3) CONSIDERATION OF CONSTRUCTION SERVICES AGREEMENT FOR CORTEZ SENIOR & COMMUNITY CENTER ROOF AND HVAC IMPROVEMENTS - PROJECT NO. 24009 It is recommended that the City Council take the following actions, contingent upon the City Council's approval of the amendments to the Program Year 2019 and Program Year 2023 Community Development Block Grant (CDBG) Action Plans and corresponding budget amendment: 1. Reject the bid submitted by MBC Enterprises, Inc. as non-responsive; 2. Award the Construction Services Agreement for the Cortez Park Senior & Community Center Roof and HVAC Improvements Project (Project No. 24009) to AC Pros, Inc. as the lowest responsible bidder; 3. Authorize the City Manager to negotiate and execute an agreement with AC Pros, Inc. for $1,395,000.00, in such final form as approved by the City Attorney; 4. Authorize the City Manager to negotiate and execute any amendments up to 10% of the awarded agreement amount; 5. Find that the project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15302 (Replacement or Reconstruction).
