Waive the sealed bid requirement of Council Policy 4.0 and approve Amendment No. 1 to\nMaster Agreement Purchase Order with CalAmp Wireless Networks Corporation, in an amount\nnot to exceed $37,316.04, for Automatic Vehicle Location solution services for a one year\nperiod (inclusive of eight months of completed service) beginning June 1, 2023 through May\n31, 2024, with four one-year optional renewals, subject to available budget appropriations; and\nauthorize the Purchasing Agent, or designee, to execute the amendment and all contractual\ndocuments, and exercise the renewal options.

Award the contract to the lowest responsible bidder, Onyx Paving Company, Inc., in the amount\nof $9,163,000, for the Sabina Neighborhood Improvements Phases 4 and 5 and the Sycamore\nStreet Rehabilitation Project; authorize the Director of Public Works to execute the contract,\nand related documents, and to take the necessary actions to implement and administer the\ncontract; determine that the Project is categorically exempt under the California Environmental\nQuality Act pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the California\nCode of Regulations; and authorize the Finance Director to execute the Escrow Agreement\npertaining to contract retentions.

Award the construction contract to the lowest responsible bidder, We R Builders, Inc., in the\namount of $354,800, for the Arterial Sidewalk Removal and Replacement at Various Locations\n– Cycle 2 - Phase 1 Project; authorize the Director of Public Works to execute the contract, and\nany documents, and to take the necessary actions to implement and administer the contract;\ndetermine the project is categorically exempt under the California Environmental Quality Act\npursuant to Class 1, Section 15301 (Existing Facilities) and Class 2, Section 15302\n(Replacement or Reconstruction) of Title 14 of the California Code of Regulations; and\nauthorize the Finance Director to execute the Escrow Agreement pertaining to contract\nretentions.

Waive the sealed bid requirement of Council Policy 4.0 and approve the Accela Subscription\nServices Agreement with Accela, Inc., in an amount not to exceed $284,520, for the upgrade of\nthe City’s permit tracking and land management system, and an amount not to exceed\n$4,350,000 which includes a 5% contingency for other fees, for the continued annual\nmaintenance, licensing and service costs required for the use of the software over a period of\nfive years; and authorize the Finance Director to execute the agreement and additional\nagreements, change orders, purchase orders and related documents as necessary for the\nimplementation of the upgrade.

Approve an agreement, in substantial form, with Raftelis Financial Consultants, Inc. dba\nRaftelis, in an amount not to exceed $185,000, to provide a strategic study for the Police\nDepartment; authorize the Chief of Police to execute and administer the agreement; and\nauthorize minimal changes that do not substantially modify the terms and conditions of the\nagreement, provided the changes are determined to be de minimis by the City Attorney’s\nOffice.

Waive Council Policy 4.1 and approve an agreement with Brian Leist, dba Kaiser Precision LLC,\nin an amount not to exceed $150,000, for specialty services to assist in the administration of\nthe Police Department’s firearms program, and authorize the Chief of Police, or designee, to\nadminister the agreement.

Waive Council Policy 4.1 and approve an agreement with Jeff Hemerson, dba J A Hemerson\nLLC, in an amount not to exceed $225,000 annually, to coordinate and manage police facility\ninfrastructure projects as directed, coordinate with Anaheim Police Department Information\nTechnology staff on projects within police facilities, and manage and maintain the department’s\n800 MHz radio systems for a one year term with four one-year optional renewals; and authorize\nthe Chief of Police to execute and administer the agreement and any renewal options.

Approve a Memorandum of Understanding, in substantial form, with the County of Orange for\nthe Cold Weather Emergency Shelter Program to receive $137,500 for the implementation of\nthe Cold and Inclement Weather Shelter Program effective February 1 to April 15, 2024; and\nauthorize the City Manager, or designee, to execute all agreements and documents related to\nthe implementation and administration of the program, and further authorize the modification of\nthe Fiscal Year 2023-2024 Housing and Community Development budget to reflect the use of\nthese funds.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY\nOF ANAHEIM authorizing the Director of Public Works or designee to submit an application to\nthe Orange County Transportation Authority for funding under the Project V Community-Based\nTransit/Circulators Program for the Anaheim Canyon Circulator Project and if awarded,\nauthorizing the acceptance of such grant(s) on behalf of the City and amending the budget\naccordingly and authorizing the Director of Public Works to enter into a subrecipient agreement\nwith a competitively procured vendor to implement and operate the service [includes\ndetermination that the services described in the application are exempt from California\nEnvironmental Quality Act (CEQA) Section 21080(b)(10) of the California Public Resources\nCode because these services involve passenger transportation service on existing streets, and\ntherefore the services described in the application are exempt from the requirement to prepare\nadditional environmental documentation].

Request by Project Applicants to continue the public hearing to the City Council meeting of\nMarch 26, 2024.\nDEVELOPMENT AGREEMENT NO. 99-01\nPREVIOUSLY APPROVED POINTE ANAHEIM INITIAL STUDY, MITIGATED DECLARATION,\nAND ADDENDA\nPROJECT LOCATION: The property is located at 321 West Katella Avenue and 300, 400,\nand 500 West Disney Way between Disney Way and Katella Avenue, approximately 700 feet\neast of Harbor Boulevard.\nREQUEST: Pursuant to Resolution No. 82R-565, governing the consideration of development\nagreements, the City Council will consider establishing a time schedule for GardenWalk Hotel I,\nLLC, GardenWalk Hotel II, LLC, and Westgate Resorts Anaheim, LLC to comply with the terms\nand conditions of Development Agreement No. 99-01.\nENVIRONMENTAL DETERMINATION: The City Council will consider whether to find and\ndetermine that the previously-approved Pointe Anaheim Initial Study and Mitigated Declaration\nand Addenda, serve as the appropriate environmental documentation for the request.

Accept additional funding administered through the State of California, in the approximate\namount of $350,000, related to the COVID-19 Pandemic Relief for Utility Water and\nWastewater customer arrearages for eligible past due residential and commercial water\naccounts between June 16, 2021 and December 31, 2022, or as modified by the State; and\nauthorize the Public Utilities General Manager, or designees, to make necessary adjustments\nto recover all applicable funds that comply with program guidelines, to apply bill credits to\nqualifying customer accounts, to execute related documents, and to take the necessary action\nto implement and administer the funds.
