EL CAMINO REAL (APN 057-192-04)\nStaff Recommendation\nReceive and file the Administrative Report dated September 2, 2025, and on\nfile with the City Clerk, which will:\n1. Acknowledge that the subject parcel is legally eligible for a range of public\nuses, including economic development, without the need for a new\neminent domain resolution.\n2. Allow staff to continue evaluating both traditional public service needs and\neconomic development opportunities for the site as part of the pending\nReal Estate Asset Management Plan, and return with feasibility analyses\nfor City Council consideration.

CONSIDERATION OF A RESOLUTION DECLARING AN EXEMPTION TO\nTHE FORMAL BIDDING PROCESS, APPROVING THE AGREEMENT FOR\nSHARING CONSULTANT COSTS FOR THE 2025 URBAN WATER\nMANAGEMENT PLAN (“AGREEMENT”) WITH THE MUNICIPAL WATER\nDISTRICT OF ORANGE COUNTY (MWDOC), AND FINDING THE PROJECT\nSTATUTORILY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL\nQUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-130, which will:\n1. Find the project statutorily exempt from the California Environmental\nQuality Act under Water Code Section 10652.\n2. Approve the Agreement for Sharing Consultant Costs for the 2025 Urban\nWater Management Plan with the Municipal Water District of Orange\nCounty.\n3. Approve, and authorize the City Manager to execute, Contract No. C2544, by and between the City of San Clemente and the Municipal Water\nDistrict of Orange County, for sharing consultant costs for the 2025 Urban\nWater Management Plan, in the amount of $71,030.

CONSIDERATION OF A RESOLUTION APPROVING A COOPERATIVE\nAGREEMENT WITH ORANGE COUNTY TRANSPORTATION AUTHORITY\n(OCTA) AND SOUTHERN CALIFORNIA REGIONAL RAIL AUTHORITY\n(SCRRA) FOR PEDESTRIAN AUDIBLE WARNING SYSTEM (PAWS) FOR\nCOST SHARING AND CONSTRUCTION\nStaff Recommendation\nAdopt Resolution No. 25-131, which will approve, and authorize the City\nManager to execute, Contract No. C25-45, Cooperative Agreement No.\nC-5-4115, by and between the City of San Clemente and the Orange County\nTransportation Authority and Southern California Regional Rail Authority, for\nthe Pedestrian Audible Warning System Rehabilitation, for a total City\ncontribution of $406,000 ($250,000 for design and $156,000 which is 12% of\nthe total construction cost; estimated at $1,300,000.)

11F.\nCONSIDERATION OF A RESOLUTION TO ACCEPT AND FILE A NOTICE OF\nCOMPLETION FOR THE FY 2025 ARTERIAL AND LOCAL STREET\nIMPROVEMENT PROGRAM, CIP PROJECT NOS. 15317 AND 15322\nStaff Recommendation\nAdopt Resolution No. 25-133, which will:\n1. Accept the FY 2025 Arterial and Local Street Improvement Program, CIP\nProject Nos. 15317 and 15322, from the contractor, ONYX Paving\nCompany, Inc.\n2. Authorize the City Clerk to execute and record the Notice of Completion\nfor the FY 2025 Arterial and Local Street Improvement Program, CIP\nProject Nos. 15317 and 15322.\n3. Authorize the City Clerk to release the payment bond 35 days from the\nrecordation of the Notice of Completion upon verification with the\nEngineering Division that no liens have been levied against the contractor,\nONYX Paving Company, Inc.\n4. Authorize the City Clerk to release the performance bond for this project\nupon receipt of a warranty bond in a form acceptable to the Public Works\nDirector/City Engineer in the amount of 25% of the total construction cost.

CONSIDERATION OF A RESOLUTION AWARDING AND APPROVING A\nSOLE SOURCE PURCHASE OF ELECTRONIC COMPONENTS IN ORDER\nTO RESTORE AND UPGRADE FUNCTIONALITY FOR THE MARBLEHEAD\nCOASTAL URBAN RUNOFF AND STORMWATER SYSTEMS FROM\nONESOURCE DISTRIBUTORS CIP PROJECT NO. 14080, AND FINDING THE\nPROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-134 which will:\n1. Approve the expenditure for Allen Bradley electronic components for\nFiscal Year 2025-26 in an amount not to exceed $289,174.\n2. Approve the sole source purchase of the Allen Bradley electronic\ncomponents and installation materials from OneSource Distributors\nbased on the fixed price quote, which is provided as attachment 2 of the\nAdministrative Report, dated September 2, 2025.\n3. Find the project categorically exempt from the California Environmental\nQuality Act (CEQA) under Class 2 (Replacement or Reconstruction, 14\nCCR Section 15302) of the State CEQA Guidelines.

CONSIDERATION OF A RESOLUTION APPROVING AN AGREEMENT FOR\nRIGHT OF ENTRY CONSTRUCTION LICENSE AND FOR THE MARQUITA\nSLOPE RECONSTRUCTION WORK AND AUTHORIZING THE CITY\nMANAGER TO EXECUTE THE AGREEMENT\nStaff Recommendation\nStaff recommends that the City Council adopt Resolution No. 25-135, which\nwill approve, and authorize the City Manager to execute, Contract No.\nC25-46, Right of Entry Construction License and Agreement, by and between\nthe City of San Clemente and Marquita, LLC., Marquita Limited Homeowners'\nAssociation, and Sea Bluff Homeowner Association, for the Marquita Slope\nReconstruction Work.

8A.\nPUBLIC HEARING ON THE CITY OF SAN CLEMENTE’S 2025 REPORT ON\nPUBLIC HEALTH GOALS (PHG’S) TO RECEIVE ORAL AND WRITTEN\nCOMMENTS FROM THE PUBLIC, ACCEPT AND FILE THE REPORT, AND\nFINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT\nPublic Hearing as required by California Health and Safety Code, Section\n116470(b), stating every three years the City of San Clemente must prepare\na report comparing the City’s drinking water quality with Public Health Goals\n(PHGs) adopted by California Environmental Protection Agency’s Office of\nEnvironmental Health Hazard Assessment (OEHHA) and/or with maximum\ncontaminant level goals (MCLGs) adopted by the USEPA.\nStaff Recommendation\n1. Open the public hearing, receive public comment and close the public\nhearing.\n2. After conducting the public hearing, adopt Resolution No. 25-128, which\nwill:\na. Accept and file the City of San Clemente’s 2025 report on public health\ngoals (PHG’s).\nb. Find the project categorically exempt from the California Environmental\nQuality Act (CEQA) under Sections 15301, 15308, and 15309 of the\nCEQA guidelines (14 CCR § 15301(h), class 1: existing facilities, 15308,\nclass 8: actions by regulatory agencies for protection of the environment,\nand 15309, class 9: inspections).

9A.\nCONSIDERATION OF A RESOLUTION IDENTIFYING THE CITY COUNCIL AS\nTHE REVIEW AUTHORITY FOR THE AMERICAN TOWER MANAGEMENT,\nLLC, CELL TOWER REPLACEMENT PROJECT, PUBLIC HEARING\nPROJECT (PHP) 25-361\nStaff Recommendation\nStaff recommends that the City Council adopt Resolution 25-129 to designate\nthe City Council as the Review Authority for application PHP 25-361, a\nrequest by American Tower Management, LLC to amend County of Orange\nConditional Permit (CP-1021), a cell tower replacement project, Public\nHearing Project (PHP) 25-361.
