d) CONSIDERATION OF RESOLUTION 23-36, ESTABLISHING THE ANNUAL SPECIAL\nTAXES FOR COMMUNITY FACILITIES DISTRICT NO. 1 AND ANNUAL\nASSESSMENTS FOR EAST BONITA AVENUE SEWER IMPROVEMENT AND EAST\nMIRA MONTE AVENUE SEWER IMPROVEMENT AND LEVYING OF SPECIAL\nTAXES AND ASSESSMENTS FOR THE FISCAL YEAR 2023-2024\nIt is recommended that the City Council approve Resolution 23-36, establishing the\nFiscal Year 2023-2024 special taxes for Community Facilities District No. 1 and annual\nassessments for East Bonita Avenue Sewer Improvement and Mira Monte Avenue\nSewer Improvement and orders levy of special taxes and assessments for the Fiscal\nYear commencing July 1, 2023, and ending June 30, 2024.

e) COST SHARING AGREEMENT FOR THE MAY 9, 2023 SIERRA MADRE SPECIAL\nMUNICIPAL ELECTION\nIt is recommended the City Council approve the May 9, 2023, Sierra Madre Special\nMunicipal Election Cost Sharing Agreement between the City of Sierra Madre and NUWI-\nSierra Madre LLC (NUWI) in the amount of $100,000. In addition, NUWI agrees to pay\nadditional costs should the special election final invoice exceed $325, 000.\nPUBLIC HEARING

The council requests that\nparticipants refrain from making personal, slanderous, profane, or disruptive remarks. A person who\ncontinues to disrupt the orderly conduct of the meeting after being warned by the Mayor or designee to\ncease the disruption may be precluded from further participation in the meeting. CONSIDERATION OF RESOLUTION 23-40, APPROVING GENERAL PLAN\nAMENDMENT 23-01 TO INCLUDE A LINK TO THE LOCAL HAZARD MITIGATION\nPLAN IN THE SAFETY ELEMENT\nIt is recommended that the City Council hold a public hearing to consider Resolution 23-\n40, approving the General Plan Amendment 23-01 (GPA 23-01), and update the Safety\nElement of the General Plan to include a link to the Local Hazard Mitigation Plan (LHMP)\nin the Safety Element.\nCEQA FINDINGS\nThis action is not a project for purposes of 15 CCR 15378(b)(5) in that It is an\nadministrative activity that will not result in direct or indirect physical changes in the\nenvironment.

CONSIDERATION OF RESOLUTION 23-31, CONDITIONALLY APPROVING A\nTENTATIVE PARCEL MAP 22-01 (TPM 22-01); A REQUEST TO SUBDIVIDE THE\nPROPERTY FOR A CONDOMINIUM PROJECT LOCATED AT 182 WEST\nHIGHLAND AVENUE\nIt is recommended that the City Council hold a public hearing to consider all pertinent\ntestimony and consider approval of the application for Tentative Parcel Map 22-01\n(TPM 22-01) by adopting City Council Resolution 23-31.\nCEQA FINDINGS\nThe project qualifies for a Class 15 (Minor Land Division) and Class 3 (New\nConstruction or Conversion of Small Structures) Categorical Exemption under Section\n15315 and 15303 of Article 19 Categorical Exemptions of the California Environmental\nQuality Act (CEQA) as the project constitutes (i) division of the land of four or less\nparcels, is in conformance with the Sierra Madre General Plan and zoning\nrequirements, does not require variances or exceptions, maintains accessibility and\navailability of services, is not part of a larger parcel division undertaken within two years\nprior the date of application, and does not have an average slope greater than twenty\npercent; and (ii) new construction of multifamily residential structures totaling no more\nthan six dwelling units within an urbanized area.

CONSIDERATION OF RESOLUTION 23-34, DESIGNATING THE OSGOOD HOUSE\nAS A HISTORIC CULTURAL LANDMARK, TO BE INCLUDED IN THE SIERRA\nMADRE REGISTER OF DESIGNATED HISTORIC LANDMARKS FOR THE\nPROPERTY LOCATED AT 615, 617, AND 619 WEST MONTECITO AVENUE; AND\nCONSIDERATION OF RESOLUTION 23-35, APPROVING A MILLS ACT CONTRACT\nFOR THE RESTORATION AND REHABILITATION OF THE OSGOOD HOUSE\nLOCATED AT 615, 617, AND 619 WEST MONTECITO AVENUE\nIt is recommended that the City Council hold a public hearing to consider all pertinent\ntestimony, and approve the designation for historic cultural landmark status of the\nOsgood House, an existing multifamily residential property located at 615, 617, and 619\nWest Montecito Avenue, by adopting City Council Resolution 23-34 and consider the\napproval of a Mills Act Contract for the Restoration and Rehabilitation of the Osgood\nHouse by adopting City Council Resolution 23-35.\nCEQA FINDINGS\nThe proposed requests for rehabilitation and restoration are in conformance with the\nSecretary of the Interior’s Standards for Treatment of Historic Properties. As such, the\nproposed work is categorically exempt from further review under the California\nEnvironmental Quality Act (CEQA Guidelines Section 15331). This section exempts\nprojects that are limited to the maintenance, repair, stabilization, rehabilitation,\nrestoration, preservation, conservation, or reconstruction of historical resources in a\nmanner consistent with the Secretary of the Interior’s Standards. Furthermore, the\nproposed requests are further exempt from CEQA review pursuant to Section 15301 as\nit involves no expansion of the existing use.\nDISCUSSION
