10.\nOFFICE LEASE AMENDMENT NO. 6 FOR 275 CENTENNIAL WAY\nRequest for authorization to enter into a Sixth Amendment to Lease with\nPK II LARWIN SQUARE SC LP ("Landlord"), extending the term to June\n30, 2031, at 275 Centennial Way to provide supplemental office space for\nCity staff.\nRecommendation: Approve and authorize the City Manager to execute the\nSixth Amendment to Lease with PK II LARWIN SQUARE SC LP, in the\nform attached hereto, subject to any nonsubstantive modifications as may\nbe recommended by the City Attorney. Fiscal Impact:The monthly rent will\nincrease by three percent from $4,502.89 to $4,638.00, with the new total\nannual rent being $55,656. Thereafter, the monthly rent will increase at a\nrate of three percent annually on July 1. The City will pay a fee of $10.00\nas consideration for the amendment. There is sufficient appropriation in\nthe 2026-27 Budget to support lease payments. Future annual lease\namounts will be incorporated in the budget for City Council's\nconsideration.

11.\nCITY COUNCIL LIAISONS TO TUSTIN UNIFIED SCHOOL DISTRICT\nThe Mayor appoints those members of the City Council who will represent\nthe City as liaisons or who will serve on various Regional committees and\nMayor-appointed Ad Hoc committees. The proposed City Councilmember\nliaison designees to Tustin Unified School District are the Mayor and\nMayor Pro.\nRecommendation: That the City Council designate the Mayor and Mayor\nPro Tem as the City's liaisons to the Tustin Unified School District. Fiscal\nImpact: There is no fiscal impact associated with this item.

12.\nADOPTION OF 2025 WATER SHORTAGE CONTINGENCY PLAN The\nCalifornia Urban Water Management Planning Act requires the City to\ndevelop and adopt a Water Shortage Contingency Plan as part of the\nUrban Water Management Plan update process. The plan establishes the\nCity’s response framework for water shortages and drought conditions,\ndemand reduction actions, water use restrictions, and operational\nresponses necessary to maintain water supply reliability.\nRecommendation: Recommend the City Council: 1. Conduct a public\nhearing for the 2025 Water Shortage Contingency Plan; and 2. Adopt\nResolution No. 26-33 approving the City's 2025 Water Shortage\nContingency Plan. 3.\nRATIFICATION OF PAYROLL AND DEMANDS The City Council has\napproved the use of Government Code Section 37208 to expedite the\npayment of City of Tustin obligations that are in accordance with the\napproved budget or continued operations authorizations.\nRecommendation: It is recommended that the City Council approve\nPayroll in the amount of $1,208,554.39 and Demands in the amount of\n$2,366,321.70.

4.\nRESOLUTION PROCLAIMING THE TERMINATION OF THE LOCAL\nEMERGENCY RELATED TO THE NAVY NORTH HANGAR At its\nmeeting on November 10, 2023, the City Council ratified the Acting City\nManager’s Proclamation of Local Emergency related to the fire at the\nNavy’s North Hangar and release of chemicals of public health concern,\nincluding asbestos. The City Council has reviewed and determined the\nneed to continue the local emergency at least once every sixty (60) days\nsince the local emergency was proclaimed, as required by State law. On\nJune 9, 2026, the California Department of Toxic Substances Control\ndetermined that the City of Tustin’s remediation of the Navy North Hangar\nis now complete. In light of that determination, it is recommended that the\nCity Council proclaim the local emergency terminated.\nRecommendation: It is recommended that the City Council: 1. Adopt\nResolution 26-36 (Attachment 2) proclaiming the local emergency related\nto the Navy North Hangar Fire to be terminated; and 2. Receive and file\nthe June 3, 2026 North Hangar Post-Fire Action Summary Report\n(Attachment 3). RESOLUTION 26-36 A RESOLUTION OF THE CITY\nCOUNCIL OF THE CITY OF TUSTIN, CALIFORNIA PROCLAIMING THE\nLOCAL EMERGENCY RELATED TO THE NAVY NORTH HANGAR FIRE\nTO BE TERMINATED. 5.\nADOPT RESOLUTION NO. 26-35 APPROVING FISCAL YEAR 2026-\n2027 SENATE BILL 1 PROJECT LIST To be eligible to receive new\nfunding under Senate Bill 1, the City is required to submit a Project List to\nthe California Transportation Commission no later than July 1, 2026.\nRecommendation: Recommend the City Council: 1. Adopt Resolution No.\n26-35 identifying projects to be submitted to the California Transportation\nCommission for Senate Bill 1 funding; and 2. Direct staff to submit the\nProject List to the California Transportation Commission on behalf of the\nCity. RESOLUTION NO. 26-35 A RESOLUTION OF THE CITY COUNCIL\nOF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING A LIST OF\nPROJECTS FOR FISCAL YEAR 2026-27 FUNDED BY SB 1: THE ROAD\nREPAIR AND ACCOUNTABILITY ACT OF 2017 Fiscal Impact: Submittal\nof the Project List to the California Transportation Commission allows the\nCity to receive funding for maintenance, rehabilitation, and safety-related\nroadway projects. The City will receive an estimated $2,254,278 in Senate\nBill 1 funding for Fiscal Year 2026-2027. These restricted transportation\nfunds\nare\nprogrammed\ntoward\neligible\nroadway\nmaintenance,\nrehabilitation, and safety improvement projects included in the City's\nCapital Improvement Program.

