APPROVE THE ENGINEER’S REPORT FOR THE\nTUSTIN LANDSCAPE AND LIGHTING DISTRICT\nAND SET A PUBLIC HEARING TO CONSIDER\nLEVYING FISCAL YEAR 2024-2025\nASSESSMENTS At the February 6, 2024 meeting,\nthe City Council ordered the preparation of an\nEngineer’s Report for the Levy of Annual\nAssessments for the Tustin Landscape and Lighting\nDistrict. The Engineer’s Report is now complete and\nready for City Council approval. Additionally, it is\nrequested that the City Council declare its intention\nto levy annual assessments and set a public hearing\nfor June 4, 2024.\nRecommendation: It is recommended that the City\nCouncil:\n1. AN APPROPRIATION TO PURCHASE THE\nMODERATE INCOME AFFORDABLE HOUSING\nUNIT AT 133 LIBERTY STREET The Tustin Housing\nAuthority ("Authority") is seeking an appropriation to\npurchase the moderate income affordable housing\nunit at 133 Liberty Street under the terms of a\nSettlement Agreement with the homeowner.\nRecommendation: It is recommended that the City\nCouncil appropriate $466,651 from unappropriated\nreserves of the General Fund to purchase the\nmoderate income affordable housing unit at 133\nLiberty Street.\nAgenda Report

6. AGREEMENT FOR TRANSFER OF OWNERSHIP\nOF POLICE SERVICE DOG Officer Taylor Ryan\nrotated out of the Canine Program and into the\nPatrol Division as a Sergeant, effective March 25,\n2024. Police Service Dog (PSD) Ragnar will be\nretired from active service. Ragnar is a 5-year-old\nBelgian Malinois and has served as a Tustin Police\nCanine for five years. Based on the unique bond\nbetween canine and handler, Sergeant Taylor Ryan\nhas agreed to accept ownership of Ragnar. The\nAgreement for Transfer of Ownership of a Police\nService Canine has been reviewed and approved by\nthe City Attorney.\nRecommendation: Approve the Agreement for\nTransfer of Ownership for a Police Service Dog\nbetween the City of Tustin and Sergeant Taylor\nRyan so that Ragnar can live out the remainder of\nhis days with the Ryan family.\nAgenda Report

ADOPT RESOLUTION NO. 24-24 TO APPROVE\nTHE CITY OF TUSTIN VEHICLE MILES\nTRAVELED ANALYSIS GUIDELINES UNDER THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT\nSenate Bill 743 (SB 743) was passed in 2013\nestablishing new requirements under the California\nEnvironmental Quality Act (CEQA) which evaluates\nVehicle Miles Traveled (VMT) metrics in-lieu of\ncongestion or vehicle delay metrics previously used\nin determining a project’s potential transportation\nimpacts as it relates to CEQA. Although SB 743 was\npassed in 2013, public agencies were not required\nto start using VMT to measure traffic impacts until\nJuly 1, 2020. Similar to many neighboring agencies,\nand since July 2020, the City has used the\nguidelines and VMT metrics for CEQA as set forth\nby the California Office of Planning and Research\n(OPR) when analyzing projects within the City. To\nensure continuity within the City’s planning\nprocesses and ensure consistency within our local\ntraffic network, the City hired RK Engineering\nGroup, Inc. (RKE) to prepare the City of Tustin\nVehicle Miles Traveled Analysis Guidelines.\nRecommendation: It is recommended that the City\nCouncil adopt Resolution No. 24-24 certifying the\nVMT Analysis Guidelines in compliance with new\nCEQA requirements. JOHN WAYNE AIRPORT NOISE ABATEMENT\nQUARTERLY REPORT – Q3 & Q4, 2023 This\nagenda report transmits the John Wayne Airport\n(JWA) Noise Abatement Quarterly Report for the\nthird and fourth quarters of 2023. The City of Tustin\nis within the JWA’s “Noise Impact Area” since it has\nthe potential to be exposed to an average\nCommunity Noise Equivalent Level (CNEL) of more\nthan 65 decibels (dB). CNEL is a weighted average\nof noise levels over a 24-hour period, and is a\nmeasurement frequently used in regulating the\nimpacts of airport noise on the surrounding\ncommunity. The average noise level measured at\nTustin’s monitoring station (NMS 10N), which is\nlocated at Columbus Tustin Middle School on\nBeneta Way (Figure 1), remained below the City,\nCounty, and State maximum criteria of 65 dB CNEL\nduring the third and fourth quarter reporting periods.\nRecommendation: That the City Council receive and\nfile this report.\nAgenda Report
