RESOLUTIONS AND APPROPRIATIONS RELATED TO SALE OF BONDS\nFOR UNDERGROUND UTILITY ASSESSMENT DISTRICT 2014-2 (WOODS\nCOVE)\nRecommendations:\n(1) Adopt the attached resolutions for Underground Utility Assessment District\n2014-2 (Woods Cove) titled:\na. “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF\nLAGUNA BEACH, CALIFORNIA, DETERMINING UNPAID\nASSESSMENTS IN UNDERGROUND UTILITY ASSESSMENT\nDISTRICT NO. 2014-2 (WOODS COVE) AND THE MANNER OF\nPAYMENT THEREOF AND LISTING BONDS ISSUED ON THE\nSECURITY THEREOF;”\nb. “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF\nLAGUNA BEACH, CALIFORNIA, AUTHORIZING THE\nISSUANCE OF CITY OF LAGUNA BEACH UNDERGROUND\nUTILITY ASSESSMENT DISTRICT NO. 2014-2 (WOODS COVE)\nLIMITED OBLIGATION IMPROVEMENT BONDS, AWARDING\nTHE SALE OF SUCH BONDS, APPROVING FISCAL AGENT\nAGREEMENT, OFFICIAL STATEMENT, BOND PURCHASE\nAGREEMENT, AND CONTINUING DISCLOSURE CERTIFICATE\nAND AUTHORIZING THE CITY MANAGER, OR ASSISTANT\nCITY MANAGER/CHIEF FINANCIAL OFFICER TO\nNEGOTIATE THE TERMS OF THE PURCHASE OF THE BONDS;\n(2) Approve the purchase of Underground Utility Assessment District 2014-2\n(Woods Cove) public offering municipal serial bonds at a 25-year term with a true\ninterest cost of 4.56%;\n(3) Authorize the use of the Utility Underground Assessment Deferment Loan\nProgram for qualified applicants;\n(4) Determine if one applicant who does not meet the eligibility criteria can qualify\nfor the Deferment Loan Program;\n(5) Appropriate $16,450,801 for construction and other related expenses within\nUnderground Utility Assessment District 2014-2 (Woods Cove), increase revenues\nby the same amount, and authorize the City Manager to expend all appropriated\nfunds; and\n(6) Authorize the City Manager to enter into necessary utility company agreements\nand make advance payments to the utility companies for their construction\nservices for a total amount of $3,375,041.

CONSIDERATION TO ESTABLISH A LOCAL HOUSING TRUST FUND\nRecommendations:\n(1) Adopt the Resolution titled “A RESOLUTION OF THE CITY COUNCIL OF\nTHE CITY OF LAGUNA BEACH, CALIFORNIA, ESTABLISHING THE CITY\nOF LAGUNA BEACH LOCAL HOUSING TRUST FUND, ADOPTING THE\nUNIFORM MULTIFAMILY REGULATIONS, AUTHORIZING THE CITY\nMANAGER TO APPLY FOR AND EXECUTE AGREEMENTS FOR GRANTS\nRELATED TO THE LAGUNA BEACH LOCAL HOUSING TRUST FUND, AND\nAUTHORIZING THE CITY MANAGER TO ISSUE A NOTICE OF FUNDING\nAVAILABILITY OF EXISTING HOUSING IN-LIEU FUNDS AND HOUSING\nFUNDS AND ANTICIPATED LOCAL HOUSING TRUST FUNDS” to:\na. Establish the Laguna Beach Local Housing Trust Fund;\nb. Adopt administrative guidelines;\nc. Adopt the Uniform Multifamily Regulations;\nd. ACCEPT A DONATION TO FUND A TEMPORARY PUBLIC ART\nINSTALLATION OUTSIDE CITY HALL\nRecommendations: It is recommended by the Arts Commission that the City Council\n(1) Accept a donation of $24,000 from Laguna Beach residents Mark Porterfield\nand Steve Chadima to fund a temporary public art installation;\n(2) Authorize the Mayor to sign a letter of appreciation to the donors\n(3) Appropriate $24,000 for the temporary installation “Epicenter” by Casey\nParlette and increase donation revenue in the General Fund by the same amount;\n(4) Approve the temporary public art installation “Epicenter” outside City Hall;\nand\n(5) Find said action exempt from the California Environmental Quality Act.

EXTENSION OF AN URGENCY ORDINANCE OF THE CITY OF LAGUNA\nBEACH, CALIFORNIA, RE-CODIFYING CHAPTER 25.95 OF THE LAGUNA\nBEACH MUNICIPAL CODE REGULATING SINGLE FAMILY\nRESIDENTIAL ONE- AND TWO-UNIT DEVELOPMENTS AND URBAN LOT\nSPLITS PURSUANT TO CALIFORNIA SENATE BILL 9\nRecommendations: Open the public hearing, consider the evidence presented, close\nthe public hearing, and:\n(1) Adopt the Ordinance titled “AN ORDINANCE OF THE CITY OF LAGUNA\nBEACH, CALIFORNIA, FOR AN EXTENSION OF URGENCY ORDINANCE\nNO. 1693 OF THE CITYOF LAGUNA BEACH RE-CODIFYING CHAPTER\n25.95 OF THE LAGUNA BEACH MUNICIPAL CODE REGULATING SINGLE\nFAMILY RESIDENTIAL ONE- AND TWO-UNTIL DEVELOPMENTS AND\nURBAN LOT SPLITS PURSUANT TO CALIFORNIA SENATE BILL 9”, to\nextend the City’s Urgency Ordinance No. 1693 for 22 months and 15 days, or until\nthe City’s permanent ordinance is certified by the California Coastal Commission,\nwhich would allow additional time for the City to analyze the Housing and\nCommunity Development Department’s correspondence for the purpose of\nevaluating whether to revise the City’s permanent regulations and the California\nCoastal Commission to certify the City’s permanent regulations for Senate Bill 9\nproperties/projects; and\n(2) Find that said action is statutorily exempt from California Environmental\nQuality Act under California Government Code sections 65852.21, subdivision (j)\nand 66411.7, subdivision (n), whereby the adoption of an ordinance by a city to\nimplement provisions of Government Code sections 66411.7 and 65852.21 and\nregulation Urban Lot Splits and Two-Unit Developments is statutorily exempt\nfrom the requirements of California Environmental Quality Act.

CITIZENS’ AUDIT REVIEW AND INVESTMENT ADVISORY COMMITTEE\nREPORT ON THE RESULTS OF THE FISCAL YEAR 2021-22 AUDIT\nRecommendations: The Citizens’ Audit Review and Investment Advisory Committee\nrecommends that the City Council:\n(1) Receive and file the Citizens’ Audit Review and Investment Advisory\nCommittee Annual Report on the results of the audit for Fiscal Year 2021-22; and\n(2) Consider implementing the Committee’s recommendations.

CITIZENS’ AUDIT REVIEW AND INVESTMENT ADVISORY COMMITTEE\nRECOMMENDATION TO OUTSOURCE THE MANAGEMENT OF THE\nCITY’S INVESTMENT PORTFOLIO\nRecommendations: The Citizens’ Audit Review and Investment Advisory Committee\nrecommends that the City Council:\n(1) Receive a presentation from the Citizens’ Audit Review and Investment\nAdvisory Committee summarizing the request for proposal procurement process\n(2) Approve a recommendation to retain Meeder Public Funds, Inc. to manage the\nCity’s investment portfolio; and\n(3) If outsourcing of the management of City investments is approved, request staff\nto prepare a transition plan, including modifying roles and responsibilities as\nappropriate.
