Authorize Award of Contract to Contractor for Barnes Park Multi-Benefit Stormwater Capture\nProject: Sod Replacement & Soil Preparation (CIP No. 21-129 Phase C)\nIt is recommended that the City Council:\n1. Approve and award the construction contract for the Barnes Park Multi-Benefit Stormwater\nCapture Project: Sod Replacement and Soil Preparation (CIP No. 21-129 Phase C) to SGD\nEnterprises dba Four Seasons Landscaping in the amount of $150,450.00; and\n2. Approve a 13% construction contingency in the amount of $19,550.00 for the project; and\n3. Authorize the Mayor and City Clerk to execute the contract with SGD Enterprises dba Four\nSeasons Landscaping, subject to any revisions deemed necessary by the City Attorney; and\n4. 11. Approval of Revised Conceptual Design for the Teri G. Muse Family Service Center\nIt is recommended that the City Council:\n1. Approve the revised conceptual design for Teri G. Muse Family Service Center; and\n2. Provide direction on the preferred building design for the proposed project by selecting one of\nthe following options: Option A, B, or C; and\n3. Authorize the Director of Public Works to solicit and advertise for bids for professional\narchitectural and engineering design services necessary for the preparation of schematic design,\ndesign development, and final Plans, Specifications, and Estimates (PS&E) required for the\nbidding and construction phases of the project; and\n4. Authorize the Director of Public Works and Director of Recreation & Community Services to\nproceed with any supplementary documents required for the project; and\n5. Authorize the Director of Finance to make the appropriation and necessary budget adjustments.

Proposed Establishment of 45-Day Moratorium on the Approval, Establishment, or Operation of\nBattery Energy Storage Systems Facilities (Urgency Ordinance No. 1526)\nIt is recommended that the City Council waive the reading and adopt by title only by four-fifths vote\nthe urgency moratorium Ordinance No. 1526 entitled: “INTERIM URGENCY ORDINANCE OF\nTHE CITY COUNCIL OF THE CITY OF BALDWIN PARK ESTABLISHING A MORATORIUM\nON THE APPROVAL, ESTABLISHMENT, OR OPERATION OF BATTERY ENERGY STORAGE\nSYSTEMS FACILITIES TO CONSIDER ADOPTING REGULATIONS FOR BATTERY ENERGY\nSTORAGE SYSTEM FACILITIES PURSUANT TO GOVERNMENT CODE SECTION 65858.”

Claim Rejection\nIt is recommended that the City Council reject the following claim and direct staff to send the\nappropriate notice of rejection to claimant:\n• Lizeth Garduno The claimant alleges bodily injury.\n• Patricia Aguilar The claimant alleges property damage.\n• George Gutierrez The claimant alleges property damage.\n• Lisa Krueger The claimant alleges property damage.\n• Queenie Collins The claimant alleges bodily injury.\nThis government claim, and all government claims, should be considered as potential lawsuits in the\nfuture. Thus, it is requested that all City Staff, the Mayor and all Council Members refrain from\nmaking any statements, whether public or private in nature. It is important that no statements be made\nso as to not prejudice this claim in any way which can happen if public or private comments are made\nabout this claim by City staff or Council Members.

Adopt Resolution No. 2026-06 Calling for and giving notice of a general municipal election to\nbe held on Tuesday, November 3, 2026;\n2. Adopt Resolution No. 2026-007 Requesting that the Board of Supervisors of the County of Los\nAngeles consolidate the City’s general municipal election with the statewide election to be held\non the same date pursuant to Section 10403 of the California Elections Code;\n3. Adopt Resolution No. 2026-008 adopting regulations for candidate statements submitted to the\nvoters at the November 3, 2026 General Municipal Election.\n4. Adopt Resolution No. 2026-009 Providing for a procedure for determining by lot a tie among\ncandidates at the November 3, 2026 General Municipal Election in Accordance with Elections\nCode Section 15651.\n5. Authorize the Director of Finance to allocate an amount not to exceed $200,000 based on the\nCounty’s cost estimate for election-related costs in the Fiscal Year 2026/27; and

Adopt Resolution No. 2026-010, “A Resolution of the City Council of the City of Baldwin\nPark, California, Adopting the Amended Fee Schedule for Solid Waste Collection and\nRecycling Services to reflect Consumer Price Index Increases.”\n2. Consider authorizing the City CEO to start negotiations with Waste Management, Inc. on a 5-\nyear contract extension.

Appropriation of Additional Funds for Land Development and Engineering Plan Checking\nServices Agreement with RKA and extend the term of its contract and the term for John L.\nHunter Associates and David Volz Design to December 31, 2026.\nIt is recommended that the City Council:\n1. Authorize the Director of Finance to appropriate $70,000 from the General Fund for RKA\nAgreement; and\n2. Authorize the Director of Public Works to extend the Professional Services Agreement with\nRKA, John L. Hunter Associates, and David Volz Design for Engineering services; and\n3. Authorize the Director of Finance to make necessary budget adjustments to allow payments as\napproved for FY 2025/2026.

9. Approval of agreement with All City Management Services to provide school crossing guard\nservices for fiscal year 2026-2027\nIt is recommended that the City Council:\n1. Approve the contract with ACMS for crossing guard services; and\n2. Authorize the Mayor to execute the agreement; and\n3. Authorize the Director of Finance to make appropriations and necessary budget adjustments;\nand\n4. Authorize the Director of Finance to bill BPUSD for their share of the contract in the amount of\n$177,811.20
