11G. CONSIDERATION OF A RESOLUTION TO ACCEPT AND FILE A NOTICE OF COMPLETION FOR THE CONSTRUCTION CONTRACT WITH ALLIANCE DIVERSIFIED ENTERPRISES FOR THE MARQUITA SLOPE INTERIM RECONSTRUCT PROJECT NO. 21208 AND UNENCUMBER FUNDS Potential Action(s) If the City Council concurs with the contents of the Administrative Report, appropriate actions include adopting Resolution No. 26-117, which will: 1. Accept Marquita Slope Interim Reconstruct Project, CIP Project No. 21208, from the contractor, Alliance Diversified Enterprises, Inc. 2. Authorize the City Clerk to execute and record the Notice of Completion for the construction work related to the Marquita Slope Interim Reconstruct. 3. Approve and authorize the amount of $455,000 be unencumbered from project Account No. 054-476-45300-000-21208 to return to the Sewer Fund Depreciation Reserve, Account No. 054-476-45000. 4. Authorize the City Clerk to release the Payment Bond 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the contractor, Alliance Diversified Enterprises, Inc. 5. Authorize the City Clerk to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director/City Engineer in the amount of 25% of the total construction cost.
