Notice of Completion for the New Dutch Haven Neighborhood Street\nRehabilitation Project (CIP 22/23-02) (Development Services)\nThe City of Los Alamitos hired a roadway contractor for street\nimprovements related to grind and overlay and slurry seal in the New\nDutch Haven Neighborhood as part of the City’s ongoing pavement\nmanagement program.\nStaff is recommending that City Council accept the work as completed,\ndirect filing of the Notice of Completion, and authorize retention release as\nprescribed by the Public Contract Code.\nRecommendation:\n1. Accept as complete the construction by Hardy and Harper, Inc. for the\nNew Dutch Haven Neighborhood Street Rehabilitation Project (CIP No.\n22/23-02); and,\n2. Direct the City Clerk to record the Notice of Completion/Final Report\nwith the County Recorder’s Office; and,\n3. Authorize Staff to release the 5% retention to the contractor, in the\namount of $13,636.60, thirty-five (35) days after recordation of the\nNotice of Completion.

H. Notice of Completion for the Briggeman Drive Street Improvements\nProject (CIP 22/23-03) (Development Services)\nThe City of Los Alamitos hired a roadway contractor, United Paving Co.,\nfor the Briggeman Drive Street Improvements Project (CIP 22/23-03) as\npart of the City’s ongoing pavement management program. The project\nprovided 5 feet of widening along the southern portion of Briggeman Drive,\nfrom the Briggeman Drive/Reagan Street intersection to 200 feet west of\nthe intersection. This project was necessary to continue the widening that\npreviously occurred adjacent to the newly developed hotel (Fairfield Inn &\nSuites by Marriott Anaheim/Los Alamitos) at 10650 Los Alamitos\nBoulevard.\nStaff is recommending that City Council accept the work as completed,\ndirect filing of the Notice of Completion, and authorize retention release as\nprescribed by the Public Contract Code.\nRecommendation:\n1. Accept as complete the construction by United Paving Co. for the\nBriggeman Drive Street Improvements Project (CIP 22/23-03); and,\n2. Direct the City Clerk to record the Notice of Completion/Final Report\nwith the County Recorder’s Office; and,\n3. Authorize Staff to release the 5% retention to the contractor, in the\namount of $7,517.87, thirty-five (35) days after recordation of the\nNotice of Completion.

A. Study Session and Resolution No. 2023-20 – Overruling the Orange\nCounty Airport Land Use Commission’s Inconsistency Determination\nfor the City’s 6th Cycle Housing Element (Development Services)\nOn January 19, 2023, the Orange County Airport Land Use Commission\n(ALUC) found the City's 6th Cycle (2021-2029) Housing Element Update to\nbe inconsistent with the 2017 Joint Forces Training Base Los Alamitos\nAirport Environs Land Use Plan. On February 21, 2023, the City Council\nadopted Resolution 2023-04, providing notice of the City's intent to overrule\nthe ALUC's determination. On July 17, 2023, the City Council conducted a\nStudy Session and reviewed information related to ALUC's finding of\ninconsistency. Following a staff presentation and receipt of public\ntestimony, the City Council continued the public hearing to tonight's regular\nmeeting. The City Council will now consider adoption of a resolution\noverruling the ALUC's determination, which requires a four-fifths affirmative\nvote.\nRecommendation:\n1. Conduct a Study Session; and,\n2. Conduct the Public Hearing; and,\n3. By a four-fifths affirmative vote, adopt Resolution No. 2023-20, entitled,\n"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOS\nALAMITOS, CALIFORNIA, MAKING FINDINGS THAT THE GENERAL\nPLAN 2021-2029 HOUSING ELEMENT UPDATE IS CONSISTENT\nWITH THE PURPOSES OF THE STATE AERONAUTICS ACT AND\nOVERRULING THE ORANGE COUNTY AIRPORT LAND USE\nCOMMISSION'S DETERMINATION THAT THE HOUSING ELEMENT IS\nINCONSISTENT WITH THE 2017 JOINT FORCES TRAINING BASE\nLOS ALAMITOS AIRPORT ENVIRONS LAND USE PLAN"; and,\n4. Authorize the City Manager to submit Resolution No. 2023-20 to the\nOrange County Airport Land Use Commission and the State Division of\nAeronautics.
