CASH AND INVESTMENT REPORT – OCTOBER 2023\nIn accordance with the City of San Gabriel’s 2023-2024 Adopted Investment\nPolicy (Resolution No. 23-36) and California Government Code Section 53646,\nthe Finance Director is to render an investment report to the City Council, City\nTreasurer, City Manager, and the City Attorney. The Cash and Investment\nReport is presented to receive and file in accordance with the City’s adopted\n2023-2024 Investment Policy.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council receive and file the Cash and\nInvestment Report for October 2023.

DEVELOPMENT IMPACT FEE COMPLIANCE REPORT REQUIRED PURSUANT\nTO GOVERNMENT CODE SECTION 66006 FOR FY 2022-23\nPursuant to Government Code Section 66006, a local agency which levies a fee\nsubject to Government Code Section 66001 shall make available to the public\na report providing the information required by Government Code Section\n66006(b)(1) and shall review that information at the next public meeting not\nless than 15 days after the information has been made available to the public.\nThe report was publicly available on the City’s website beginning November 17,\n2023. There is no fiscal impact related to this item.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council receive and file the Annual\nDevelopment Impact Fee Compliance Report for FY 2022-23 in accordance with\nGovernment Code Section 66006.

ORDINANCE NO. 693: AMENDING CHAPTER 153 OF THE SAN GABRIEL\nMUNICIPAL CODE, VALLEY BOULEVARD SPECIFIC PLAN, AND MISSION\nDISTRICT SPECIFIC PLAN RELATING TO OBJECTIVE DESIGN STANDARDS\nFOR MULTI-FAMILY AND MIXED-USE PROJECTS (ZTA23-002) – SECOND\nREADING AND ADOPTION\nAdoption of Ordinance No. 693 would amend Title XV, Chapter 153 (Zoning\nCode) of the San Gabriel Municipal Code, Valley Boulevard Specific Plan, and\nMission District Specific Plan relating to objective Design Standards for Multi-\nFamily and Mixed-Use Projects. The Fiscal Year 2023-24 Adopted Budget\nincludes the cost for required legal publication (Account No. 121-702-00-65-\n000) and codification (Account No. 121-702-00-22-000) of the ordinance.\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\namendment would be exempt from the California Environmental Quality Act\nunder section 15061(b)(3) of the CEQA guidelines, under the commonsense\nexemption, because it can be seen with certainty that it would not have a\nsignificant effect on the environment and, thus, is not subject to CEQA review.\nRecommended Action:\nStaff recommends that the City Council waive reading and adopt Ordinance No.\n693 entitled, “An Ordinance of the City Council of the City of San Gabriel,\nCalifornia, Approving Planning Case No. ZTA23-002, Amending Title XV,\nChapter 153 (Zoning), Valley Boulevard Specific Plan, and Mission District\nSpecific Plan relating to Objective Design Standards for Multi-Family and\nMixed-Use Projects.”

ORDINANCE NO. 695: AMENDING CHAPTER 153 OF THE SAN GABRIEL\nMUNICIPAL CODE TO ADDRESS MIXED-USE STANDARDS IN THE C-1 AND\nC-3 ZONE DISTRICTS (ZTA 23-003) – SECOND READING AND ADOPTION\nAdoption of Ordinance No. 695 would amend Title XV, Chapter 153 (Zoning\nCode) of the San Gabriel Municipal Code (SGMC) relating to Mixed-Use\nStandards in the C-1 and C-3 Zone Districts\nCalifornia Environmental Quality Act (CEQA) Determination: The proposed\namendments were reviewed for compliance with the California Environmental\nQuality Act. An Initial Study/Negative Declaration was prepared for the 2021-\n2029 Housing Element, as required by the California Environmental Quality Act,\nPublic Resources Code Section 21000 et seq., the CEQA Guidelines, and the City\nof San Gabriel Local Guidelines for Implementing CEQA. The Initial\nStudy/Negative Declaration considered the policies and programs outlined in the\nHousing Element. The Housing element establishes objectives, policies, and\nprograms to assist the City in achieving state-mandated housing goals. No formal\nland use changes or physical development are proposed at this time and future\nland use and physical development would require separate environmental\nevaluation.\nRecommended Action:\nStaff recommends that the City Council waive reading and adopt Ordinance No.\n695 entitled, “An Ordinance of the City Council of the City of San Gabriel,\nCalifornia, Approving Planning Case No. ZTA23-003, Amending Title XV,\nChapter 153 (Zoning) relating to mixed-use standards in the C-1 and C-3 Zone\nDistricts.”

G. ORDINANCE NO. 698 EXTENDING EXISTING DEVELOPMENT AGREEMENT\nFOR PROJECT NO. PL-15-149, A PLANNED DEVELOPMENT AND\nDEVELOPMENT AGREEMENT, AND VESTING TENTATIVE PARCEL MAP NO.\n74993 FOR THE ELEGANCE AT SAN GABRIEL ASSISTED LIVING PROJECT\nAT 806-824 SOUTH GLADYS AVENUE VIA ADOPTION OF FIRST\nAMENDMENT TO THE DEVELOPMENT AGREEMENT – SECOND READING\nAND ADOPTION\nAdoption of Ordinance No. 698 would extend the term of the Development\nAgreement, Planned Development and Vesting Tentative Parcel Map for the\nElegance Project at 806-824 South Gladys Ave. There is no negative fiscal\nimpact as it relates to this request for extension. Should the extension not be\napproved, this project would most likely not move forward reducing the\npotential property tax revenue for the City.\nCalifornia Environmental Quality Act (CEQA) Determination: The Mitigated\nNegative Declaration adopted in conjunction with the Project remains valid and\nin effect and continues to be the proper and legal environmental document for\nthe Project.\nRecommended Action:\nStaff recommends that the City Council waive the second reading and adopt by\ntitle Ordinance No. 698 entitled, “An Ordinance of the City Council of the City\nof San Gabriel, California, Extending Existing Development Agreement for\nProject No. PL-15-149, a Planned Development and Development Agreement,\nand Vesting Tentative Parcel Map No. 74993 for the Elegance Assisted Living\nProject at 806-824 South Gladys Avenue via Adoption of First Amendment to\nthe Development Agreement.”

APPROVAL OF FINAL PARCEL MAP NO. 82763, A 2-UNIT CONDOMINIUM\nDEVELOPMENT PROJECT LOCATED AT 313 WEST NORWOOD PLACE\nThe development project located at 313 West Norwood Place is a 2-unit\ncondominium on a 10,018 square-foot-lot. Staff and RKA Consulting Group Inc.,\nthe City’s contract consultant for land surveying, have reviewed the Final Parcel\nMap and determined that it is in compliance with the State Subdivision Map\nAct, Conditions of Approval, and the City’s ordinances regarding subdivision.\nThere is no fiscal impact related to this item.\nCalifornia Environmental Quality Act (CEQA) Determination: The project has\nbeen reviewed for compliance with the California Environmental Quality Act\n(CEQA) and is exempt from CEQA based on Section 15332, Class 32 exemption\n(In-Fill-Development).\nRecommended Action:\nStaff recommends that the City Council approve Final Parcel Map No. 82763,\nauthorize its filing with the Los Angeles County Recorder and authorize the City\nManager to execute the Subdivision Agreement on behalf of the City.
