chamber Improvements Project; and 4. Authorize the Director of Finance to make the appropriation and necessary budget adjustments.

23. Appropriation of Funding to Buyout City Vehicles Leased through Enterprise Fleet Management, Inc. It is recommended that the City Council: 1. Approve the funding for the purchase and buyout of select City vehicles currently leased through Enterprise Fleet Management, Inc. in an amount not-to-exceed $851,425; and 2. Authorize the Director of Finance to make appropriation and necessary budget adjustments; and 3. Authorize the Mayor and City Clerk to execute all necessary agreements and documents related to the vehicle buyout transactions with Enterprise Fleet Management, Inc., upon finalization; and 4. Authorize the Director of Public Works or his designee to process all necessary documents related to the purchase, transfer, registration, and continued operation of the vehicles.

Authorize the Chief of Police to execute the Grant Agreement on behalf of the City; and 5. Authorize the Director of Finance to make the appropriation and necessary budget adjustments.

9. Professional Service Agreement (PSA) with The Wellness Center for the City of Baldwin Park Tobacco Grant Program It is recommended that the City Council: 1. Approve the Professional Service Agreement with The Wellness Center in the amount of $121,800.00; and 2. Authorize the Mayor and the City Clerk to execute the Agreement for the Tobacco Grant Program for a three-year term (Fiscal Years 2024/25 through 2027/28) between the Wellness Center and the City of Baldwin Park; and 3. Authorize the Director of Finance to appropriate funds in the amount of $225,228.00 from Fund 270 – Grant Funds.

Mayor Damian seeks the consensus of the City Council to discuss the request from Alzheimer's Foundation of America to participate annually in the Light the World in Teal by illuminating the Baldwin Park Transit Center Bridge for the annual awareness initiative to be held on the first Monday in November.
