7.d. CONSIDERATION AND APPROVAL OF RESOLUTION NO. 25-002,\nAPPROVING FIRST AMENDMENT TO THE CONTRACT SERVICES\nAGREEMENT WITH WEST & ASSOCIATES ENGINEERING, INC. TO\nPROVIDE CONSTRUCTION PHASE SUPPORT SERVICES FOR SAFE\nROUTES TO SCHOOL PEDESTRIAN SAFETY PROJECT, ATP CYCLE\n5, ATPL-5352(023)\nOn November 12, 2024, the City Council awarded a construction contract\nto Toro Enterprises in the amount of $1,794,169.80, and the construction\nwork is scheduled to start in January 2025. The project involves\ninstallation of pedestrian safety upgrades at signalized intersections and\nuncontrolled crosswalks including RRFBs, pedestrian push buttons,\ncountdown systems, overhead pedestrian signal systems, speed radar\nfeedback signs, pedestrian ramps, signage, crosswalks and striping\naround schools and major destinations. The project plans, specifications\nand estimates were prepared by West & Associates Engineering, Inc. Staff\nseeks City Council approval of a First Amendment to the Contract\nServices Agreement with West & Associates Engineering, Inc. to provide\nconstruction phase support services during construction.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Adopt Resolution No. 25-002, approving First Amendment to the\nContract Services Agreement with West & Associates Engineering,\nInc. to provide Construction Phase Support Services for Safe\nRoutes To School Pedestrian Safety Project in the amount of\n$15,000;\n2. Appropriate $15,000 of Measure M Local funds to the project for the\nproposed additional services; and\n3. Authorize City Manager or designee to negotiate and execute the\nagreement.

CONSIDERATION AND APPROVAL OF RESOLUTION NO. 25-003,\nAPPROVING AMENDMENT NO. 2 TO THE MEMORANDUM OF\nAGREEMENT (MOA) WITH THE SAN GABRIEL VALLEY COUNCIL OF\nGOVERNMENTS (SGVCOG) FOR THE FOOD RECOVERY PROGRAM\nOn June 13, 2023, the City Council approved a 2-year agreement with the\nSan Gabriel Valley Council of Governments (SGVCOG) to coordinate the\nimplementation of an edible food recovery recycling and enforcement\nprogram for designated food generators. This is the 2nd amendment to the\noriginal agreement\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Adopt Resolution No. 25-003 adding 2nd amend to the current\nagreement with the San Gabriel Valley Council of Governments to\ncontinue to implement an edible food recovery recycling and\nenforcement program for designated food generators; and\n2. Authorize City Manager or designee to negotiate and execute the\nagreement.

CONSIDERATION AND APPROVAL OF PROFESSIONAL SERVICES\nAGREEMENT FOR INTERIM CITY ATTORNEY SERVICES BETWEEN\nTHE CITY AND OLIVAREZ MADRUGA LAW ORGANIZATION, LLP\nStaff is seeking City Council approval of the Professional Services\nAgreement for Interim City Attorney Services.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Consider and approve the Professional Services Agreement for\nInterim City Attorney Services between the City of South El Monte\nand Olivarez Madruga Law Organization, LLP, to continue to\nprovide interim City Attorney Services to the City, City Council and\nits Boards and Commissions while the City recruits a new\npermanent City Attorney. Consideration and approval are in\naccordance with Government Code Sections 53262, 54953(c)(3)\nand 54956(b); and\n2. CONSIDERATION AND APPROVAL OF RESOLUTION NO. 25-004,\nADOPTING AN INJURY AND ILLNESS PREVENTION PROGRAM OR\nPLAN (“IIPP”)\nCalifornia Code of Regulations, Title 8, Chapter 4, Section 3203 of the\nGeneral Industry Safety Orders & Section 1509 of the Construction Safety\nOrders require the establishment of an Injury and Illness Prevention\nProgram (“IIPP” or “Plan”).\nRECOMMENDED ACTION: Staff recommends City Council consider\nadopting Resolution No. 25-004, adopting an Injury and Illness Prevention\nProgram or Plan ("IIPP").

9.h. CONSIDERATION AND APPROVAL OF RESOLUTION 25-005,\nADOPTING AND APPROVING THE WORKPLACE VIOLENCE\nPREVENTION POLICY\nSB 553 was enacted on September 30, 2023. The bill requires covered\nemployers to create, implement and maintain a Workplace Violence\nPrevention Plan(“WVPP” or “Plan”) by July 1, 2024. Staff is requesting the\nCity Council consider adopting a Workplace Violence Prevention Plan that\naddresses the hazards known to be associated with the four types of\nworkplace violence as defined by state law. The purpose of this Plan is to\nprovide guidelines for City employees to follow in preventing and reporting\nworkplace violence, as it is the City’s goal to maintain a violence-free\nworking environment. If this Workplace Violence Prevention Plan is\napproved by the City Council, City management will initiate and complete\nthe required meet and confer with both Bargaining Units within the City\nand will timely provide required training regarding the adopted Workplace\nViolence Prevention Plan.\nGENERAL BUSINESS (CONTINUED)\nItem 9.h.\nRECOMMENDED ACTION: Staff recommends City Council consider\nadopting Resolution No. 25-005, adopting and approving the Workplace\nViolence Prevention Policy.
