A RESOLUTION OF THE CITY COUNCIL OF THE CITY\nOF ANAHEIM, CALIFORNIA, accepting the certification of the Orange County Registrar of Voters\nas to the verification of signatures of the initiative petition entitled “City of Anaheim For-Profit\nHospital Gross Receipts Tax Initiative.”\nUpon acceptance of the certification of the Orange County Registrar of Voters as to the\nverification of signatures of the initiative, and if the initiative is found sufficient, either:\ni) RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE\nCITY OF ANAHEIM, CALIFORNIA, calling and giving notice of a general municipal election\nto be held on Tuesday, November 5, 2024 and ordering the submission to the qualified\nelectors of the City of Anaheim an initiative measure imposing a general tax on each for-\nprofit general acute care hospital located in the City of Anaheim (“Hospital”) equivalent to\nthree (3) percent of the For-Profit Hospital’s Annual Gross Receipts; requesting that the\nOrange County Board of Supervisors direct the Orange County Registrar of Voters to render\nservices to the City relating to the conduct of the general municipal election; establishing the\ndeadlines for the filing of arguments and rebuttal arguments; and directing the City Attorney\nto prepare an impartial analysis.\na. DEVELOPMENT APPLICATION NO. 2020-00204\nADDENDUM TO FINAL ENVIRONMENTAL IMPACT REPORT (FEIR) NO. 331 AND\nMITIGATION MONITORING PROGRAM NO. 137 ADOPTED FOR FEIR NO. 331\nMITIGATION MONITORING PLAN NO. 389\nTENTATIVE PARCEL MAP NO. 2022-160\nCONDITIONAL USE PERMIT\nGENERAL PLAN LAND USE ELEMENT AMENDMENT\nAMENDMENT NO. 4 TO THE MOUNTAIN PARK SPECIFIC PLAN (SP NO. 90-4)\nZONING CODE AMENDMENT (CHAPTER 18.112) – SP NO. 90-4\nAPPLICANT/OWNER: Tim Deutsch, Orange County Cemetery District, 25751 Trabuco Road,\nLake Forest, CA 92630\nPROJECT LOCATION: The approximately 283-acre property is located southeast of the State\nRoute 91/Gypsum Canyon Road interchange, at the terminus of Santa Ana Canyon Road.\nREQUEST: The applicant requests approval of a Tentative Parcel Map and Conditional Use\nPermit to construct and operate a cemetery use. Parcel 1 and Parcel 2 would be approximately\n126 and 157 acres, respectively. Parcel 1 would be developed as a public cemetery to be\nowned/operated by the Orange County Cemetery District. Parcel 2 is being proposed as a\nVeterans Cemetery in collaboration between the applicant and the California Department of\nVeterans Affairs (CalVet). The request also includes amendments to the General Plan Land Use\nElement, Mountain Park Specific Plan No. 90-4, and Zoning Code.\nENVIRONMENTAL DETERMINATION: The City Council will determine whether the Addendum\nto the Previously-Certified Final Environmental Impact Report (FEIR) No. 331 and Mitigation\nMonitoring Program No. 137 (MMP 137) adopted for FEIR No. 331 and Mitigation Monitoring Plan\nNo. 389 (MMP 389), together are the appropriate environmental documentation for the proposed\nproject and adopt the Addendum and MMP 389 for the proposed project.\n5 July 23, 2024\nACTION TAKEN BY THE PLANNING COMMISSION:\nRecommended City Council approval of Development Application No. 2020-00204 and approved\nResolution Nos. Public hearing to consider a proposed vacation/abandonment of portions of excess street right-of-\nway lying west of Anaheim Boulevard and directly south of Midway Drive requested by developer,\nEncore Anaheim LLC, in order to clear title to construct the 156 single-family attached dwelling\nResidential Project.\nRESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY\nOF ANAHEIM vacating portions of excess street right of way lying west of Anaheim Boulevard\nand directly south of Midway Drive (Abandonment No. ABA 2019-00390).\nApprove the Purchase and Sale Agreement with Encore Anaheim LLC, in the purchase price of\n$1,600,000, for the sale of excess right-of-way from the City; authorize changes to the agreement\nthat do not substantially change the terms and conditions of the Agreement, so long as such\nchanges are determined to be de minimis by the City Attorney’s Office; authorize the Director of\nPublic Works Director to execute the Agreement and authorize the Mayor to sign the Quitclaim\nDeed; authorize and direct the Public Works Director or his designee to execute other documents\non behalf of the City, including escrow documents, as required to close escrow; and authorize the\nCity Clerk to deliver the Resolution and Quitclaim Deed to escrow for recordation in the Orange\nCounty Recorder’s Office.\nMOTION:

Award the construction contract to the lowest responsible bidder, AMPCO Contracting, in the\namount of $388,650 plus a 10% contingency, for the Kraemer Power Plant Demolition Project;\nauthorize the Director of Public Works to execute the contract and related documents and to take\nthe necessary actions to implement and administer the contract; determine that the project is\nexempt from the California Environmental Quality Act pursuant to Sections 15061(b)(3), 15301,\n15304 of Title 14 of the California Code of Regulations; and authorize the Finance Director to\nexecute the Escrow Agreement pertaining to contract retentions.

Approve the Services Agreement with Smart City Networks, Limited Partnership (SCN)\ndesignating SCN as the exclusive technology service provider throughout the Anaheim\nConvention Center for a base term of seven (7) years and at the end of the seventh year, the City\nand SCN by mutual consent, may renew for three (3) additional one-year terms; SCN submitted a\nfinancial proposal that commits to paying the City a license fee of 60% of gross revenues on\ntechnology services; 3% Technology Reserve Fund; and Capital Investment, in the amount of\n$2,150,000, consisting of network and infrastructure upgrades for enhanced technology services;\nand authorize the Executive Director of the Convention, Sports & Entertainment Department\nto execute this agreement and any other related documents, including all actions necessary\nto implement and administer the Agreement and execute any optional renewals.\n3 July 23, 2024

Waive Council Policy 4.1 and approve an agreement with Trauma Intervention Programs, Inc., in\na total contract amount not to exceed $220,962, to provide a range of emotional and practical\nsupport to victims of traumatic events and their families for a three year term commencing on July\n1, 2024, with two one-year optional renewals; and authorize the Fire Chief to execute and\nadminister the agreement.

Approve the Professional Services Agreement with Security Land & Right of Way Services, Inc.,\nin an amount not to exceed $200,000, for professional property management services to support\ncurrent and future economic development needs for a two year term with two two-year optional\nrenewals for a total contract amount not to exceed $600,000, and authorize the City Manager, or\ndesignee, to execute and administer the agreement.

Lincoln\nAvenue, in the amount of $3,915,000; approving an Agreement for Sale of Property and Joint\nEscrow Instructions by and between the City of Anaheim and Kali Investment, Inc., a California\nCorporation, substantially in the form submitted herewith for the purchase of the Kettle Motor\nHotel, in the amount of $3,915,000; authorize the Director of Housing and Community\nDevelopment, or her designee, to execute and administer the agreement on behalf of the City of\nAnaheim; and increase the FY 2024-2025 Housing and Community Development Department’s\nBudget by $3,915,000.

ORDINANCE NO. 6585 (ADOPTION) AN ORDINANCE OF THE CITY OF\nANAHEIM amending Section 18.54.035 of the Anaheim Municipal Code to require annual review\nof sex-oriented business employee identification cards and finding and determining that this\nordinance is exempt from the requirements to prepare additional environmental documentation\nper California Environmental Quality Act (CEQA) Guidelines, Section 15601(b)(3) because it will\nnot have a significant effect on the environment [Development Application No. 2024-00026,\nintroduced at the Council Meeting of July 16, 2024, Item No. 27].\nBUSINESS CALENDAR:
