This is an informational report only.

REQUEST FOR THE CITY COUNCIL TO CONSIDER THE PLACEMENT OF PERSIAN NEW\nYEAR (NOWRUZ) BANNERS IN BEVERLY HILLS.\nComment: The Beverly Hills City Council Liaison Rodeo Drive/Special Events/ Holiday Program\nCommittee, consisting of Mayor Bosse and Councilmember Friedman, recommends the City Council\napprove the request from the Farhang Foundation to allow the installation of street pole banners\ncommemorating the Persian New Year, also known as Nowruz (New Day), celebrated in March 2023.

AGREEMENT WITH HISTORIC RESOURCES GROUP, LLC TO PREPARE A HISTORIC\nRESOURCES SURVEY OF MULTI-FAMILY PROPERTIES IN THE CITY OF BEVERLY HILLS;\nAND\nAPPROVAL OF A PURCHASE ORDER TO HISTORIC RESOURCES GROUP, LLC FOR A TOTAL\nNOT-TO-EXCEED AMOUNT OF $125,400 FOR THE ABOVE SERVICES.\nComment: Staff recommends that the City Council approve an agreement with Historic Resources Group,\nLLC to prepare a comprehensive historic resources survey of multi-family properties in the City of Beverly\nHills. Staff is also recommending that City Council approve a purchase order for a total not-to-exceed\namount of $125,400 for the services to be provided.

CAMDEN DRIVE; AND\nAPPROVAL OF A CORRESPONDING PURCHASE ORDER IN THE NOT-TO-EXCEED AMOUNT\nOF $3,335,000; AND\nAPPROVAL OF PLANS THEREFOR WITH RESPECT TO DESIGN CRITERIA; AND\nFIND THE PROJECT EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\n(CEQA).\nComment: Staff recommends that City Council move to approve the award of a contract to the lowest\nresponsible bidder, Balfour Beatty Construction, LLC, Inc. for the Shell and Core Improvements Project at\n430 N. Camden Drive in the amount of $2,900,000; and approve a construction contingency in the\namount of $435,000 (15%); and approve the plans as detailed in the bid documents, which are adopted\nand approved with respect to design criteria; and approve a purchase order in the not-to-exceed amount\nof $3,335,000; and find the project exempt from the California Environmental Quality Act (CEQA)

3. AMENDING CHAPTER 5 AND CHAPTER 6 OF TITLE 4 OF THE BEVERLY HILLS MUNICIPAL\nCODE REGARDING EVICTIONS. (First Reading – for Introduction)\nComment: The City Council directed staff to return to the City Council with an ordinance reflecting the\ndirection of the City Council at its December 13, 2022 meeting. This Ordinance removes the provision\nfrom Chapter 5 (BHMC Section 4-5-512) and Chapter 6 (BHMC Section 4-6-6 K) that allows a landlord to\nevict a tenant for major remodeling. This Ordinance would prohibit a landlord from evicting a tenant for\nmajor remodeling.

AMENDING REGULATIONS IN THE BEVERLY HILLS MUNICIPAL CODE RELATED TO THE\nADJUSTMENT OF LOT LINES THAT WOULD CREATE OR EXPAND LOTS ACROSS THE\nJURISDICTIONAL BOUNDARIES OF THE CITY (Second Reading for Adoption); AND\nPURSUANT TO THE PROVISIONS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\n(CEQA), THE CITY COUNCIL WILL ALSO CONSIDER FINDING THE ORDINANCE EXEMPT\nFROM CEQA.\nComment: This ordinance was introduced on November 15, 2022, and is returning to the Council for\nsecond reading and adoption. This ordinance has previously been reviewed by the Planning Commission\nat their October 13th meeting, during which they adopted a resolution recommending the City Council\napprove the draft ordinance. By completing this process, the City Council will\nhave taken the necessary steps to ensure the continuation of City government operations in the event of\nan emergency or disaster.

APPROVING A PURCHASE AND SALE AGREEMENT AND JOINT ESCROW INSTRUCTIONS, IN\nSUBSTANTIVE FORM, BY AND BETWEEN THE CITY OF BEVERLY HILLS AND WILSHIRE\nCOMMERCIAL HOLDINGS, LLC CONCERNING REAL PROPERTY LOCATED AT 8401\nWILSHIRE BOULEVARD IN BEVERLY HILLS; AND\nAPPROVAL OF AN APPROPRIATION FROM THE GENERAL FUND (FUND 001) IN THE\nAMOUNT OF $7,995,000, WHICH INCLUDES $20,000 FOR ESCROW FEES AND DUE\nDILIGENCE ACTIVITIES.\nComment: Staff recommends City Council approve a resolution that (i) authorizes the City Manager to\nexecute a purchase and sale agreement for the City’s acquisition of 8401 Wilshire Boulevard in the\namount of $7,995,000 (ii) finds the acquisition advances the goals and objectives of the General Plan and\nis in conformance with the General Plan, and (iii) finds that the acquisition is exempt from the California\nEnvironmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State CEQA Guidelines\nregarding common sense exemptions. Staff also recommends City Council approve an appropriation in\nthe amount of $7,995,000, which consists of the purchase price plus $20,000 related to escrow fees and\ndue diligence activities.

MAKING EXPRESS FINDINGS AND DETERMINATIONS THAT MODIFICATIONS TO THE 2022\nCALIFORNIA BUILDING STANDARDS CODE ARE REASONABLY NECESSARY BECAUSE OF\nLOCAL CLIMATIC, GEOLOGICAL OR TOPOGRAPHICAL CONDITIONS.\nComment: Staff recommends that the Council repeal Resolution No. 22-R-13434 and adopt the updated\nResolution making express findings and determinations that modifications to the 2022 California building\nstandards code including appendices, are reasonably necessary because of local climatic, geological, or\ntopographical conditions, and instruct the City Building Official or his designee to file the most recent\nadopted Resolution of findings with the California Building Standards Commission (CBSC).\nAPPROVAL OF:
