CC 3.\nCheck Registers – June 11, 2023, through June 26, 2023.\nApprove the Check and Wire Registers for June 11, 2023, through June 26, 2023, in the\namount of $5,980,859.75 as presented.\nAt each regular City Council Meeting, the City Council is presented with a check and\nACH/wire registers listing the financial claims (invoices) against the City for the purchase\nof materials, supplies, services, and capital projects issued the prior three to four weeks.\nThis process provides the City Council the opportunity to review the expenditures of the\nCity. Claims are paid via checks, Automated Clearing House (ACH) payments, or federal\nwires. The justifying backup information for each expenditure is available in the Finance\nDepartment.

CC 4.\nSubordination Agreement, allowing Laurel Crest L.P. to Proceed with Refinance of Senior\nLoan for Laurel Crest Apartments\nAdopt Resolution No. 23-52, authorizing the City Manager, or his designee, to finalize\nterms, modify and execute a subordination agreement with respect to the $3,412,500.00\nLancaster Redevelopment Agency Loan and a $4,024,440.00 HCD loan, allowing Laurel\nCrest, L.P. to proceed with mortgage refinance of senior loan for Laurel Crest Apartments.\nCity staff received a request from Laurel Crest L.P., owner and manager of Laurel Crest\nApartments, to subordinate Laurel Crest’s $3,412,500.00 Lancaster Redevelopment\nAgency loan with the City of Lancaster (City) to a new $1,900,000.00 first mortgage loan\n(the “New Loan”) from Clearinghouse Community Development Financial Institution\n(“CCDFI”) and the $4,024,440.00 HCD loan as part of a restructuring of the HCD loan\nunder HCD’s Loan Portfolio Restructuring Program, whereby new loan documents will\nbe issued. Development of Laurel Crest Apartments, a 72-unit complex, was financed\nthrough a combination of mortgage loan, multi-family revenue bonds, HCD loan, a\nLancaster Redevelopment Agency/the City loan, and the owner/investor. Laurel Crest\nL.P. (the “Borrower”) now desires to refinance and pay off the existing Bond loan that has\na balance of $1,508,096.47 as of May 2023 with a loan provided by CCDFI in the amount\nof $1,900,000.00. The additional proceeds above the existing loan balance will be used\nfor deferred capital expenditure items, such as a new fence, new boiler, new mailbox area,\nlandscaping, et cetera.

CC 5.\n\n2023 Transformative Climate Communities Planning Grant Application Submission\nApproval\n1. Adopt Resolution No. 23-53, authorizing the submittal of an application to the\nCalifornia State Department of Housing and Community Development for funding under\nthe Transformative Climate Communities Program; and delegating the authority to the\nCity Manager or his designee, to negotiate and execute all related documents.\n\n2. If funded, accept the Transformative Climate Communities grant award funds and\nappropriate said funds into a Transformative Climate Communities Fund account number,\nto be created by Finance, for expenditure in accordance with the Transformative Climate\nCommunities Program.\n\nThe Transformative Climate Communities (TCC) Program is part of the State of\nCalifornia’s Climate Budget and funds the “development and implementation of\nneighborhood-level transformative climate community plans that provide local economic,\nenvironmental, and health benefits to disadvantaged communities.” This opportunity\nuniquely aligns with the redevelopment goals for the former Fairgrounds site at Division\nStreet and Avenue I. Local governments are eligible to apply for Planning Grants as Lead\nApplicants; however, there must be a minimum of one Co-Applicant in addition to the\nLead Applicant. Staff recommends the submittal of the application for the former\nFairgrounds site in conjunction with Habitat LA, a member of the development team\nselected to develop the site in a recent competitive Request for Proposals. Habitat would\nserve as Co-Applicant.

Private property\nlandscaping should be maintained so as not to constitute a hazard to pedestrian use of\nstreets and sidewalks, or interfere with the safe travel of vehicular traffic.
