CU-89-004 (AS AMENDED AND\nMODIFIED) HELD BY ATLANTIC SQUARE, LLC (CONTINUED FROM NOVEMBER 1, 2023)\nIt is recommended that the City Council consider:\n(1) Adopting a Resolution authorizing the Mayor and City Clerk to issue legislative subpoenas\nfor testimony and records related to the potential revocation of CUP No. CU-89-004 (as\namended) that was originally approved via Resolution No. 9356, adopted August 29, 1989\n(and subsequently modified/amended); and\n(2) Taking such additional, related, action that may be desirable.

SR-710 NORTH MOBILITY IMPROVEMENTS PROJECT UPDATE AND FUNDING\nAGREEMENT\nIt is recommended that the City Council consider:\n(1) Authorizing the City Manager to execute a funding agreement with Los Angeles County\nMetropolitan Transportation Authority (“LACMTA”), on a form approved by the City\nAttorney, for the Garvey Avenue Capacity Improvements totaling $18,202,000;\n(2) Authorizing the City Manager to appropriate project funds for the Garvey Avenue Capacity\nImprovements project per the project funding schedule included in the terms and\nconditions of the funding agreement;\n(3) Adopting a Resolution to add the Garvey Avenue Capacity Improvement and Parking\nStructure projects to the fiscal year 2023-2024 Capital Improvement Program (“CIP”);\n(4) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act)\nThe City reviewed the environmental impacts of the Project under the California Environmental\nQuality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated\nthereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guidelines\n§§ 15060(c)(2), 15061(b)(3), and 15378 exempt activities that will not result in a direct or\nreasonably foreseeable indirect physical change in the environment, activities where there is\npossibility that it may have a significant effect on the environment, and activities that do not\nconstitute a “project” as defined, respectively. This activity is primarily a legislative tool to assess\nlegislative and budgetary priorities and does not approve any of the specific projects for\nconstruction, and therefore does not have the potential to have a significant effect on the\nenvironment. Accordingly, no further review is required.

RECEIVE AND FILE EFFECTIVE DATE FOR THE INCREASE IN WATER RATES AND\nCHARGES\nIt is recommended that the City Council consider:\n(1) Receiving and filing effective date for the increase in water rates and charges;\n(2) Direct the City Manager to postpone implementing the approved rates until after the City\nCouncil considers issuing bonds for infrastructure financing (in February 2024); and\n(3) Taking such additional, related, action that may be desirable.

CONSIDERATION AND POSSIBLE ACTION TO ADOPT A RESOLUTION TO RECORD A\nNOTICE OF NUISANCE ABATEMENT LIEN AGAINST CERTAIN REAL PROPERTY IN THE\nCITY (APN 5254-002-031)\nIt is recommended that the City Council consider:\n(1) Adopt a resolution to record a Notice of Nuisance Abatement Lien; and/or\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nAdoption of the Resolution is exempt from the California Environmental Quality Act (“CEQA”)\nunder CEQA Guidelines § 15061(b)(3) because it can be seen with certainty that there is no\npossibility that the action proposed by the proposed resolution would have a significant effect on\nthe environment.

3-H. PREFERENTIAL PARKING DISTRICT: E. HELLMAN AVENUE FROM N. ALHAMBRA\nAVENUE TO N. NICHOLSON AVENUE.\nIt is recommended that the City Council consider:\n(1) Adopting a Resolution designating E. Hellman Avenue from N. Alhambra Avenue to N.\nNicholson Avenue among the preferential parking districts; and\n(2) Taking such additional, related, action that may be desirable.\nCEQA (California Environmental Quality Act):\nThe City reviewed the environmental impacts of the proposed Ordinance pursuant to the\nCalifornia Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and\nthe regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA\nGuidelines”). CEQA Guideline § 15303 exempts activity that results in new construction or\nconversion of small structures. The Resolution creates a preferential parking district governing\nparking within a designated area and which requires installation of pedestrian level street\nsignage. Accordingly, the Resolution is exempt from further review.

CONSIDERATION AND POSSIBLE ACTION TO AUTHORIZE THE MAYOR TO EXECUTE A\nTHREE-YEAR EMPLOYMENT AGREEMENT (WITH ONE-YEAR EXTENSION) WITH MS.\nINEZ ALVAREZ, IN A FORM APPROVED BY THE CITY ATTORNEY, FOR CITY MANAGER\nSERVICES. FISCAL IMPACTS INCLUDE, WITHOUT LIMITATION, A (1) BASE\nCOMPENSATION FOR A TOTAL OF $265,000 BEGINNING NOVEMBER 15, 2023; (2)\nVEHICLE ALLOWANCE OF $600 PER MONTH; AND (3) MEDICAL, DISABILITY, AND\nOTHER FRINGE BENEFITS INCLUDING, WITHOUT LIMITATION, CALPERS RETIREMENT\nBENEFITS SUBSTANTIALLY THE SAME AS OTHER DEPARTMENT DIRECTORS. THE\nTOTAL COMPENSATION PACKAGE IS APPROXIMATELY $325,278 FOR THE FIRST\nYEAR. AN INCREASE IN BASE SALARY TO MEDIAN SALARY (OF SIMILARLY SIZED\nCITIES) MAY OCCUR ON JANUARY 1, 2025 WITH A CORRESPONDING INCREASE IN\nTOTAL COMPENSATION.\nIt is recommended that the City Council consider:\n(1) Authorize the Mayor to execute an Agreement with Ms. Inez Alvarez, in a form approved\nby the City Attorney; and\n(2) Taking such additional, related, action that may be desirable.
