I.17 SECOND AMENDMENT TO TELECOMMUNICATIONS LICENSE AGREEMENT –\nWESTON PARK (REPORT OF: PARKS AND COMMUNITY SERVICES)\nSecond Amendment to Telecommunications License Agreement – Weston Park (Site\nID #RS0029-01) with NCWPCS MLP 35 – Year Sites Tower Holdings, LLC\nRecommendation(s)\nThat the City Council and CSD:\n1. Authorize the City Manager/Executive Director of the Moreno Valley CSD to\nexecute a Second (2nd) Amendment to the Telecommunications Lease Agreement\nwith Licensee, NCWPCS MLP 35- YEAR SITES TOWER HOLDINGS, LLC, a\nDelaware limited liability company, by and through its Attorney In Fact, CCATT LLC,\n7\na Delaware limited liability company, to extend the renewal terms with the Licensee,\nfor an additional eight (8) five-year (5-year) terms at the beginning rates of $4,526.76\nper month for rent and $160.47 per month for graffiti removal and landscape\nmaintenance fee, each to be adjusted annually by CPI or 3%, whichever is greater,\nper the terms of the 2nd Amendment; and,\n2. Authorize the expansion of the Telecommunications Licensed Area, ground space\nor Premises, located at 13156 Lasselle Street, Moreno Valley, CA 92553, known as\nWeston Park, by 430 square feet of contiguous land space as more specifically\nidentified on the Site Plan, per the terms of the 2nd Amendment, identified as Second\nAdditional License Area; and,\n3. Allow Licensee to sublicense to Sublicensee, T-Mobile or an affiliate or subsidiary\n("TMO Sublicensee"), a portion of the Premises, as expanded to TMO Sublicensee\nfor the installation/maintenance/operation of a wireless communications facility\nthereon in return for a separate revenue share of rents for Sublicensee at a rate of\nfifty percent (50%) of the rents collected by Licensee from Sublicensee, payable to\nthe Licensor (City) for rent associated with Sublicensee's use of the\nTelecommunications Cell Site Premises or Premises, as expanded, at 13156\nLasselle Street, Moreno Valley, CA 92553, known as Weston Park. Licensee to\ninform Licensor of Sublicensee Agreement/Arrangement, including rental amounts\nand terms at least annually upon such subleasing agreement/arrangement; and\n4. Authorize the City Manager/Executive Director of the Moreno Valley CSD and/or\ntheir designee to submit necessary budget adjustments as applicable.

Legacy Construction, Inc. for the\nconstruction of the Moreno Valley Pump Track Site Improvements Project No. 807\n0058; and\n2. Authorize the Executive Director or its designee to execute a contract with C.S.\nLegacy Construction, Inc. in the amount of $5,761,475.40 funded by PCS Capital\nProjects Park Improvements (3015); and\n3. Authorize the issuance of a Purchase Order to C.S. Authorize the City Manager to execute a contract with Global Diversified Voltage\nfor the amount of $1,388,675, funded by MVU restricted funds balance (Fund 6011).\n3. Approve a Professional Consultant Services Agreement with CWE for preliminary\nengineering, design, and construction support for the Moreno Master Drainage Plan\n(Line K and Reche Canyon Debris Basin Project; and\n2. Authorize the City Manager to execute any subsequent amendments to the\nAgreement for Professional Consultant Services with CWE, within the City Council\napproved annual budgeted amounts, including the authority to authorize the\nassociated purchase orders in accordance with the terms of the Agreement, subject\nto the approval of the City Attorney; and\n7. Award a construction contract to Elecnor Belco Electric, Inc. for the Redlands\nBoulevard Streetlight Improvements Project located between Grelck Drive to the\nNorth City Limits; and\n2. Authorize the City Manager to execute a contract with Elecnor Belco Electric, Inc.,\nin the amount of $220,783 funded by the DIF Arterial Streets Capital Projects Fund\n(Fund 3301); and\n10\n3. After City Attorney publicly describes the recommended Compensation and\nBenefits to be included in the Employment Agreement for the Manager of the Office\nof the Mayor & City Council/City Clerk, the City Attorney recommends that a Motion\nto Approve be made and Seconded, and that the City Council and its Affiliated\nBoards vote to approve said Compensation and Benefits and direct the City Attorney\nto finalize the subject Employment Agreement which shall be subject to public review\nand inspection upon request.