6.\nAPPROVE THE ANNUAL MEASURE M2 ELIGIBILITY SUBMITTAL\nPACKAGE, FISCAL YEAR 2026-2027 To maintain eligibility to receive\nOrange County Measure M2 Program funding, the City is required to\nannually submit a compliance package to the Orange County\nTransportation Authority.\nRecommendation: Recommend the City Council take the following\nactions: 1. Adopt the attached Measure M2 Seven-Year Capital\nImprovement Program (Fiscal Year 2026-2027 through Fiscal Year 2032-\n2033, Attachment "B" of the M2 Eligibility Package); and 2. Approve\nResolution No. 26-37, informing the Orange County Transportation\nAuthority that the City updated a Local Signal Synchronization Plan that is\nin conformance with their format; and 3. Authorize the Director of Public\nWorks to submit the City of Tustin's Measure M2 eligibility package to the\nOrange County Transportation Authority. RESOLUTION NO. 26-37 A\nRESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,\nCALIFORNIA, CONCERNING THE UPDATE OF THE LOCAL SIGNAL\nSYNCHRONIZATION PLAN FOR THE MEASURE M (M2) PROGRAM\nFiscal Impact: The City has successfully secured Comprehensive\nTransportation Funding Program competitive funds under the current\nMeasure M2 Program and met required match funding contributions\ntowards various projects over the years. Since 2011, the City has received\napproximately $48M from Measure M2, including $24.6M in Local Fair\nShare funds. The City's annual local jurisdiction apportionment, known as\n"Local Fair Share" under Measure M2, is estimated at $2.15M for Fiscal\nYear 2026-2027.

7.\nDECLARE INTENT TO VACATE ENDERLE CENTER DRIVE AND SET A\nPUBLIC HEARING California Streets and Highways Code Section 8312\nauthorizes the City Council to vacate all or a portion of a street within the\nCity when it is no longer necessary for current or prospective public street\npurposes, either on its own initiative or upon request of an interested\nparty. A request was received from the owners of Enderle Family Trust\nEnderle Center to vacate Enderle Center Drive. Pursuant to procedures\noutlined in Sections 8320-8325 of the California Streets and Highways\nCode, the City Council must first adopt a resolution declaring its intent to\nvacate and set a public hearing. Resolution No. 26-30 includes an\nassociated map of the area to be vacated.\nRecommendation: It is recommended the City Council adopt Resolution\nNo. 26-30 declaring its intent to vacate Enderle Center Drive and set a\npublic hearing for September 15, 2026. RESOLUTION NO. 26-30 A\nRESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN\nDECLARING ITS INTENTION TO VACATE ENDERLE CENTER DRIVE\nFiscal Impact: Adoption of the Resolution of Intent to Vacate Enderle\nCenter Drive does not result in any immediate fiscal impact to the City.\nAny future fiscal impacts associated with the proposed vacation and\nredevelopment project will be evaluated as part of subsequent approvals\nand implementation activities.

8.\nAPPROVE AMENDMENT NO. 2 TO CONSULTANT SERVICES\nAGREEMENT WITH RIOS Staff recommends the City Council approve\nAmendment No. 2 to the Consultant Services Agreement with RIOS to\nprovide design modifications of the Legacy Park Phase 2 Project. The City\nhas explored design alternatives to reduce construction costs and\nrecommend authorizing the redesign, including the preparation of the final\nplans, specifications, and construction documents.\nRecommendation: It is recommended the City Council approve\nAmendment No. 2 to Consultant Services Agreement with RIOS to\nprovide design modifications of the Legacy Park Phase 2 Project, in an\namount not to exceed $382,410.00, and authorize the City Manager to\nexecute the Agreement on behalf of the City. Fiscal Impact: The proposed\nAmendment No. 2 to Consultant Services Agreement with RIOS includes\na not-to-exceed total compensation amount of $382,410.00. Sufficient\nfunds have been appropriated in the Fiscal Year 2025-2026 Capital\nImprovement Program Budget.

9.\nEXCLUSIVE NEGOTIATING AGREEMENT WITH TUSTIN LEGACY\nMIXED USE, LLC FOR AN APPROXIMATELY 52 ACRE SITE WITHIN\nTHE TUSTIN LEGACY SPECIFIC PLAN AREA Request for authorization\nto enter into an Exclusive Negotiating Agreement with Tustin Legacy\nMixed Use, LLC for the disposition and development of approximately 52\nacres of City-owned real property within the Tustin Legacy Specific Plan.\nThe staff supported recommendation is made by an Ad Hoc Committee\ncomposed of Councilmember Gallagher and Mayor Lumbard.\nRecommendation: Authorize the City Manager to execute the Exclusive\nNegotiating Agreement between the City and Tustin Legacy Mixed Use,\nLLC in the form attached hereto, subject to any nonsubstantive\nmodifications as may be recommended by the City's special real estate\ncounsel or the City Attorney. Fiscal Impact: Concurrent with the execution\nof the Exclusive Negotiating Agreement, Tustin Legacy Mixed Use, LLC\nwill submit a good faith deposit of $250,000 to be applied toward staff and\nthirdparty costs incurred by the City including the retention of legal\ncounsel associated with the negotiation. These costs are separate from\nentitlement expenses that will be borne by Tustin Legacy Mixed Use, LLC.
